CHAPTER I
PRELIMIN AR Y

The Madhya Prade sh Land R evenue Code, 1959.

under th e Indi an For est A ct, 192 7 (X VI of 1927)
Pro vided th at the aforesaid pro vi sion s of th e Code sh all apply with ref eren ce
to the u se of l and in such ar eas for one or more of th e purpo ses sp ecifi ed in S ection
59.]

2. Def initions. — (1) In this Cod e, unl ess there i s an ythin g repu gnant to the
subj ect or cont ext, —
(a) "abadi" mean s the ar ea r eser ved from ti m e to time in a village in a non -
urban ar ea for the re sidence of the inhabitants ther eof or for p urposes

or who may reasonabl y b e expect ed to culti vat e p erso nally;
(f) "co-op erati ve so ciet y" mean s a so ci et y r egi st er ed as such under any l aw
rel ating to Co -op er ative Soci eties in for ce for the ti me bein g in an y
region of the St at e;
(g) "Go vern ment fo rest" mean s a fore st co nstituted as a reser ve fore st or
protect ed forest in accordan ce with th e pro vi sion s of th e Indian For est
A ct, 192 7 (XV I of 19 27);
(h) "Govern ment l essee" m eans a per son holding l and from the St at e
Go vernment und er Section 181;
(i) a p ar cel of land sep arat el y assessed to l and revenu e and h eld
under on e t enur e; and

(ii) in ref er en ce to l and h eld b y a t en ant a p ar cel of land held from
a b humi sw ami und er o ne l ease or set of co nditions;
(j) " impro vem ent" m eans with ref er enc e to a holdin g, -an y w ork whi ch add s
materi all y to th e val ue of th e holding which i s suitabl e th er eto and
con si st ent with th e purpo se for whi ch it is held and whi ch, if not
execut ed on th e holding, i s eith er execut ed dir ectly for its b en ef it or i s
aft er execution, m ade directl y b en efi ci al to it; and, subj ect to the
foregoing provi sion s, includ es —
(i) The con stru ction of tank s, w ells, w at er ch ann el s, emb an km ents and
other works for stora ge, sup ply or di stribu tion of w at er for agricultural
purpo ses;
(ii) The con stru ction of works for th e drain age of land or f or the
protection of land from flood s, or from er osion or other d amage from
w ater;
(iii) The pla ntin g of trees and th e recl aimin g, cl earin g, en cl osin g,
levellin g or t erracin g of land;
(v) the r ene wal or re con stru ction of an y of the foregoin g works, or
alt er ations therein or additions th er eto;
(a) temporary well s and such water ch ann el s, embank ment s, l evell ing,
en clo sures or oth er works or p ett y alt er ati ons in or repairs to such
work s, as are commonly mad e by culti vat ors of the lo cality in the
ordinar y cour se of agriculture; or
(b) an y work whi ch sub st anti ally dimini shes the val u e of an y land,
wher ever situat ed, in the o ccupation of an y other p er son, w h ether ,as
bhumiswami or o ccup anc y ten ant;

Explanation. —A wor k whi ch benefit s several holdin gs may b e d eemed to be
an i mprovement with respect to e ach of such holdings;
(k) "land" mean s a po rtion of the earth 's surface wh ether or not un der w at er;
and, wh er e land i s ref erred to in thi s Cod e, it shall b e d eemed to i nclude
all thin gs attach ed to or per man ently fast en ed to an y thing att ached to
su ch land;
(l) "landless p erson" mean s a per so n who is bo nafid e agri culturist and who
wh eth er indi viduall y o r jointly with oth er memb er s of hi s famil y ho ld no
lands or l and l ess th an the area whi ch may b e prescrib ed in this b ehalf;
(m) "land reco rd s" means record s maint ain ed under th e pro vi sions o f this
Cod e;
(n) "legal p ra ctitione r" mean s any per so n entitled to pr actice in an y of the
Courts in Madh ya Prad esh und er the Le gal Practitioner s Act , 1879
(XV III of 18 79)1, or under an y oth er l aw for the tim e b eing in force;
(oa) " ma rket Value" mean s the valu e of land assessed according to
guidelin es issu ed b y the Coll ector und er the Madh ya Pr ad esh Bajar
Mul ya Mar gd arshak Siddhanton k a Banaya Jan a Tath a. U nka Pun riksh an
Niyam, 2000 mad e un der th e Indi an St amp Act, 189 9 (No . 2 of 18 99);]

