CC | t CIVIL SERVICE COMMISSION Guidelines Governing Access to SALNs Number, i 356 of Government Officials and Employees f filed with the Civil Service Commission Promulgdted:_15 MAR 2011 x x i | RESOLUTION i | WHEREAS, Section 7, Article Ill of the 1987 Confttution recognizes the fight of the people to information on matters of public concen and the right of each Filipino citizen to access official records in the ciistody of government agencies/offices subject to such timitations as may be provid by law; WHEREAS, Section 8 (A), (5), of Republic Act No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees) obligates Public officials and employees defined in Republic Act Noi 3019 (Anti-Graft and - Corrupt Practices Act) to file under oath their Statement f Asstt, Liabilities and Net Worth (SALN) with the Civil Service Commission (CSC); # WHEREAS, Section 8 (C) of RA No. 6743 specifically provides that any and all_ statements filed under this Act shall be made available for inspection at reasonable hours; such statements shall be made available for copying or reproduction after ten (10) working days from the time theyjare filed as required by law, and, the requesting party pays for the cost of reafoduction, mailing and certification; ' | WHEREAS, Section 8 (D) of RA No. 6713 prohibits fhe use of SALN for any purpose contrary to morals or public policy or any commercifl purpose other than by ‘news and communications media for dissemination to the gederal public; WHEREAS, the Supreme Court held in the cases offSubido vs. Ozaeta, 80 Phil 383, and Teodoro Berdin, ef al. vs. Mayor Eufraciol A. Mascarifias, et al., Municipality of Tubogon, Bohol, G.R. No. 135928 (July 6f 2007) that government offices having custody of public documents, like SALNs, may prescribe reasonable rales and regulations relative to the manner with which the public may examinelsrutnize/reproducsicopy the subject documents; "y WHEREFORE, the Commission resolves as it heretly resolves to adopt the following guidetines that wil govern requests for access to SNS filed withthe CSC 1. The requesting party, shall be required to accomplish the Request for SALN Form (copy attaches) and submit two (2) valid Identiication Cards (10 Cards) which can be any ofthe folowing: a.
