‘MEMORANDUM OF UNDERSTANDING BETWEEN CORNWALL-LEBANON SCHOOL DISTRICT AND SOUTH LEBANON TOWNSHIP POLICE DEPARTMENT, NORTH LEBANON TOWNSHIP POLICE DEPARTMENT, BOROUGH OF CORNWALL POLICE DEPARTMENT, NORTH CORNWALL TOWNSHIP POLICE DEPARTMENT ‘AND PENNSYLVANIA STATE POLICE THIS MEMORANDUM OF UNDERSTANDING between the CORNWALL LEBANON SCHOOL DISTRICT and the SOUTH LEBANON TOWNSHIP POLICE DEPARTMENT, the NORTH LEBANON TOWNSHIP POLICE DEPARTMENT, the BOROUGH OF CORNWALL POLICE DEPARTMENT, the NORTH CORNWALL ‘TOWNSHIP POLICE DEPARTMENT, and the PENNSYLVANIA STATE POLICE is entered into pursuant to the Public Schoo} Code, as amended, including the Safe Schools provisions found ~ a Amicle XGA. and in particular, Section XIli-1303-A. THIS MEMORANDUM OF UNDERSTANDING is intended to describe the general role and responsibilities ofthe School District and ofthe local law enforcement authorities relating to violations of school rules andthe laws of the Commonwealth of Penasyivania, and in particular, acts of violence or possession involving a weapon brought onto any schoo! property ar brought to any school-sponsored activity, ‘THIS MEMORANDUM OF UNDERSTANDING reaffirms the commitment of the Sebs District an the local law enforcement authorities to work together in addressing issues facing the ‘youth of our community. The School District agrees tht it wil: (@) Inform all students of all school disciplinary consequences; () Follow the due process procedures outlined in school policy and as set out in the Pennsylvania Code and the Public School Code; (©) Report to the appropriate loeal police department all student ations in violation of local andor state laws as described as follows. The appropriate police department will respond to calls involving potential criminal activity: ie., tefs, assaults, bomb tats, tafic incidents and mae accidents on campus, as wall as other incidents nomally involving polise participation. Police will patcpate ina serch fr stants who le fom a School Distr building in order toretum the student tothe School District building and fr student safety purposes Polie will not respond forthe purpose of counseling students; (@) Make all cals for police service through the Lebanon County Emergency Management Agency: if an emergency call, dialing 911; if « non- emergency call, dialing 272-204, Direct contacto police department office will not be made; and (©) Apprise local police departments of schoo! policies as they pertain te legal iotuee, including, but nt necessarily limited to, drug and sleshol matters, weapons, access fo students at schoo, student abuse, and providing of information ‘obtained by @ Schoo! District investigation, ‘The local law enforcement authorities will (a) Investigate reports initiated by the School District, where appropriate, conduct investigation initiated as 2 result ofa report initiated by the ‘School District, make the final decision on whether prosecution is warranted or nat sand, where appropriate, pursue prosecution; (©) Upon arival st schoo! will always inform the chief administrator or Gesignce of their presence, and when possible, deserbe their purpose in being at the schools (©) Honor sciool policy with respect to student access during the school day; (@)__Be available to consult with school officials on issues relating to student behavior and actions and the law; (©) Will respond to calls involving potential csiminal activity: ie. thefls, assaults, bomb threats, traffic incidents and traffie accidents on campus, as well as other incidents normally involving police participation, Police will Participate in search for students who flee from 8 School District building in order ie student tothe School District building for student safety purposes; and (9, Will not respond forthe purpose of counseling students, POLICE WILL NOT ACCEPT COMPLAINTS DIRECTLY FROM PARENTS/QUARDIANS OR STUDENTS INVOLVING INCIDENTS THAT OCCUR AT SCHOOL. INITIAL INVESTIGATIONS OF SUCH COMPLAINTS SHALL BE CONDUCTED BY SCHOOL STAFF, IF SCHOOL STAFF DETERMINES IT IS APPROPRIATE TO CONTACT POLICE, THEN SCHOOL, STAFF SHALL PROMPTLY CEASE THEIR INVESTIGATION AND ‘CONTACT THE APPROPRIATE POLICE DEPARTMENT; ‘The School District and the local law enforcement authorities agree to work together to prevent potentially troublesome and/or illegal behaviors by students and, whenever possibe, wll coordinate their efforts with respect to students and their families. ‘The pates hereto understand and agree to the provisions ofthis MEMORANDUM OF UNDERSTANDING. It is the intent ofthe School District to review this MEMORANDUM OF UNDERSTANDING on s regular basis to determine whether it ned be revised or refined in any way.
