Gender equity in all measurements is an essential human right and the Constitution of India

(sexual harassment) is considered as an infringement of a women’s right to equality, which
right is ensured by Articles 14 and 15 of the Constitution of India and her entitlement to life
and to live with respect and dignity according to Article 21 of the Constitution. It has
additionally been considered as an infringement of a privilege to rehearse or to complete any
occupation, exchange or business under Article 19(1) (g) of the Constitution, which
incorporates a privilege to a sheltered domain free from badgering.

Sexual harassment at the work environment has dependably been one of the focal issues of
the women’s movement in India since quite a while. In the prior occasions, women
encountering Sexual harassment at work environment needed to document a dissension under
Section 354 of the Indian Penal Code that managed the charges of criminal assault of women
for offending her modesty, and Section 509 which rebuffed for using a word, signal or act

After a long clash of nearly 16 years after the decision of Supreme Court in Vishaka vs. State
of Rajasthan in 1997, India finally enacted the Sexual Harassment for Women at Workplace
(Prevention, Prohibition And Redressal) Act, 2013 for prevention of sexual harassment
against women at the workplaces.
