Part I, Section 3, Sub-section (i), dated the 4 January 2018 vide Notification ofthe Governmect of India in the Ministry of Commerce and Industry (Department of Industrial Policy & Promotion), cumber, GSR 09(8), dated 4" January. 2018(or ue 30) ar = TR = STEVE 3 inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of thi date on which the notification was made avaiable tothe public; AND WHEREAS, the ssid notification was made available to the public on the 4 January, 2018 AND WHEREAS, objections and suggestions received from the public on the said draft have heen duly considered by the Central Government; NOW WHEREAS, in exercise ofthe powers conforeed by sections 5 and 7 of the Explosives Act, 1886 (4 of 1884), the Central Government hereby makes the following rules further (amend the Gas Cylinders Rules, 2016. namely ty days from the 1. Short title and commencement— (1) These rules may be called the Ges Cylinders (Second amendment) Rules, 2018, (2) They shall come inc force on the date of their publication inthe Official Gazette 2 In the Gas Cylinders Rules, 2016 (hereinafter refered to as the sad ules), in rule 48, for sub-rule (3), the following shall be substituted, namely:~ "“@) The requitement ofthe "No Objection Certificate” under sub-rule (1) shall not be applicable for a Tiesnse in form "F", (a) for storage of flammable or toxic of corrosive gases forming part of eylinder Hiling plant; and () for storage of Liquefied Pecrolcum Gas in cylinders, provided "No Objection Centiieat” shall be obtained from the lesl body such as Gram Panchayat or the urban local body concerned.” 3, Inthe said rules, in the rule 57, after clause (4), the following clase shall be inserted, namely = “(S) Every licence or approval granted under these rules shall stand cancelled, ft licensee eeases to have any right tothe ste ofthe licensed or approved premises.” 4, In the said rules, inform “C’, under the heading DOCUMENTS REQUIRED TO BE SUBMITTED WITH ‘THIS APPLICATION FOR A LICENCE IN FORM ‘E', ‘F* and ‘G = () in item Gv), the words “Tease agreement” shall be omitted: (©) for tem (vi), the following item shall be substituted, namely = “(vi) No Objection Certificate from the Distict Authority under rule 48 in the ease of application fora license in Form “" to dispense Compressed Natural gas or Compressed Bio Gas as automotive fuel ora Licence in Form {stare flammable Toxic or corrosive gases forthe purpose of sale or trading Provided that the requirement of No Objection Cerificate from the Distict Authority shall net be applicable for & licence in form “F” for storage of flammable or toxie of corrosive gases forming part of cylinder filling plant o Hicence in form “F” for storage of Liquefied Petroleum Gas in cylinders Provided further that fora licence in form “F* for storage of Liquefied Petrloum Gas in eylinders, “No objection Certificate” shall be required from the local body such as Gram Punchayat or the Urban local Body concerned.” ‘5. In the ssid rules, in Form “Gin condition 1, in sub-condition (b), for tbe words and figure “in condition 6 of the licence", the words and figures, “Table Il of condition 7 of the licence in Forma G shall be substituted, IF.
