IN THE DISTRICT COURT OF OKLAHOMA COUNTY) STATE OF OKLAHOMA, ) ) vs. ) ) AFFIDAVIT OF PROBABLE CAUSE Walker, Michael, Elijah wim ) WGT: 160 EYES: BRO. ‘STATE OF OKLAHOMA ) ) ss. COUNTY OF OKLAHOMA ) |, Brenton Brown, being a duly sworn Detective for the City of Edmond, Oklahoma, Oklahoma County swear the following statements to be true: (n 03/04/2019 at approximately 0257 hours | was contacted by Dispatch as the on-call Detective in reference toa Homicide. Edmond Patrol Officers responded to 2601 N. Bryant Avenue in Edmond, Oklahoma County, OK at approximately 0232 hours after 17 year-old, IEEE called saying there was gunfire in his residence. [I went on to say that his brother, The Defendant, had shot their parents. When patrol Officer's arrived on scene Dispatch directed the calling party, INININNNII to exit the house and he came running out the front door to Officers. A short time later, Officers asked The Defendant to come out of the house unarmed over a loud-speaker. The Defendant complied and came out of the house and was taken into custody at that time. The Defendant was later transported to the Edmond Police Department. Upon my arrival on scene, | entered the residence through the garage side door, which was secured by Edmond Patrol Officers maintaining the Crime Scene Log. At the front entry way, | observed a female, later identified as Rachael ‘Walker, The Defendant's mother, lying face down in a pool of blood surrounded by several spent shell casings, later confirmed to be 9mm shell casings. The female was clearly deceased and had apparent gunshot wounds in her upper torso. There was also a pillow sitting beside the female which had at least 2 holes with burn marks through the pillow, consistent with gunfire. | observed apparent gunshot entry holes in the drywall on the north side of the entry way and in the front door near Rachael Walker's body. There was also a partial bullet projectile resting on the entry way rug near Mrs. Walker's feet. | walked down the hallway to the south of the entryway and inside the first bedroom on the west, | observed a male, later identified as Michael Walker, The Defendant's father, lying on his back in a pool of blood. This bedroom was confirmed to be the bedroom belonging to The Defendant. The decedent, Mr. Walker had apparent gunshot wounds in his head, face, and torso. Mr. Walker was clearly deceased and there were Sim shell casings around his body and on the bed. There was blood on the bed, pooled near the head of the mattress on the east wall. There was a Glock Model 17, 9mm handgun, resting on the southwest corner of the mattress with dried blood on the grip. There were apparent gunshot entry holes in the side of the bedroom door frame toward the southwest, into the bedroom closet to the south, in the ceiling, and downward into the mattress. There were a total of 19 spent 9mm shell casings recovered inside the residence between the entry way, hallway and The Defendant's bedroom. The Glock Model 17 pistol recovered at the scene has a magazine capacity of 17, leading me to believe that The Defendant reloaded his gun during the homicide. There were a total of 3 Glock 17 magazines, recovered inside The Defendant's bedroom. Ath ato and wines tne wth he poring I Md hate woke up to the sound of his mother screaming and gunfire. When he opened his bedroom door, he saw his mother in the hallway and she yelled for him to call 911. [called 911 and then he looked out into the hallway again and saw bis brother, The Defendant, walking down te alway holding his gun. He sid that The Defendant's haeds were covered in blood. [IINSid that he is familar with his brother's gun, and identified i 25a Glock 17, He advised ‘that his brother often carries the gun around the house with him because he is paranoid. When he walked down the hall, he saw his father lying face down on The Defendant's bed, and then he saw his mother lying in the entry way near the front door, coughing and gurgling n a pool of her own blood. He said his brother told him tohang up the pone so he did. INI The Defendant ol him tat he shot the parents because they were sending him messages telepathically and they were Satan worshipers. The Defendant also told) that everything was okay, and he would bury the bodies. (On 03/04/2029 at approximately 1000 hours | interviewed The Defendant along with Detective Sgt. Stearns at the Edmond Police Department. | read The Defendant the Miranda Warning and when asked if he understood his rights he said, “Yes.” When | asked if he wished to talk to us now, he replied, “I'd be fine doing so.”. While under Miranda, The Defendant said that he got into an argument with his mother and father after he asked them a question about satanism. He said that the argument took place in his room and his gun was sitting in the open on his bed beside him. He stated that his father “tackled” him on the bed, so he grabbed his gun and shot his father. When asked where he shot him, he said, “Anywhere | could hit him.” He said that his mother ran out ofthe bedroom, and he shot at her as she was running away. The Defendant said he followed his mother out into the hallway and into the entryway and he believed she was ‘trying to escape outside the house. He said that he shot his mother several times in the entry way through her back. The Defendant admitted that after shooting his mother, he walked back to his bedroom and reloaded his pistol before ‘returning to shoot her again because he believed she was stil alive. The Defendant also admitted that he took his pillow Into the entry way and held it over the back of his mother's head and shot once or twice through the pillow because the Bun was very loud, indicating that the noise from the gunfire was hurting his ears, The Defendant also told me that he dragged his father off his bed and onto the floor because it was “kind of gross” to have his dad bleeding on his bed, ‘The Defendant said that neither his father, nor his mother harmed him at all. He only referenced his father grabbing, ‘onto his legs and saying “give me the gun!”, before he shot his parents. The Defendant stated that he believed he did {the right thing. | asked The Defendant if he would react the same way if he had it to do over again, and he said that he would, The evidence at the crime scene indicated that The Defendant's father was shot several times. One round was fired through the victim and traveled straight downward into the mattress from approximately a 90 degree angle and the Projectile was recovered by Technical Investigators 8 inches deep into the mattress, Based on the evidence at the scene ‘as well as The Defendant's own statement, his mother was actively trying to escape when she was murdered, and the Defendant returned to his bedroom to obtain additional ammunition along with a pillow in an attempt to muffle the sound of gunfire before he returned to shoot her again and ensure that she was dead. These factors indicate forethought and deliberate intention to unlawfully kill the victims. This crime occurred in Oklahoma County. Based upon the above facts and circumstances, | believe that sufficient Probable cause exists for the filing of criminal charges: 2 Counts of Murder in the First Degree, 21-701.7.A.
