AN ACT INSTITUTIONALIZING THE CREATION OF DAY CARE
CENTERS FOR SENIOR CITIZENS
Section 1. Short Title. – This Act shall be known as the “Senior
Citizens Day Care Centers Act of 2018
Section 2. – Definition of Terms. – For the purpose of this Act, the
following terms shall apply:
a. Senior citizen refers to any citizen of the Philippines sixty (60)
years of age and over; b. Senior Citizens Day Care Centers are those establishments to be created under this law, public or private, designed to provide care and companionship for senior citizens who need assistance during the day; c. DSWD refers to the Department of Social Welfare and Development; d. OSCA refers to the Office of the Senior Citizens Affairs.
Section 3. – Coverage. – This Act shall be enforced in all cities and
municipalities in the Philippine Archipelago.
Section 4. – Availments. – The senior citizens who are in need of
personal care and/or limited nursing care due to weak health and or functional disabilities are entitled to the nursing and rehabilitation care services during the day whenever they lack family members or whose family members are unable to look after them.
Section 5. – Implementing Rules and Regulations. – The Office of
the Senior Citizens Affairs in cooperation with the Department of Health shall issue a corresponding rules and regulations necessary for the implementation of this Act.
Section 6. – Electricity Bill Discount. – Private institutions, which are
providing similar services, shall enjoy a fifty percent (50%) refund for their consumption of electricity, water and telephone services; provided, they are properly documented and approved by OSCA nearest them. Such refund shall come from the funds of the OSCA. Section 5. – Separability Clause. – If any provision of this Act is declared invalid or unconstitutional, the provisions not affected thereby shall remain in force and effect.
Section 6. – Repealing Clause. – All laws, presidential decrees,
executive orders, presidential proclamations, rules and regulations or parts thereof contrary to or inconsistent with this Act are hereby repealed or modified accordingly.
Section 7. – Effectivity. – This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in at least two (2) newspapers of general circulation.
