CANON 4.Engrs shall act in professional
matters for each employer or clients as

indiscriminately criticize another’s work.
-not to use equipment, supplies, laboratory
/office facilities to carry on outside private
practice w/o the consent of employer.
CANON 6.Engrs shall act in such a
manner as to uphold & enhance the
integrity, honor & dignity of eng’g
profession.
-not knowingly act in a manner that will be
derogatory to the integrity, honor &
dignity of eng’g profession
-not knowingly engage in business or
professional practices of fraudulent,
dishonest or unethical nature.
CANON 7.Engrs shall continue their
professional dev’t throughout their career,

under their supervision.

of contract doc & is professionally
responsible & liable for design of project.
CE in-charge of Constr’n is a CE who is
the signatory of the bldg. permit of a
project & is professionally responsible &
liable for the constr’n mgt & supervision
of project.
CE Prime Professional is a CE who is
responsible for the overall integration,
coordination & successful conduct of all
processes who is engaged in the proj from
inception to completion.
Continuing Professional Dev’t (CPD)
refers to the sustaining & progressive
learning that maintains, enhances or
increases the knowledge & continuing
ability of CEs.
ARTICLE II (Board of Civil Eng’g)
SEC3. Composition of the Board
Board of Civil Eng’g is a collegial body
under the administrative supervision of
Commission composed of a chairman &
four members.
*Chairman of the board is appointed by
president of Phils.
*This is endorsed by the Commission who
will select from atleast 3 nominees of each
position as submitted by PICE.
*Except to 1st chairman, only members of
the board that have served for atleast 1
year is qualified to be appointed as
chairman.
*Members of the board will hold office for
a term 3 years.
*First members of the board has the ff
terms: chairman (3 years), 2 members (2
years),& 2 members (1 year).
*No member of the board will be
appointed for 2 consecutive terms.
SEC4. Power & Duties of the Board:

SEC5. Qualifications (7) of Board
Members:
1. Resident & citizen of Phils.,
2. Atleast 30 yrs of age & of good
moral character,
3. Holder of bachelor’s degree of
Civil Eng’g from a recognized &
legally constituted school,
institute, college or university,
4. CE duly qualified to practice
civil eng’g in Phils.,
5. Have practiced civil eng’g, w/ a
certificate, for a period not less
than 10 yrs prior to his
appointment & 5 yrs of such
practice must either be a CE-of-
record, CE in-charge of
Constr’n, or CE Prime
Professional,
6. Not a member of faculty where
civil eng’g is taught,
7. Active member in good standing
of PICE
SEC6. Members of the board shall receive
compensation the sum comparable to the
compensation received like other members
of professional regulatory boards.
*CE in government appointed as member
of board shall receive compensation in
addition to the compensation received in
the service.
SEC7.The Board shall submit at the end of
fiscal year to Commission a detailed
reports & proceedings (ANNUAL
REPORT).

