Republic of the Philippines DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT DILG-NAPOLCOM Center, EDSA corner Quezon Avenue, Quezon City ‘Telephone Number 925.11.48 + 925.88.88 + 925.03.52 wow dilg.gow-ph ‘Terms of Reference Program Management Office Capacity Enhancement for People’s Law Enforcement Boards (PLEB) L Rationale Pursuant to Section 43(a) of Republic Act No. 6975 or the DILG Act of 1990: “Within thirty (30) days from the issuance of the implementing rules and regulations by the Commission, there shall be created by the sangguniang panlungsod/bayan in every city and municipality such number of People's Law Enforcement Boards (PLEBs) as may be necessary: Provided, That there shall be at least one (1) PLEB for every municipality and for each of the legislative districts in a city. The PLEB shall have jurisdiction to hear and decide citizen's complaints or cases filed before it against erring officers and members of the PNP. There shall be at least one (1) PLEB for every five hundred (500) city or municipal police personnel.” To ensure the sustained compliance of local governments with the mandates of Section 43 of R.A. No. 6975, and to continually provide technical assistance and capacity development to PLEBs, a Program Management Office (PMO) shall be created to carry out the program. IL Roles of the PLEB PMO ‘The PMO shall be the office primarily responsible for the following: i, Ensuring collaboration with the NAPOLCOM, Concerned DILG Officials, Bureaus, Services and Regional Offices and other Agencies for concerted and cooperative engagements; ii, _ Ensuring the smooth operations of the PLEB Program Operating Unit at the Central level, and the establishment of the their Regional counterparts; iii, Providing capacity development and training seminars to capacitate DILG and NAPOLCOM personnel and local government units, specifically PLEB members in the performance of their duties and responsibilities; iv. Developing a monitoring system for PLEBs, to be able to track the following, among other parameters: A. How many PLEBs are organized within the LGU? B. How many cases have the PLEBs received? C. How many cases have been resolved? v. Providing assistance to LGUs for the following: a. Creation of a dedicated PLEB Office; b. Program for PLEB Secretariat Volunteers; c. PLEB benefits per R.A. 8551; d. Ocular Inspection of PLEBs; and e. Annual Inventory of Cases IIL Organizational Structure of the PLEB PMO CO PLEB Program Head A. Program Head (Salary Grade 18 ~ Php 35,693.00/month) i. Qualifications Must have at least one (1) year of relevant work experience managing programs or projects relative to local governments Preferably with a Bachelor of Laws degree, or a Master’s Degree relevant to the job ‘Must have working knowledge of the law; Must have good leadership skills; Must have above average analytical, oral and written communication skills; Must have the ability to deliver results under pressure; and Must have the ability to work well in a multi-disciplinary team and relate well in diverse range of stakeholders at local and national levels. Functions ‘The PLEB Program Head, in close coordination with the Bureau of Local Government Supervision, shall: Take the lead in the overall planning, organizing, and coordination for program implementation of the Capacity Enhancement for PLEBs, with focus on: © Training for PLEBs © Provision of technical assistance to PLEBs © Monitoring and Evaluation of PLEBs; Spearhead the drafting of policies, guidelines, and rules in the proper appreciation and implementation of the program, its processes, and activities; Ensure that the financial and manpower resources are managed in the most efficient and effective manner towards accomplishing the objectives of the program; Ensure that the physical and financial targets are delivered, and the objectives and outcomes are achieved through close coordination with partner agencies and local government units; Ensure the provision of technical assistance to PLEBs through trainings, conferences, and seminars; Oversee the performance and the carrying-out of the functions of the Manila Bay PMO’s staff; Ensure close coordination with concerned DILG Offices, NGAs, and the private sector for the advancement of the program; Cause the drafting and submission of necessary documents as requested by top management, partner agencies, and other concerned offices; Represent the Department in inter-agency working groups and meetings related to the program and those committees necessary for the proper implementation of the program; Undertake fieldwork or travel in relation to the performance of the Program Chief's above-mentioned responsibilities. The Department, through