pre scribed record s un der an indi cative num ber and includ es an y portion
of land ent er ed in t he previous record s und er an indi cative numb er
known as kh asr a or su rvey number;
(r) "recogni sed agent" in ref er ence to a p art y to a pro ceeding und er the
Code mean s—
(i) a p erson authori sed und er a p ower of at torney b y such p art y t o m ake
app earance and appli cation s and to do oth er acts on his b eh alf in such
proceedin gs; and
(s) "region" means the Mah ako sh al region, t he Madh ya Bharat r egion, the
Bhop al r egio n, th e Vindh ya Pr ad esh regi on and th e Sironj regio n, or an y
of these, as the c ase may b e;
(t) "rent s" mean s w h atever i s paid or i s p aya ble in mon ey or in kind —
(u) " Revenue Offi cer" in any pro vi sion of this Cod e mean s such Reven u e
Officer as th e St at e G overn ment may, by n o tification , direct to di sch ar ge
the fun ction s of a Revenu e Offi cer under th at provi sion;

(x) "survey number" mean s a portion of land in non-urb an area formed into,
or reco gnised as a survey numb er at th e l ast preceding r evenue survey, or
sub sequ entl y r eco gni sed as su ch b y th e Collector, in r esp ect of wh ich the
ar ea and land r evenue p ayabl e are separ at el y ent er ed und er an in dicati ve
numb er in th e l an d r ecord s; and in clud es, any portion of l and entered in
the l and record s un der an indi cative nu mb er known as th e kha sr a numb er;
(y) "tenant" means a p erson holdin g land from a bhu misw ami as, an
occu pan cy t en ant und er Chapt er X IV;
(z) "tenu re-hold er" m eans a p er son who holds l and from th e St at e
Govern ment and who is or is d eemed to b e b humi swami und er the
provi sion s of this Code;
(z-1) " timb er t rees" m eans tr ees of the follo win g sp eci es, namel y : --
(v) tinsa;
(z-2) “to cultivate person ally” mean s to cult ivat e on one's o wn ac count —

(ii) by the l abour of an y memb er of on e's f amil y; or
(iii) by ser vant s o n w ages p ayabl e in cash or kind but not in crop
sh ar e; or
(z-3) "uno ccu pied lan d" m eans the l and in a vill age oth er than th e abadi or
servi ce l an d, or th e lan d h eld b y a bh umi sw ami, a t en ant or a
Govern ment l essee;
(z-4) "u rban area" mean s the area for the time b eing in clud ed within the
limits of an y municip al corpor ation or an y mu nicip alit y or notified
ar ea con stituted und er any l aw for th e ti me bein g in for ce relatin g to
muni cipalitie s or an y vill age or gr oup of villages whi ch ma y be
sp ecifi ed b y th e Stat e Go vern ment as urb an ar ea; and the expression
"non -urban ar ea" sh all be constru ed accordin gl y;
(z-5) " village" means an y tract of l and whi ch, b efor e th e comin g into force
of this Cod e, w as r ecognised as or was d ecl ared as -a village u nder
the provi sion s of an y law for the time b ei ng in for ce and an y o ther
tract of l and whi ch i s hereaft er recogni sed as a vill age at an y reve nue
sur vey or w hich th e State Go vernment may, by notifi cation, d ecl are to
be a village.
(2) Any r efer en ce mad e in thi s Cod e to th e d at e of co min g into for ce of thi s
Code shall b e con stru ed as a r ef eren ce to the d at e appoint ed b y notification und er
sub -section (3) of S ect ion 1.

CHAPTER II
(2) Th e Board of Revenu e as con stitut ed and fun ctioning for t he several
region s of thi s St at e immedi at el y b efor e the comin g into force of thi s Cod e,
her einaft er in this ch apter r eferred to as th e exi sting Board, sh all with effect from
the dat e of comin g int o force of thi s Code, be d eemed to b e the Board of Revenue
for Madhya Pradesh constitut ed u nder thi s section.
(3) The President and memb er s of the existin g Bo ard sh all b e the fir st
President and memb ers r especti vel y of th e Board of Revenue for Madh ya Pr ad esh .
(2) Not withst an din g anythin g contain ed in sub-section (1), th e Pr esid ent and
member s of th e Bo ard may al so sit at su ch other pl ace or pl aces as th e Pre sid ent a
the Bo ard may with the approval of th e St ate Go vern ment, appoint.
(2) Except as expressly provid ed b y thi s Co de, th e t erms and con ditions of
servi ce of th e President and m emb ers of the Bo ard sh all b e such as may be
pre scribed and the t er ms and condition s l aid down b y th e Stat e Govern ment for the
President and m emb ers of th e existing Bo ard shall continu e in for ce until modified
or su perseded u nder th is section.

