1. l have probable cause to believe the defendant committed the crimes of Armed criminal
action (RSMo. 571.015), and Murder, second degree (RSMo. 565.021) in that on or about 2:54 a.m.
T1e defendant called 911 to report that he had shot an acquaintance at his residence. The defendant
advised dispatch that the acquaintance was not breathing. Police and EMS respond to the scene
where the victim was pronounced dead. The defendant was taken into custody and advised of his
Miranda rights. The statement of the defendant was that the victim had been verbally harassing him
for several days and that the victim had been texting just before arriving at the defendants residence
around 3 am. The defendant further stated that he ansWered the door with his pistol in hand, told the
defendant to leave, and then shot him. The victim, who was unarmed, was struck twice. The
defendant did not express that the victim had threatened his life.
