As of the pay period ending December 28, 2018, you only had 64.42 hours of accrued vacation leave, which is not enough to account for the entire period of your absence. You are on unauthorized leave in violation of Section 1 of MSD's Rules of Conduct and Penalties for Violation Covering Unit Employees. MSD's Rules of Conduct and Penalties for Violation Covering Unit Employees, Rule |, paragraph 11, prohibits “Absence without authorized leave or notification for two (2) consecutive workdays.” As a condition of employment, ‘employees are required to be ready, willing, and able to work unless they are on approved leave including but not limited to FMLA, Medical Leave, Personal Leave, vacation, holiday, or approved personal time. MSD does not approve leave for an employee's incarceration. A violation of Rule | of the Rules of Conduct and Penalties for Violation Covering Unit Employees is grounds for suspension for up to 30 days or termination for a single or first offense, {tis our understanding that you are unable to report for work due to the inability to post bond and that, as a condition of any bond you might post, you would not be able to drive a vehicle. It's also our understanding that, pursuant 10 KRS 189A.200, a pretrial suspension order was to have been entered at your arraignment suspending your ‘Commercial Driver's License, which would preclude you from driving even if you were released. For the above reasons, your employment with MSD is terminated effective immediately. Your last paycheck will be mailed to your home address. You must contact, or have someone contact Lopez High, Facilities, Safety & Security Director, on your behalf at 502-540-6611, by Friday, January 18, 2019 to arrange to return all MSD issued property.