(2) The St at e G o vern ment may, subj ect to such co ndition s as it ma y d eeinfit
to impo se, b y notification, conf er upon, or entru st to th e Bo ard o r an y m emb er of
the Bo ard addition al power s or fun ctions assi gned to th e Stat e Govern ment b y or
under an y en act ment f or the time b ein g in fo rce.
8. Pow ers of Superintend ence of Boa rd.—The Bo ard sh all, in re sp ect of all
matter s subject to it s app ell at e or r evi sion al jurisdi ction, h ave superint en - dence
over all authoriti es in so f ar as such autho rities d eal with su ch matter s and m ay
call for r eturns.
9. Ex erci se of juri sdi ction by sin gle me mbers and b ench es.— Th e Bo ard
may mak e rules for the exer cise of pow ers and fun ctions of th e Board by ben ch es
con stitut ed of on e or more memb er s th er eof, and all d eci sion s given by su ch
ben ches in exerci se of such po wers or function s sh all b e d eemed to be the
deci sion s of the Bo ard .
(i) Fir st app eal again st th e ord er of th e Collector wh eth er exerci sin g the
power s of Coll ector or Settl ement Officer during the curr en cy of
settlem ent, pendin g before the Bo ard;

(2) Th e State Govern ment may alter th e limits of an y di strict or tah sil and
may cr eat e n ew, or abolish exi stin g di strict s or t ah sils, and may di vide an y distri ct
into su b-di visio ns and may alt er the limits o f or abolish, an y sub - divi sion
Pro vided th at the St ate Go ver nm ent b efor e passing an y orders und er thi s
section on an y pro posal to alt er th e limits o f an y di vi sion or di strict or tah sil or to
cr eat e n ew or aboli sh exi stin g di visions, di stri cts or tah sils, sh al l publish in the
pre scribed for m su ch propo sals for in vi ting obj ection s and shall take into
con sid eration an y obj ection s to su ch prop o sal.
(3) Subject to the order s of the Stat e Go vern ment under sub -section (2),
ever y tah sil sh all b e d eemed to be a sub -di vi sion of a di strict .
(2) Th e St at e Govern ment m ay, subj ect to su ch condition as it may d eem fit
to impose, b y notification, conf er upo n the Co mmi ssioner an y of the pow er s o r
function s assi gned to t he St ate Go ver nm ent by or under an y enactm ent for th e time
bein g in force.
(2) An Additional Commi ssion er sh all exer ci se su ch pow ers an d disch arge
su ch duti es conf erred and i mpo sed on a Co mmi ssioner b y or und er this Cod e or b y
under an y other en actment for the tim e b ei ng in force in such ca ses or cl ass of
cases as th e Stat e Go vern ment may, b y a gen eral ord er, n otify or as the
Commi ssioner of the divi sion may, subj ect to any gen er al or spe ci al re striction s
impo sed b y the St at e Govern ment, b y an or der in writing dire ct.
(3) This Cod e and every oth er enactm ent for the ti me b ein g in force an d an y
rule mad e und er thi s Code or an y su ch other en actment shal l, except wh ere
expressl y dir ect ed otherwi se, a ppl y to the A ddition al Commissio n er wh en

conferr ed and imposed on a Coll ector b y or under thi s Cod e or by or und er an y
other en act ment for th e time bein g in for ce, in such cases or class of cases a s the
State Go vern ment may, b y a ge neral ord er, n otify or as the Collect or of th e di strict
may, subject to an y gen er al or sp eci al re striction s impo sed b y th e St at e
Govern ment, b y an or der in writin g direct.
(3) This Cod e and every oth er enactm ent for the ti me b ein g in force and an y
rule mad e und er thi s Code or an y su ch other en actment shal l, except wh ere
expressl y direct ed oth erwi se, appl y to the Additional Coll ector, wh en exer ci sin g