the designated fund source, shall cover the Program Head’s actual transportation expenses and daily allowance for food and accommodation not to exceed the daily rate of per diem given to regular employees on official travel, and subject to the usual accounting and auditing rules and procedures; and ‘* Undertake other management functions as may be required by superiors/top management. B. Legal Officer (Salary Grade 16 ~ Php 30,044/month) i. Qualifications Must have at least one (1) year of relevant experience; Must have a Bachelor of Laws degree; Must have knowledge of relevant rules and regulations, policies, procedures and operations of the PLEB, as well as of local governments in general; Must have the ability to apply legal and administrative expertise to analyze a diverse range of complex and unusual issues and problems, and to develop innovative and creative solutions; Must have good research and policy formulation skills; Must have above average analytical, oral and written communication skills; Must have the ability to deliver results under pressure; and Must have the ability to work well in a multi~ and relate well in diverse range of stakeholders at local and national levels. sciplinary team Functions ‘The PLEB Legal Officer shall: * Draft contracts, briefs, notices, memoranda, circulars, correspondence, orders, reports, and other necessary issuances and paperwork; * Undertake necessary legal and legislative research or study ‘on matters relative to the PLEB and draft preliminary decisions about actions to be taken, for submission to the superiors; * Provide capacity development to PLEBs through trainings, conferences, and seminars; * Provide legal advice and counsel on other official matters; * Represent the Department in inter-agency working groups and meetings related to the program and those committees necessary for the proper implementation of the program; © Undertake fieldwork or travel in relation to the performance of the Legal Officer's above-mentioned responsibilities. The Department, through the designated fund source, shall cover actual transportation expenses and daily allowance for food and accommodation not to exceed the daily rate of per diem given to regular employees on official travel, and subject to the usual accounting and auditing rules and procedures; and Perform other functions that maybe assigned by the superiors/management C. PLEB Information Technology Officer/Programmer (Salary Grade 16 — Php 30,044/month) i, Qualifications Must have at least 2-years work experience on managing projects or programs funded by the government or International Funding Institution; Must be a Degree holder on Information Technology, Computer Science/Computer Engineering, or equivalent; Must have relevant experience on online database creation and management; Must have good analytical, oral and written communications skills; and Must have the ability to work well in a multi-disciplinary team and relate well in diverse range of stakeholders at local and national levels. ii, Functions ‘The PLEB IT Officer/Programmer shall: Perform research and analysis on the front-end and back- end coding and workflow; Assist in the formulation of process workflow for the PLEB Database System (PDS); Render support in developing database management system for both front-end and back-end; Assist in the conceptualization of the front-end and back- end interface of the PDS ; Provide assistance in the revision and enhancement of the PDS interface; Track the data of all PLEBs being monitored by the program and provide summary reports on the same at the end of each quarter; Go on fieldwork or to travel in relation to the performance of the IT Officer's above-mentioned responsibilities. The Department, through the designated fund source, shall cover actual transportation expenses and daily allowance for food and accommodation not to exceed the daily rate of per diem given to regular employees on official travel, and subject to the usual accounting and auditing rules and procedures; and Undertake other functions as may be required by the superior. D. PLEB Assistant Information Technology Officer/Database Systems Officer (Salary Grade 13 — Php 23,257/month) i. Qualifications * Must be a Degree holder on Information Technology, Computer Science/Computer Engineering, or equivalent; * Must have good analytical, oral and written communications skills; and * Must have the ability to work well in a multi-disciplinary team and relate well in diverse range of stakeholders at local and national levels. ii, Functions The PLEB Assistant IT Officer shall: * Assist the IT Officer/ Programmer in the conceptualization, revision and enhancement of the PLEB