 The Sexual Harassment of Women at Workplace ( Prevention , Prohibition and Redressal) act
2013
 This act came into force on 9th Dec ’2013
 Act aims at preventing harassment of women, by men at the work-place
 Act mandates that employer shall introduce , monitor , implement mechanisms to prevent
Sexual harassment at work-place
 Sec 4 of the Act requires the” Internal Committee” to comprise of Presiding officer, who shall be
a senior women employee of the Company
 Any complaint received should be first segregated / identified between :
o Sexual Harassment
o Work place Harassment
o Gender Bias
 Only Sexual Harassment will be governed by POSH:2013
 Internal committee should be framed in the organizations where employees more than 10. The
committee should consist of minimum 4 members – one member should be an outsider
associated with women welfare. The committee should contain 50 % of women
 In the outcome of the investigation , if proved male employee is at fault the extent of the
punishment will be based on the severity of the case
 The punishment may be termination, warning letter, transfer, change in reporting structure /
shift
 The investigation should be closed by 90 days on receiving the complaint & the outcome /
recommendation should be implemented within 60 days by HR department