22. Sub-Divi sion al Off icers.-(1) The Co llector may pl ace o n e or more
A ssist ant Colle ctor s o r 3[Joint Coll ector or D eput y Coll ector] in -ch ar ge of a sub -
division of a di strict o r in-ch arge of two or more sub -di vi sion s of a distri ct.
(2) Such Assi st ant Collector or 1[Joint Coll ector or D eput y Collector] shall
be call ed a Sub -Di vi si onal Offi cer and sh all exerci se su ch po wers of a Coll ector as
the Stat e Go vern ment may, by notifi cation, direct.
23. Sub o rdination of Revenue Off icers.—Unl ess th e Coll ector otherwise
directs, ever y Revenue Offi cer in a sub -di vision sh all b e sub ordinat e to the Sub -
Division al Officer an d a N aib-T ahsildar in a t ah sil sh all be subordinate to th e
Tah sildar.

ari sin g for det ermin ation bet w een the Stat e Go vernm ent and an y per son or b etwe en
parties to an y pro ceed ings, sh all b e a Reven ue Court.
32. Inh erent pow er of Rev enue Co urt s.- Nothing in this Co d e sh all be
deemed to limit or other wise affect the inher ent pow er of th e Revenue Court to
mak e such orders as may b e n ecessary for the end s of ju sti ce or to pr event the
abu se of the pro cess of the Court.
33. Pow ers of Rev enue Officers to requi re atten dance of person s and
pr oduction of do cu ments a nd to receiv e evidence.- (1) Subj ect to the provi sion s
of S ection s 1 32 an d 1 33 of th e Co d e of Ci vil Procedur e, 1908 (V of 1908) and to
rules mad e under Sec tion 41, every Revenue Offi cer actin g as a Revenue Court
sh all h ave po w er to t ak e eviden ce, to su mmon an y p er son wh o se att end ance he
con sid ers necessar y either to b e exa mined as a p arty or to gi ve evidence as a
witness or to produ ce an y do cu ment for the purpo ses of an y inquiry or case ari sin g
under this Co d e or an y other en actm ent for the ti me b eing in force.
(2) No person shall b e ordered to att end in per son, unl ess h e r esid es —
(a) within the li mits of th e tah sil if th e Revenu e Offi cer actin g as
a Revenu e Offi cer i s a N aib-Tah sild ar an d in the case of an y
other Reven u e Officer, within th e lo cal li mits of his
jurisdiction; or

(4) Every su ch Revenue Offi cer sh all have pow er to issu e a commission to

infirmity.

35. Hea ring in absence of party .— (1) If on th e dat e fixed for hearin g a
case or pro ceedin g, a Revenu e Offi cer finds th at a su mmon s o r noti ce w as not
served on an y part y d ue to the failur e of t he opp o site part y to pay th e requi site
process fees for su ch ser vi ce, th e case or proceeding may b e di smissed in d ef ault
of payment of su ch process f ees.
(2) If any part y to a case or proc eedin g b efore a Revenu e Offi cer does n ot
app ear on th e d at e fi xed for he arin g aft er d ue servi ce of a notice or su mmon s on
him the case may be heard and d et ermined in hi s ab sen ce or m ay b e dismi ssed in
def ault, as th e case may be.
(3) Th e part y against who m any ord er i s p assed under sub -section (1) or (2)
may ap pl y along with his affid avit] within thirty d ays from the d ate of su ch ord er
or knowl edge of th e order in case th e notice or su mmon s was n ot dul y ser ved to
have it set asid e on the gr ound that h e was prevent ed b y any suffi ci ent cau se from
paying th e r equi site proce ss fees for service of a su mmo n s o r notice on the

time, for r easo n s to be r ecorded an d on su ch terms as to cost s, ad journ the h earin g
of a case or pro ceedin g before him :

for su ch time as may be requi site for filin g a n appeal or r evision and o btainin g a
st ay order from the appell at e or r evisional authority.
(2) The app ell ate or revi sion al authorit y may, at an y ti m e direct the
execution of the ord er appeal ed from or again st which a revi sion is mad e to be
st ayed for such tim e as it m ay think fit:

as h e d eems fit, c ause the bound ar y to be d emar cated or the boundar y mark s to be
rep aired or ren ew ed and m ay reco ver the cost incurr ed as an arrea r of lan d revenu e.
128. Enforce ment of rep air of bounda ry o r su rv ey ma rks.— (1) Aft er the
end of N ovem ber in each year the p at el of the village sh all give written noti ce to

