Vacancies & Succession

Permanent vacancy - when an elective official fills a higher vacant office, refuses to assume
office, fails to qualify, dies, is removed from office, voluntarily resigns, or otherwise permanently
incapacitated to discharge the functions of his office.

 When vice mayor position is vacant, filled by highest ranking Sanggunian member.
>Permanent vacancies in Sanggunian where automatic succession, filled by appointment.

Nature of appointment
a. Permanent in nature, and for
b. Unexpired term
c. Acquires Security of tenure.
-Where permanent vacancy is caused by Sanggunian member belonging to a political party -
nomi and cert of political party
- not belong to political party- recommendation of sanggunian

Temporary vacancies- does not exceed 30 working days


Absence- powerless, for the time being, to discharge the powers and prerogatives of the office.

Chap 3. Local legislation

-Local legislative power shall be exercise by Sanggunian.


-The reasonableness of an Ordinance passed under a General, Implied, or Incidental.