SEC13. All successful candidates of
examination are req’d to take oath b4 the
Board/gov’t officials authorized by
Commission prior to issuance of CoR.
*CoR shall be the authority to practice but
may be suspended/revoked by the Board &
the Commission after due notice &
hearing.
*All registered CEs are au2matically
members of PICE.
*Professional Identification Cards are
issued by Commission bearing the name,
picture, date of issuance, registration #,
expiration date, signature of chairman of
Commission.
*No professional identification card will
be issued to new registrants unless he can
present cert. of active membership.
*CE is req’d to indicate his CoR &
Professional ID Card, its date of issuance
& duration of validity, including the
professional tax receipt # on the plans &
docs.
SEC14. CEs shall obtain a seal in w/c
serial # is included in the design.
SEC15. Plans, drawings, specs & other
contract docs duly signed & sealed shall
remain intellectual property of CE.
SEC16.Board won’t issue CoR who have
not taken the oath of CEs.
SEC17. Board has the power subj to
Commission:
1. To suspend/revoke CoR for any
cause
2. To suspen/revoke CoR due to
malpractice, unprofessional,
unethical, immoral,
dishonorable conduct/non-
membership for 3 consecutive
years.
*When CoR is supended/revoked, prof.ID
will be ordered cancelled by chairman of
Comission.
SEC18. Board may entertain an
application for new CoR after the
expiration of 1 yr from date of revocation
& reasons are deemed sufficient.
*Other entities & orgs may be CPD
providers upon accreditation by Board &
PICE.
*Only specialists in each branch of
specialization may form SOCE provided
that SOCE is affiliated to PICE & one
SOCE for each recognized branch.
*Holder of CoS may use specialist title in
signing relevant plans & docs.
*Specialist ID card is issued by PICE to all
CEs w/ CoS.
SEC19. Upon effectivity, all CEs duly
registered in the provisions of RA 544 will
au2matically retain its registration status as
if they are registered under provisions
hereof.
*Cert of Recognition for advanced studies,
research or highly specialized training
issued under RA 544 shall be replaced w/
equivalent CoS by PICE.
ARTICLE IV (Miscellaneous
Provisions)
SEC21. It is unlawful to any person to
order/cause the constr’n, reconstr’n or
alteration to any bldgs./structures intended
for public gathering & assembly unless the
designs, plans & specs have been prepared
under the responsible charge of & signed
& sealed by a registered CE & unless the
constr’n, reconstr’n &/ alteration are
executed under direct supervision of reg
CE.
*Practice of Civil Eng’g is a professional
service, admission to w/c must be det upon
ind’l & pers’l qualifications.
SEC22. Sole proprietorship, partnership or
corporation may engage in consultancy
services as defined in NEDA guidelines:
1. The entity must be
owned/controlled by a reg CE
2. Such has been issued CoR by
Board
*Foreign nationals to include former
Filipino citizens desiring to practice Civil
Eng’g in Phils shall apply for a special
temporary permit from Board subj to
approval of Commission in accordance w/
the provisions of Sec 7(j) of RA 898.
*Roster showing names of businesses of
all reg CEs shall be periodically prepared
by Commission thru the Board.
ARTICLE V (Enforcement of Act &
Penal Provisions)
SEC23. It shall be the duty of all duly
constituted law officers to enforce the
provisions of this Act & to prosecute any
person violating the same.
SEC24. Enticing, compelling, coercing,
requiring or causing a duly reg CE to
perform/undertake any Civil Eng’g
works/professional services w/o executing
written service agreement, appointment or
employment contract shall be deemed
guilty of violation.
SEC25.Any person acting as if reg CE &
foreign nationals w/o the benefits of
special temporary permit shall be guilty of
misdemeanor, be sentenced to fine not
less than 100,000 nor more than 1M, or to
suffer imprisonment not less than 6 mos
nor more than 3 years or both at the
discretion of court.
*Foreign nationals w/o the benefits of
special temporary permit shall be subject
to deportation.
*All laws, part of laws, orders, ordinances
or regulations in conflict w/ the provisions
of this Act are repealed.
*No laws of other allied professions shall
limit the scope of practice of Civil Eng’g
nor shall exclude the CE from practicing
his profession provided that he does not
designate himself as other professional.
*If any part or section of this Act is
declared unconstitutional, such
declarations will not invalidate other
provisions.

ARTICLE 1(General Provisions)
*This Act shall be known as Government
Procurement Reform Act (GPRA).

