Signing with Power of Attorney

When signing with Power of Attorney, please note the following:

 The person who is party to the escrow (generally a seller or buyer) is


called the Principal. The person signing by using the Power of
Attorney for the Principal is called an Attorney in Fact.

 The name of the Principal and Attorney in Fact should be signed


exactly as stated in the document you are signing.

Signature Example:

Jack Doe, by Jane Doe, attorney in fact


[Principal], by [Attorney in Fact], attorney in fact

 If you are designating an Attorney in Fact to sign loan documents, the


lender will need to grant their approval before doing so. Please
contact them with questions before signing.

 Living Trusts and Powers of Attorney often do not work well together.
If you are selling or purchasing a home in a Trust, but would like to
designate an Attorney in Fact, please contact your Escrow Officer.
