‘Subject: 9/5 Planning Commission Item Docket #6 - Proposed Text Amendment to Section 4-702 Zoning Ordinance To: Chair Mindy Lyle and Members of the Ad Hoc Eisenhower West/Landmark Van Dorn Implementation Advisory Group Re: ission Docket Item #6, Proposed Text Amendment to Section 4-702 to the Commercial Re; As a Member of the Ad Hoc Eisenhower West/Landmark Van Dom Implementation Advisory Group, I am writing to inform you of a proposed Text Amendment to Section 4-702 to the Commercial Regional (CR) Zone to permit the homeless shelter use in the Commercial/Regional (CR) Zone. Howard Hughes Corporation (HHC), the majority owners of the Landmark Mall, is in discussions with Carpenter’s Shelter regarding possible accommodation of the Shelter’s activities during the Shelter’s redevelopment. This proposed change would facilitate temporary use of the Macy’s building in the Landmark Mall site by the Carpenter’s Shelter facility until their permanent new structure is completed on N. Henry Street. This interim Shelter location is suitable to provide temporary space for the use, with an empty building that can be quickly adapted to the use, ample parking, and four bus lines currently serving the site to provide transportation options. The new permanent Carpenter’s Shelter facility has an approved Development Special Use Permit (DSUP#2016-008) and it is anticipated to take 18-24 months for construction. Sears and Macy’s, and their associated portions of the Landmark Mall parking lot, are the only locations in the City currently zoned as CR, and it anticipated that the CR Zone will ultimately be eliminated in accordance with the recommendations of the adopted Landmark/Van Dom Corridor Plan, Regarding the status of Landmark Mall’s redevelopment: In Fall 2012, HHC approached the City with a phased redevelopment proposal. HHC had gained ownership of the central portion of the Mall, but the buildings that housed Macy’s and Sears were owned by those companies, respectively, and their ownership was disinclined to participate in redevelopment. Staff and HHC worked to design a proposal that met many of the goals of the City’s 2009 Landmark/Van Dorn Corridor Plan, while leaving the anchor stores unaffected. Plans were approved in June 2013 (DSUP#2013-0004), which included approval to rezone the central eleven acres of the 54 acre site from CR to Commercial Residential Mixed Use — Medium (CRMU-M). In June 2015, HHC returned to public hearing to request approval of DSUP#2015-0003, which added approximately 55,000 SF of residential and flex space. Since this approval, HC has been reviewing the site and participating in negotiations with Sears and Macy's ownership. In December 2016, HHC announced that they were purchasing the Macy’s site. In January, 2017, the Mall and the Macy’s store were closed. Communications continue between HHC and Sears ownership, and City staff anticipates that a new development proposal will be forthcoming, based on the outcome of those discussions. The City remains strongly supportive of and committed to the redevelopment of Landmark Mall and this change is to accommodate only interim use of the site until the new Carpenter’s Shelter facility is completed. The interim use is not intended to impact or delay the planned redevelopment of the Mall. The proposed Text Amendment is included on the Planning Commission Docket of September 5, 2017 as Item # 6. We found out about the proposal to put a batting cage and scoreboard in Ben Brenman Park by happenstance. No one from City staff bothered to contact us or our homeowners association nor are we aware of any other West End civic association that was contacted by City staff to discuss this proposal and obtain public input.