Database System; * Track the data of all PLEBs being monitored by the program and provide input to the IT Officer/Programmer for the preparation of summary reports on the same at the end of each quarter; * Go on fieldwork or to travel in relation to the performance of the IT Assistant Officer’s above-mentioned responsibilities. The Department, through the designated fund source, shall cover actual transportation expenses and daily allowance for food and accommodation not to exceed the daily rate of per diem given to regular employees on official travel, and subject to the usual accounting and auditing rules and procedures; and * Undertake other functions as may be required E. _PLEB Technical Assistant (Salary Grade 11 — Php 19,620/month) i Qualifications * Graduate of a four-year course. Preferably, a Baccalaureate Degree holder in Commerce, Development/Social Studies, Public Administration or Communications; * Must have good analytical, oral and written communications skills; and ‘* Must have the ability to work well in a multi-disciplinary team and relate well in diverse range of stakeholders at local and national levels. ii, Functions The PLEB Assistant IT Officer shall: * Assist the IT Officer/ Programmer in the conceptualization, revision and enhancement of the PLEB Database System; © Track the data of all PLEBs being monitored by the program and provide input to the IT Officer/Programmer for the preparation of summary reports on the same at the end of each quarter; * Go on fieldwork or to travel in relation to the performance of the IT Assistant Officer's above-mentioned responsibilities. The Department, through the designated fund source, shall cover actual transportation expenses and daily allowance for food and accommodation not to exceed the daily rate of per diem given to regular employees on official travel, and subject to the usual accounting and auditing rules and procedures; and * Undertake other functions as may be required 'V. Duration and Place of Assignment The contract shall be for a maximum duration of six months and renewable at the end of each semester upon endorsement of the Head of the Office/Bureau where the PMO is lodged. The Program will be based at the DILG Central Office located at DILG NAPOLCOM Center, EDSA corner Quezon Avenue, Quezon City. The assignment will involve extended visits to covered regions, LGUs. V. Contract Cost and Payment Details Payment for the PLEB PMO shall be on a monthly basis, subject to the usual accounting practices and requirements of the Department, and shalll be funded and made through the PLEB Fund. Approved by: iL Q. GOTIS, CESO III jirector IV, BUSS GENERAL GUIDELINES FOR THE IMPLEMENTATION OF THE PROGRAM CAPACITY ENHANCEMENT FOR PEOPLE'S LAW ENFORCEMENT BOARDS (PLEB) A. Legal Bases Pursuant to Section 43(a) of Republic Act No. 6975 or the DILG Act of 1990: “Within thirty (30) deys from the issuance of the implementing rules and regulstions by the Commission, there shell be created by the sangguniang panlungsod/bayan in every city and municipality such number of People's Law Enforcement Boards (PLEBs) as may be necessary: Provided, That there shall be at least one (1) PLEB for every municipality and for each of the legislative districts in a city. There shall be at least one (1) PLEB for every five hundred (500) city or municipal police personnel,” Further, Republic Act No. 10924 or the General Appropriations Act of FY 2017 reads, quote: “The amount of One Hundred Million Pesos (P100,000,000,00) shall be used for the implementation and capacity enhancement of the People’s Law Enforcement Board to ensure its fanctionality and effectiveness in accordance to the provision of R.A, No. 6975 and R.A. No. 8551. The DILG and its attached agencies and other stakeholders shall implement the ‘Program based on the design and guidelines issued by DILG." To fully implement the provisions of the abovementioned, these Guidelines are hereby issued B. Objectives The Department of the Interior and Local Government (DILG), in close coordination with the National Police Commission (NAPOLCOM) and other stakeholders, shall: 1. Provide technical and financial assistance to local government units for the creation of PLEBs; 2. Provide capacity development activities for PLEBs; and Closely monitor the performance of the PLEBs C. Coverage ‘The Program is of National coverage, but for CY 2017, initial focus is on the Three Hundred One (301) PLEBs aimed to be created and/or strengthened in local government units within Regions III, IV-A and the National Capital Region (NCR). Other LGUs are to be covered in CY 2018. D. The PLEB Program Management Office (PMO) For the promotion of public interest, and to