LOLS 58pm Sooner, Recorder Receation PROTECTIVE COVENANTS APPLYING TO SHATTUCK'S SUBDIVISION OF BLOCK SEVEN, FIRST ADDITION TO ARLINGTON PARK The undersigned being the ovners in fee simple of all lots in Shattuck's Subdivision of Block Seven (7), First Addition to Arlington Park in accordance with thé plat thereof filed October 29, 1927 in the Office of the Clerk and Recorder of the County of Weld, Colorado, do hereby establish these restrictive covenants for the benefit and protection of said Subdivision and of the undersigned and of each and every person hereafter acquiring oimer- ship of land therein: 1, All lots in the tract shall be Imown and described as residential lots. No structure shall be erected, altered, placed, or permitted to remain on any building lot other than one detached single family dwelling not to ex- ceed two and one-half stories in height and a private garage for not more than ‘two cars. No barns, chicken houses or any buildings for care of chickens or livestock shall be placed or permitted to remain on any lot. 2, Mo building shall be located on any residential building lot nearer than 25 feet to the front lot line nor nearer than 5 feet to any side street line, No building, except a detached garage located 65 feet or more from the front lot line, shall be located nearer than 5 feet to any side lot line. 3. No noxious or offensive trade or activity shall be carried on upon any lots nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. - 4. No trailers, basements, tents, shacks, garage or barn shall at any time be used as a residence temporarily or permanently, nor shall any structure of a temporary character be used as a residence.’ 5. The ground floor area of the main structure, exclusive one story open porches and garages, shall be not less than 700 square feet in a case of a one story structure nor less than 650 square feet in a case of a one and one- half, two or two and one-half story structure. 6. No persons of any race other than the Caucasian Race shall use or oceupy any buildings or any lots, except that this covenant shall not prevent occupancy by domestic servants of e different race domiciled with an omer or ‘tenant. These covenants are to run with the land and shall be binding on all parties and all persons claiming under them to January 1, 1967 at which time said covenants shell be automatically extended for successive periods of ten years unless by vote of a majority of the then owners of the lots it is agreed to change such covenants in whole or in part. If the parties hereto, or any of them, or their heirs or assigns, shall violate or attempt to violate any of the covenants herein it shall be lawful for any other person or persons owing any real property situate in this development to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenants and either to prevent him or them from so dcing or to recover damages for such violation. soo 1210 ense24 4 Invalidation of any one of these covenants by judgnent or Court order shall in no wise affect any of the other provisions which shall remein in full force and effect.
