Lawary, b/m, 08/14/80 SWORN STATEMENT OF POLICE OFFICER The undersigned officer hereby states that on the 12" day of August, 2018, at about 5:23 (A.M: police officer of the Decatur Police Department made a warrantless arrest of Michael L. Lawary, b/m, 08/14/80 at 3750 N. Moundford Ave. in Macon County, Illinois upon the following grounds or cause: The following incident occurred in Decatur, Macon County, IL. ‘On 08/12/18 at 1550 hours 1, Set. A. Jahraus, responded to 3750 N. Moundford Ave. in reference to a domestic incident. Upon my arrival I spoke with 17-year-old Kaeden J, Lawary. Kaeden stated he was in his bedroom playing video games when his father Michael L. Lawary arrived home from work at approximately 1530 hours. Kaeden stated a verbal argument took place between his father Michael and he regarding something that had occurred overnight. Kacden stated during this argument his father Michacl took his (Kaeden's) cell phone and left the room with it. Kaeden stated he followed Michael across the hallway to a bedroom Michael walked into. Kaeden stated his mom, Jaya Lawary, was on the bed in this bedroom. Kaeden stated he asked Michael for his phone back because what he needed to complete for his homework assignments was on the phone. Kaeden stated Michael tured around and approached him while accusing him of “running up on him.” Kaeden stated Michael then punched him with a closed fist one time in the stomach before pushing him out into the hallway outside the bedroom. Kaeden stated Michael grabbed him by the shirt collar and pushed him up against the hallway wall. Kaeden stated Michael began throwing closed fist punches at him while keeping him pinned against the wall. Kaeden stated his father Michael punched him approximately 10-12 times in all with a closed fist. Kaeden stated the punches struck him in the stomach, chest, shoulder and right side of his face. Kaeden stated his mother Jaya was able to eventually separate them. Kaeden stated while being pinned up against the wall at one point one of Michael's hand was around his neck. Kaeden stated his airway was not restricted as he could still breathe but he was unable to talk. I would observe injuries to Kaeden in the following areas, redness to his left pectoral area, red mark under left pectoral, redness to upper left shoulder/upper left arm area, swelling to his right eye, red mark near right eye, red marks to the right and left side of neck, These injuries were consistent with being in a physical altercation in which he was punched and grabbed. I then spoke with Kaeden’s mother Jaya Lawary. Jaya stated she was upstairs in her bedroom ‘when her husband and Kaeden’s father, Michael L. Lawary artived home from work. Jaya stated she heard Michael asking Kaeden about a situation that had occurred overnight and an argument ensued, Jaya stated Michael walked into their bedroom and she saw that he had Kaeden’s phone. Jaya stated Kaeden walked to the bedroom doorway and asked Michael if he could have his phone back. Jaya stated Michael turned around and made a statement about Kaeden “walking up on him.” Jaya stated at this time Kaeden was still in the doorway and was separated from Michael by 3 to 5 feet. Jaya stated Michael approached Kaeden and threw a punch at him. Jaya stated it happened so fast she wasn’t sure where Michael was even trying to punch Kaeden. Jaya stated the fight moved out into the hallway and she quickly began*trying’to separate Michael and Kaeden while Michacl was continuing to throw multiple punches at Kaeden, Jaya stated at one-point Michael had Kaeden pinned up against the wall in the hallway while throwing punches. Jaya stated the physical altercation continued Michael and Kaeden were able to be separated. Jaya stated Kaeden did nothing to start the physical altercation and that Michael had thrown the punch that began the altercation without any justification.
