Fact:

Plaintiff is a 20 year old unmarried girl who had an amorous relation with the defendant, a 23
year old unmarried guy. Out of their affection, plaintiff gave birth to a baby boy and the two lovers
became parents. Defendant provided paternal support for the plaintiff and child during the pre and post
birth period of their offspring.

Plaintiff got pregnant with their second child however the defendant left without reason and
got married with another person. In effect, plaintiff filed for damages on breach of marriage promise
and requires defendant to obligate his paternal duty on the plaintiff’s two children.

Court of First Instance ordered defendant to attend his paternal obligation on his first child.

Both parties however appealed on the lower court’s decision, plaintiff’s motion for relief was
disregarded and defendant still contests the court ruling.

Issue:

Should the plaintiff’s petitions for recovery and child recognition be granted?

Held:

No, referring to examination and evidences from correspondences between the two parties,
discussion about marriage never existed. As for the defendant, acknowledgement of paternity is
confirmed by a document of indubitable trait.

Wherefore, judgment appealed is in all respects affirmed without costs.
