Q#1: Is access to safe and legal abortion of transcendental importance to warrant its

decriminalization?

TS#2: Access to safe and legal abortion is contemplated is a basic human right and is
contemplated in the Philippine Constitution as to warrant its decriminalization.

TS#3: Access to safe and legal abortion should be accorded to every Filipino citizen
and thus, should warrant its decriminalization

Why this?
 We get to present Roe vs. Wade where its primary contention is that abortion
is a constitutional right (US Cons
 We get to quote PC provision on the protection of both mother and child.. not
only child
 We get to provide statistics from other countries regarding maternal
healthcare improvement
 We get to emphasis on every human’s right of choice
 We get to emphasis on the equal protection clause (the rich can fly to other
countries to avail of it, the poor do not have that option)
 We can still clamp on transcendental importance as one of the points

Issues
 Abortion = Murder  We limit the number of months a person can abort,
make use of NCC/FC to limit the ages - make use of Maputo Protocol +
Sharia law to illustrate such limitations occur as well (Note: See if PH is a
signee to any treaty )
 Protection of the child? No answer yet
 As to right of choice, how? People have different opinions as to what is right
and what is wrong. In our present Penal Laws, abortion is a criminal act,
therefore the lawmakers have instantly branded it is a wrong, as a
punishable offence. In addition to the Penal Code being over 300 years old
and not up to date with the current needs of society, it fails to take into
consideration those who believe that abortion is not akin to murder, it fails to
take into consideration those whose beliefs differ from theirs. By the
decriminalization of abortion and by providing access to safe and legal
abortion procedures, the law would be in tune with those who are pro-
abortion and those who are not.
