People vs. Campuhan (G.R. No. 129433)

Facts: The plaintiff is the People of the Philippines. The accused is Primo Campuhan. In the
case at bar, Primo Campuhan, is a helper of Conrado Plata Jr., brother of Corazon, who was then
busy filling small plastic bags with water to be frozen into ice in the freezer located at the second
floor. Ma. Corazon Pamintuan, the mother of the victim Chrystel went downstairs and later on
rushed upstairs aupon hearing her child. She said that she found the accused kneeling down on
his 4-year old daughter with his pants down and forcing his penis into Chrystel’s vagina.
Campuhan then ran away but was apprehended by the police.

Issue: Is the appellant guilty of said crime.

Held: The Supreme Court said that the appellant cannot use the defense that the victim was a
prostitute. It is for the reason that even if the victim was a prostitute, any sexual intercourse
committed with a person below 12 years of age is rape. In the case, it was proven by sufficient
evidence that at the time of the sexual intercourse, the victim was below 12 years of age.