land of a village inclu ding tho se road s and path s r ecorded in th e vill age Wajib-ul -
ar z or who di sobeys the d eci sion of a Tah si ldar p assed und er S ect ion 131 , sh all be
liabl e, und er th e writt en ord er of a Tah sild ar st ating th e f act s and circu mstanc es of
the case, to a penalt y whi ch m ay ext end to 3 [ten thousand rup ees]
135. Acqui sition of land f or road , p ath s, etc.— (1) If, o n th e application
of the vill agers or other wise, th e Collecto r is, after enquir y satisfied that it i s
exp edient to acquire any land for the purpose of providin g a ro ad not exceedin g t en
feet in width cart tr ack or path for th e use o f the vill age commu nity in su ch villa ge
he may call upon the r esident s of the village to depo sit the am ount of
co mp en sation, p ayabl e in r esp ect of su ch land und er sub-secti on (3) within a
sp ecifi ed p eriod. On su ch depo sit b eing mad e th e Coll ector may, b y ord er
published in th e pr escribed mann er, acquir e su ch land and upon the making of su ch
order, such l and sh all vest ab solutel y in the Stat e Go vern ment.

137. Land reven ue first cha rg e on land .— The land reven u e assessed on

138. Responsibility for pay ment of land reven ue.— (1) Th e followin g
per son sh all be primar ily liable for the p ay ment of th e land r evenue assessed on a
holding —
(b) in a h oldin g con si stin g of land l eased by t he Stat e Go vernm ent the
lessee th ereof.
139. Land rev enu e recov erabl e fro m any person, in po ssession .—In case
of d efa ult by any pe rson who i s pri m arily liabl e und er S ection 138, the l and
revenu e, includin g arrear s, sh all be r ecover abl e from an y p erson in possession of
the l and
Pro vided th at su ch person sh all b e entitled t o credit for th e amount reco vered fro m
him in acco unt with th e p erson w ho i s pri marily li abl e.
140. Dates on w hich land reven ue f alls due a nd is pa yable. — (1) The
land revenu e payabl e on account of a r even ue year sh all f all due on th e first d ay of
that year.
(2) Th e St at e Go vern ment m ay mak e rul es pro viding for the p aym ent of
land revenue in inst alments and on d at es (herein aft er r ef erred to as pr escribed
dat es) sub sequ ent to t he first d ay of th e revenu e year, and such ru le s may pre scribe
the p erso ns to who m and the pl aces wher e at such in st alm ents sh all be p aid.

(4) Any p eriod el ap sin g b etween th e first day of the revenu e year and an y
dat e fi xed for th e p ayment of land reven ue by such rules sh all b e d eemed to b e a
period of gr ace, and shall not affect the pro vi sions of sub -section (1).

Th e St at e Govern ment ma y grant r emi ssion or su spen sion of l and revenu e in year s
in whi ch crop s h ave f ailed in an y area or in whi ch cro p s co uld n ot b e grown in an y
ar ea in co n sequ ence of any order m ade under an y l aw by a co mp et ent auth ority,
and su ch r emi ssion o r su sp ension shall b e det ermined in ac cor dan ce with rul es
mad e un der thi s Co d e.

146. Notice of de man d.— A Tah sildar or Naib-Tah sildar may cause a

pay the amount cl ai med an d may, at the sam e time, d eli ver a protest sign ed b y
himself or b y his authorised agent to th e Re ven u e Officer t akin g such pro ceedin gs,
and thereupon th ey sh all b e st ayed.
(2) Any p erson co mpl yi ng with the pro vi sio ns of sub -section (1 ) ma y,
notwithst an ding an ything contain ed in S ect ion 145, ap pl y to th e Sub -Di vi sional
Officer th at nothin g was du e or that th e amount du e was less than the amount for
the recover y of whi ch proceedings w er e t aken and the Sub -Di vi si onal Offi cer shall
decid e th e obj ection so rai sed .
(3) No app eal shall lie again st th e order of the Sub-Di vi sional Offi cer passed
under sub-section (2), but the person con cerned may in stitute a civil suit for the
reco ver y of th e sum or part th ereof p aid und er protest.
151. Application of pro ceed s of sal e.— (1) Th e pro ceeds of every sal e
under this Ch apt er sha ll be appli ed, firstly, in sati sf action of th e arrear s on accou nt
of which th e sal e w as h eld an d of the expen ses of su ch sal e, secon dl y, to the
payment of an y arre ars of cesses due b y th e d ef aulter und er an y law for th e ti me
bein g in force in the r egion con cerned, thirdly, to the p ayment of an y other arrear s
payable to th e St ate Go vern ment by the d efault er, and fourthl y t o the p aym ent of
an y arr ear s due b y the def aulter to a Co -operati ve So ci et y, and th e surplu s, if an y,
sh all th en b e pa yabl e to him, or wh ere th er e ar e more d ef aulters t han on e, to su ch
def ault er s a ccordin g to their r esp ecti ve sh are s in th e prop ert y sold :
Pro vided th at th e surp lus sh all not be paid t o th e d efault er or def aulters until