Approved Budget for the Contract (ABC)
refers to the budget for the contract duly
approved by the Head of Procuring Entity
as provided for in the General
Appropriations Act.
BAC refers to Bids and Awards
Committee. The head of BAC shall not be
the Head of Procuring Entity.
Bidding Documents refers to the
documents issued by the Procuring Entity
as basis for bids, furnishing all
information necessary for the prospective
bidders to prepare a bid for the
Infrastructure Projects, Goods, and
Consulting Services to be provided.
Bid refers to a signed offer or proposal
submitted by a supplier, manufacturer,
distributor, contractor or consultant in
response to the bidding documents.
Competitive Bidding refers to the method
of procurement which is open for
participation to any interested party. This
consists the following process:
1. Advertisement
2. Pre-bid conference-to
clarify problems and issues,
i.e. req’ts
3. Eligibility screening of
prospective bidders
4. Receipt and opening of bids
5. Evaluation of bids
6. Post-qualification
7. Award of contract
Consulting Services refers to the services
for the Infrastructure projects and other
types of projects or activities of the
government requiring adequate external
technical and professional expertise.
PhilGEPS refers to Philippine Government
Electronic Procurement System.
Goods refers to all items, supplies,
materials and general support services
excluding consulting services and
infrastructure projects, which may be
needed in the transaction of public
businesses.
GPPB refers to Government Procurement
Policy Board and is the one , including
DBM, NEDA, and COA, who drafted the
IRR of this act.
Head of Procuring Entity refers to:
1. Head of agency for national
gov’t
2. Governing board for gov’t-
owned/controlled corporations
3. Local chief executive for LGUs
Infrastructure Projects include the
construction, improvement, rehabilitation,
demolition, repair, restoration or
maintenance of roads and bridges and the
like.
IRR refers to Implementing Rules and
Regulations.
Portal refers to a website that has a wide
variety of content for the purpose of
attracting large number of users.
Procurement refers to the acquisition of
Goods, Consulting services, and the
contracting of Infrastructure Projects by
the procuring entity. Procurement of real
property shall be governed by the
provisions of RA No.8974.
Procuring Entity refers to any branch,
department, office, agency or
instrumentality of gov’t, including state U
and C, gov’t-owned/controlled
corporations, gov’t financial institutions,
and LGUs procuring Goods, Consulting
services, and Infra Projects.
Domestic Bidder refers to any person or
entity offering unmanufactured articles,
materials or supplies of the growth or
production of the Philippines.
Domestic Entity refers to an individual or
a sole proprietor who is a citizen of the
Philippines or a partnership, corporation,
cooperative, or association duly organized
under the laws of the Philippines and of
which at least seventy five percent (75%)
of the interest or outstanding capital stock
belongs to citizens of the Philippines .
Executive Agreements refer to
International Agreements except that they
do not require legislative ratification.
Expendable Supplies refer to articles
which are normally consumed in use
within one (1) year or converted in the
process of manufacture or construction.
Foreign Bid refers to any offer of articles,
materials or supplies not manufactured or
not to be manufactured in the Philippines .
Foreign-funded Procurement refers to the
acquisition of goods, consulting services,
and the contracting for infrastructure
projects by the GOP which are wholly or
partly funded by Foreign Loans or Grants.
Foreign Grants refer to grants with no
repayment obligations and are provided in
monetary form, goods, works, and
consultancy services.
Foreign Loans refer to loans, credits, and
indebtedness with private foreign banks or
with foreign governments, agencies.
International Agreement refers to a
contract or understanding, regardless of
nomenclature, entered into between the
GOP and another government .
Non-expendable Supplies refer to articles
which are not consumed in use and
ordinarily retain their original identity
during the period of use .
Philippine National refers to an individual
or a sole proprietor who is a citizen of the
Philippines or a partnership, corporation,
cooperative.
Treaties refer to international agreements
entered into by the GOP which require
legislative ratification after executive
concurrence.
Universal or Commercial Banks refer to
universal or commercial banks duly
authorized under R.A. 8791, otherwise
known as “The General Banking Act of
2000”.
*To systematize the procurements process,
avoid confusion and ensure transparency,
the procurement process, including the
forms to be used, shall be standardized.
*The term “Bid” shall be equivalent to and
be used interchangeably with “Proposal”
and “Tender”.
ARTICLE II (Procurement Planning)
*All procurement should be within the
approved budget.
*Only those considered crucial to the
discharge of gov’tal functions shall be
included in APP (Annual Procurement
Plan).
*APP shall be approved by Head of
Procuring Entity.
*In infra projects, eng’g designs and
acquisition of ROW shall be included in
plan.
*Each agency should have PPMP
(Procurement Plan and Master Program)
and to be consolidated to be included in
APP.
ARTICLE III (Procurement by
Electronic Means)
*Info and communications technology
shall be utilized in procurement
procedures.
*There shall be a single portal that shall
serve as primary source of info on all gov’t
procurement.
*GPPB is authorized to approve changes
in procurement process.
*For non-common use items, infra proj
and consulting services, agencies may hire
service providers to undertake e-
procurement.
ARTICLE IV (Competitive Bidding)
*All procurement shall be done through
competitive bidding except as provided for
in Article XVI.
ARTICLE V (Bids and Awards
Committee)
*Each procuring entity shall establish its
BAC for its procurement.
*BAC shall be composed of atleast 5 not
more than 7 members designated by HPE
and chaired by third ranking permanent
official.
*BAC members shall have 1 year fixed
term and renewable at discretion of HPE.
*Cases of resignation, retirement,