ensure the sustained compliance of local governments with the mandates of Section 43 of R.A. No. 6975, a PMO shall be created to carry out the program. Pending the creation and operation of the PMO, the Bureau of Local Government Supervision shall temporarily act as the implementing office of the program, working in partnership with the NAPOLCOM. In addition, drafting of necessary documents for the cxeation of the PMO shall be the responsibility of the said Bureau. E. Roles of the PLEB PMO ‘The PMO shall be the office primarily responsible for the following: ii iti, iv. Organizational Structure of the PLEB PMO_ CO PLEB Program Head PLEB IT Officer PLEB Legal (Programmer) Officer PLEB Assistant IT PLEB Technical Officer Assistant DILG Regional PLEB PMTs ‘The Bureau of Local Government Supervision is tasked to supervise the Program Management Office of the PLEB, which shall consist of the following: ‘A. PLEB Program Head- shall oversee the implementation of the Program B. PLEB IT Officer (Programmer)- mainly in charge of developing and maintaining the monitoring and system for the PLEB C. PLEB Legal Officer- tasked to do legal research, policy formulation, and other such tasks D. PLEB Assistant IT Officer- shall assist the PLEB IT Officer. Also mainly in charge of actual monitoring B. PLEB Technical Assistant- mainly in charge of administrative matters such as planning, budgeting, coordination, etc. Consequently, for CY 2017, DILG Regional Offices of Regions III, IV-A and NCR are directed to create their PLEB Program Management Teams (PMTs) under the said PMO, with the following members: ‘" PLEB Regional Program Head « PLEB Regional Legal Officer ‘LEB Regional IT Officer + PLEB Regional Technical Assistant ‘Additional Staff may be hired by the Region as determined by the need of the Regional Office concerned. F. About the PLEB ‘The following are the Functions, Powers and Duties of the PLEB, Composition of the PLEB, and the indicative procedure for PLEB, subject to amendment and/or adoption through laws and NAPOLCOM Memorandum Circulars and/or Resolutions: a. Functions, Powers and Duties The People’s Law Enforcement Board empowers the people against abusive and erring policemen. It has the power to hear and adjudicate all citizen's complaints formally filed with, or referred to it, against any uniformed member of the PNP, and, if warranted, impose the corresponding penalty. b. Composition of the PLEB Per Section 3, Rule 11 of NAPOLCOM MC No. 2016-002, titled REVISED RULES OF PROCEDURE BEFORE THE ADMINISTRATIVE DISCIPLINARY AUTHORITIES AND THE INTERNAL AFFAIRS SERVICE OF THE PHILIPPINE NATIONAL POLICE: Sec. 3. Composition. - The PLEB shall be composed of the following: a) A member of the Sangguniang Panlungsod/Bayan chosen by the respective senggunian; ) A punong-barangay of the city or municipality concerned chosen by the Liga rng mga Barangay: and c) Three (3) other members who can be removed only for cause, chosen by the city/municipal peace and order council from among the respected members of the community known for their probity and integrity, one (1) of whom must be @ ‘woman and another, a member of the Bar, or in the absence thereof, the principal of the central elementary school in the locality, or, a college graduate. ‘The Chairman of the PLEB shall be elected from among its members. Except as provided in this Section or as may be provided by law, a public official ‘or employee is disqualified for appointment or designation as member of the PLEB. Applying the provisions of Article 152, Chapter IV, Title III, Book II of the Revised Penal Code, the members of the PLEB are considered persons in authority. c. General Rules of Procedure for PLEB 1. Filing of Complaint 2. Evaluation to determine jurisdiction (refer to Section 41(a) of RA 6975, as amended) 3, Service of Notice /Summons 4, Hearing 5. Decision- the PLEB shall render a decision within 15 days from filing of the complaint 6. Motion for Reconsideration, if any 7. Implementation- PLEB decision is implementable even pending appeal 8. Appeal- Any appeal on the decision of the PLEB may be raised to the Regional Appellate Board of the NAPOLCOM; RAB decision is to be made within 15 days G. Funding Source Alll expenses in the operation of the PMO and the conduct of the Program's activities shall be chargeable against the PLEB Funds. ‘The Central Office PMO shall require quarterly accomplishment reports from the concerned Regional Offices to be able to monitor progress in implementation, as well as fund utilization. Hi. Repealing Clause Any amendments issued by duly authorized persons, the PMO, or its alternate, shall ‘ot invalidate portions of these guidelines which remain unaffected.
