(SPF.A) Dept., Dt.25-6-2001. The Andhra Pradesh Public Employment (Organisation of Local Cadres and Regulation of Direct Recruitment) Order, 1975 (Presidential Order) was re-published vide G.O. 1 18-10-1975. For effective implementation of the Presidential Order, orders and instructions were issued from time to time clarifying the course of action to be taken. Government noticed certain deficiencies in the implementation of the Presidential Order and consequently the Government have constituted a One Man Commission (SPF) i.e. OMC(SPF) vide 6.0. done in the "implementation of G.0.Ms.No.610, General Administration (SPF-A) Department, dated 30-12-1985 and tosort out the anomalies and also to suggest further follow up action for the rectification of defects, anomalies and irregularities, if any, and to arrive at estimates of deviations and anomalies in implementing the Presidential Order and also suggest remedial actions, which would include a mechanism to ensure implementation and monitoring of Six Point Formula". 2. The One Man Commission (SPF) submitted its Report and after detailed consideration, the following further instructions are issued in this ‘matter:- A-l) . Appointments to various categories of posts in the under ‘mentioned offices are made either on Deputation, on Tenure, on Other Duty and also under Rule 10 (a) (i) of the Andhra Pradesh State and Subordinate Service Rules. Para 9 (B) (I) of G.0. P No. 728, G.A. (SPF.A) Dept., Dt. 1-11-1975 specifies that all such appoinunents in the Departments of Secretariat., Offices of Heads of Departments, Special Offices or Establishments, State Level Offices or Institutions and Major Development Projects are to be on the basis of a" Fair cited’ and came into force fromsa cited, to "make study of the injustice 2 Share Principle". This principle would require that such appointments are to be made from local cadres in proportion t0 .. ep ruman oppo com/201 1 eatmeame=no9742m:204-50-gadns ht us ergn0is snumandla, CIRCULAR MEMONo 97462 2004 S0GADMEDEPTDT 04-10-2006 the basic strength of such local cadres, In this light, the offices are directed to: - i) identify the local cadres from which the current appointees are presently in office, and ii) to make adjustments by way of repatriation’ and demotion as required in order to ensure that the fair share principle is maintained. A-2) All employees who have been posted on office and later on absorbed in the post and thereafter promoted, should be identified. In all such cases, the orders of absorption/promotion shall: be reviewed so as to ensure conformity with reference to the Fair Share principle. In the event some promotions have been ordered in excess of such principle, the concerned should be demoted and then repatriated to their respective local cadres. The consequential vacancies ‘may be filled with personnel who are qualified in accordance with the Rules. B) The Department shall be fixed according to the number of persons involved in Administrative Work alone and not based cfn line functions. In case of personnel discharging administrative as well as line functions, the function which is predominant shall be taken’ into account while determining whether it is an administrative or a line function. ©) The Departments concerned shall immediately identify Other Duty to anyCadre strength in each office of the Head of the"Major Development Projects" 525 (E) and communicate the same to General Administration Department. Thereafter, the General Administration Department shall update’ the list of GSR 525 (E) by obtaining the concurrence of Government of India. D) The Departments concerned shall" immediately identify the non functional offices listed in the GSR 526 (E), GSR 527 (E) and GSR 529 (E) for deletion and also identify the new eligible offices for inclusion. Necessary proposals shall be sent by all the concerned Departments to the General Administration (MC) Department for obtaining concurrence of the Government of India. E) From 1-11-1975, members of the Establishment regularized from time to time in accordance with the orders and instructions as issued at that time. With regard to such which are not included under G.S.R.Work-chargedin various projects would have been a regularized work charged establishment, the following instructions are issued:~ 1) the local status of each Member must be identified 4s per instructions mentioned in G.O. P. No.729, G.A. (SPF.A) Dept., Dt. 1-11-1975. iv) Hereafter, as and when regularization is permitted by the extent rules of the Departments concerned, no non-local candidates shall be absorbed till all local candidates are absorbed. v) After absorbing all the local candidates, the nonlocal candidates can be absorbed withint the permissible ratio. F) The Municipal Administration and Urban Development Department are directed to take immediate necessary action to bring all their creation under the purview of Presidential Order, 1975, in order to organize the local cadre, The M.A shall send proposals to G.A. (MC) Dept., within three months. @ The Presidential Order, 1975 shall be strictly applied. With regard to the different categories of employment, the Unit of Appointment is as follows:- i) For all categories equivalent to Junior Assistants and below, the Unit of Appointment shall be the District. {i) For all non-gazetted categories of posts above the level of Junior Assistant, the Unit of Appointment is the Zone as defined in the Presidential Order. lil) For all the gazetted categories, the State is the Unit of Appointment except for the Categories" shall be the Zone. Departments shall immediately review the existing cadre strength, and regularly thereafter, in the ‘month of April every year,’ to ensure that the percentages above are adhered to. * D Appointments on dependents of deceased Government employees, shall only be in accordance with the definitions given to the Local Area / Local Candidate in the Presidential Order, 1975, except, in the case of Offices to which the Presidential Order is not applicable. J-L) The First Schedule under para 2 (1) (a) of the Presidential Order, 1975 has defined the which comprises specified urban rural areas and Panchayats. As Panchayat areas have ceased to exist ~ue to the creation of Municipal Bodies, in order to ensure that the City of Hyderabad is defined within the terms of the First Schedule, it is ordered that the Panchayat area should be read to mean the Revenue Villages which constituted these Panchayats as on 18-10-1975. J-2) The Revenue Department shall furnish the details of the Revenue villages which comprised the erstwhile Panchayats as listed in the First Schedule, so as to amend the Presidential Order to that extent. The geographical limits of this Hyderabad), shall remain immutable for all the times to come. "Compassionate Grounds" to the" City of Hyderabad" as a Unit(City ofhaving been defined in the Presidential Order, 5 J-3) Further, in order to remove misconceptions and misdefinitions, it is clarified that the Presidential Order has no where defined any "Free Zone" or Hyderabad City Zone. The only specified area in the Presidential Order is the Unit called the City of Hyderabad which is constituted by the areas as set out above. The Presidential Order requires that appointments to certain categories of posts and to the extent mentioned in G.S.R. 528 (E), shall only be trom the local candidates rrom the City of Hyderabad. The term local candidate will be as set out in the Pr~sidential Order itself. K) The local status of the selected candidates shall be determined as per the established procedure. L) All the appointing authorities are directed entries in the Service Registers his/her Local Status, in aC'cordance with Para 7 of the Presidential Order, 1975. 3. All Departments of Secretariat are directed to take action as per above orders. The Departments should also review the progress of implementation of the above and send a monthly status report to G.A.
