RESOLUTION OF THE MERCER COUNTY IMPROVEMENT AUTHORITY ESTABLISHING A PROTOCOL REGARDING THE EXERCISE OF FREE EXPRESSION AT THE SUN NATIONAL BANK CENTER WHEREAS, the Mercer County Improvement Authority (the “Authority”) Is the owner of the Sun National Bank Center Arena located at 81 Hamilton Avenue, in the City of Trenton, New Jersey (“Arena”); and WHEREAS, the Authority Is obligated to operate the Arena in a manner that protects the safety of its patrons and promotes the efficiency of its operations; and WHEREAS, the Authority is required by law to permit persons to engage in activities, protected by free speech at and around the Arena In connection with an event(s) occurring at the Arena; and WHEREAS, the Authority is permitted to adopt reasonable time, place and manner restrictions on its premise in consideration of its operational prerogatives and the safety of Its patrons; and WHEREAS, the Authority is desirous in this Resolution of providing guidance to the public as to the time, place and manner rules regarding free expression activities at the Arena site as follows: NOW THEREFORE BE IT RESOLVED, as follows: 1. Persons wishing to hand out leaflets or otherwise engage in free speech activities at the Arena may do so anywhere on the public sidewalks and others areas for which the general public Is permitted; and 2. The Arena may designate restricted areas for patrons and authorized personnel only, but such restricted areas shall not include the public sidewalks and others areas for which the general public Is permitted; and 3, Persons are not required to obtain permits so long they do not comprise a group size that would require a City of Trenton permit to use the sidewalks; and 4, Nothing shall preclude restrictions or actions necessary for the safety of the public and the general operations of the facility provided such restrictions or actions are generally applicable to all persons, and 5. Nothing in this Resolution shall be construed to limit the enforcement of any applicable State Statutes ,City of Trenton and County Ordinances. ‘THEREFORE BE IT FURTHER RESOLVED, this Resolution upon adoption shall be Immediately communicated to the Mercer County Sheriff and shall simultaneously be publically posted on the Mercer County Improvement Authority's website.