*Cases of leave or suspension,
replacement shall serve for its duration.
*BAC functions:
1. advertise &/post invitation to bid
2. conduct pre-procurement & pre-bid
conferences
3. det. the eligibility of prospective bidders
4. receive bids
5. conduct of evaluation of bids
6. undertake post-qualification
proceedings
7. recommend award of contracts to HPE
*If recommendation is disapproved, such
shall be based only on valid, reasonable
and justifiable grounds.
*BAC shall also recommend to HPE the
use of Alternative Methods of
Procurement.
*BAC ensures that PE abides standards,
prepares monitoring report that shall be
approved and submitted by HPE to GPP on
semestral basis.
*BAC shall invite atleast 2 observers, in
addition to COA rep: 1 from private group
and the other from NGO.
*For infrastructure projects, national
associations of constructors duly
recognized by the Construction Industry
Authority of the Philippines (CIAP), such
as, but not limited to the following:
1.Philippine Constructors Association,
Inc.;
2.National Constructors Association of the
Philippines, Inc.;
3. Philippine Institute of Civil Engineers
*For consulting services, a project-related
professional organization accredited or
duly recognized by the Professional
Regulation Commission or the Supreme
Court, such as, but not limited to:
1. PICE;
2. Philippine Institute of Certified Public
Accountants (PICPA);
3. Confederation of Filipino Consulting
Organizations
*Observers should be duly registered to
SEC, do not have direct/indirect interest in
contract, and should meet the criteria for
observers as set.
*HPE shall create Secretariat to serve as
main support unit of BAC.
*PE may grant honoraria to BAC members
not to exceed 25% of their monthly salary
subject to availability of funds.
*GPPB shall develop the capacity of
BACs, Secretariat and TWG thru training
programs.
*The term “permanent” shall refer to a
plantilla position within the procuring
entity concerned.

*PE may require addt’l doc req’t or specs.
*Specs for Procurement of Goods shall be
based on relevant characteristics &
performance req’ts.
*Reference to brand names hall not be
allowed.
*No aspect of bidding docs shall be
divulged/released prior to the official
release.
PE ensures equal access to info.
ARTICLE VII (Invitation to Bid)
*BAC is mandated to hold a pre-
procurement conference on every
procurement except those contracts below
a certain amount specified in IRR, in
which case, the holding is optional.
P2M-below-pre-procurement is not req’d
(goods)
P5M-below-pre-procurement is not re’d
(infra)
P1M-below-pre-procurement is not req’d
(consulting)
*Pre-procurement assesses the readiness of
procurement for certification of
availability of funds.
*The conference is attended by BAC, unit
officials, consultants hired by agency &
rep of end user.
*Invitation to bids is advertised in PE’s
premise, in newspapers, PhilGEPS, and
website of PE.
*Invitation to Bid contains:
1. Brief description of subj matter
of procurement
2. A general statement on the
criteria to be used by PE
3. Date,time, & place of deadline
for submission & receipt of
eligibility req’ts, pre-bid conf,
submission and receipt of bids,
& opening of bids.
4. ABC to be bid
5. Source of funds
6. Period of availability of Bidding
docs and place where these may
be secured.
7. Contract duration
8. Other necessary info as deemed
by PE.
*Atleast 1 pre-bid conf shall be conducted
for each procurement.
*Pre-bid conf may be conducted upon
written request of any prospective bidder
subj to approval of BAC.
*Competitive Bidding is interchangeably
used as public bidding.
*Financial docs shall not be opened yet
unless technical docs are satisfied.
*Bidder may modify his bid provided that
is before the deadline of receipt of bids.
*The modification shall be sealed in an
envelope and identified as modification of
original.
*Bidder may withdraw his bid through a
letter before the deadline of receipt of bids.
*All bids shall be accompanied by a bid
security w/c serves as guarantee
that the winning bidder shall enter into
contract with PE w/in the stipulated time.
*2% of ABC for cash or cashier/mgr’s
check and bank draft/guarantee or
irrevocable letter.
*5% of ABC for surety bond callable
issued by insurance company
*Bids and Bid securities shall be valid for
such reasonable period of time indicated in
bidding docs.

ARTICLE VIII (Receipt & Opening of

and equal access to all prospective bidders.

electronically.