153. Purchaser' s title. — Wh ere immo vable propert y i s sold und er the
provi sion s of thi s Ch apter and such sale has become absolut e, th e propert y sh all be
deemed to h ave vest ed in the purchaser fro m the time when th e propert y is sold and
not from th e ti me w h en the sal e b eco mes ab solute.
154. Purchaser not liable for land rev enue due prio r to sal e.—
Notwithst andin g anyth ing in S ection 138, or S ection 139, th e person nam ed in the
certificate of purch ase sh all not b e liabl e for lan d revenu e p ayabl e in resp ect of th e
land for an y period pr evious to the dat e of the sale.

opportunity of b eing heard to th e p er so n s aff ect ed b y the transfer, pass an ord er
ratifyin g the tran sf er o r refu sin g to r atify the tran sf er.

only on the ground that th e di version i s lik el y to c ause a publi c nuisan ce, or the
bhumiswami is un able or unwilling to compl y with th e con ditions th at may b e
impo sed u nder sub -section (3).
(3) Condition s may b e imposed on di ver sion for the followin g obj ect s and
no other s, n amely, in order to secur e th e public h ealth, safet y and convenien ce, and
in the case of l and w hich is to b e u sed as buildin g sit es, in order to secur e in
addition that th e dim ensions, arran gement and accessibilit y of the sites are
ad eq uate for th e he alt h and con veni en ce of occupier s or ar e suit ab le to the locality.
(4) If an y land has b een divert ed without per mission b y th e bhu mi swami
or by a ny oth er person with or without th e con sent of the bhu miswami the Su b-
Division al Officer on recei vin g informatio n thereof, may i mpo se on th e p erson
responsible for th e di ver sion a pen alty not exceedin g 2[tw enty per centu m of the
mark et valu e of su ch diverted l and] and ma y pro ceed in accordanc e with the
provi sion s of sub-sect ion (1) as if an appli cation for p ermi ssion t o di vert h ad b een
mad e.

sur vey n umb er or plo t number is r elinqui shed u nder Section 173, the Tah sild ar
sh all off er the rights t o occup y su ch sub -division at su ch pr emiu m as h e think s fit
to the bhu mi sw ami of the oth er sub-di vi sions of th e same survey numb er .or plot
numb er an d if th ere be comp etition among su ch bhu mi swami h e shall sell su ch
right to th e hi ghest bidder amon gst th em.
175. Right of way to relin quish ed land.— If an y p er son r elinqui shes his
right to land, th e w ay whi ch li es thro u gh other l and r etain ed by him any, future
holder of th e l and r elinquish ed sh all be entitled to a right of wa y through th e l and
ret ained.
(4) Wh er e a h oldin g i s declared abando ned u nder sub-se ction (3), the
liability of th e bh umi sw ami for th e arrears of revenu e d ue from him in respect
thereof shall st and di schar ged .
177. Dispo sal of hol dings.— (1) If a bh umisw ami who se l and has b een
assessed for the purp ose of agri cultur e un der S ection 59 , or who hold s land for
dwelling purposes, dies, without kno wn heir s, th e 1[Tah sildar] sh all take
possessio n of hi s l and and may l ease it for a period of on e year at a time.

(2) If within thr ee year s of the d at e on whi ch the 2[Tah sildar] t akes
possessio n of the l and an y cl aima nt ap plies for the holdin g b ein g restored to him,
the 3[Tahsildar] may, after such enquiry as h e thin ks fit, place such cl aim ant in
possessio n of th e l an d or rej ect hi s claim.
(3) Th e ord er of the 4[Tahsild ar] p assed und er sub -section (2) shall not
be subje ct to appeal o r revi sion but an y p er son whose cl aim i s rej ected under su b-
section (2) ma y, within on e year from th e d at e of the co mmuni cat ion of th e ord er
of the 5[Tah sildar] fil e a civil suit to est ab lish hi s title, and if such suit is file d,
the 6[Tah sild ar] shall continu e to lease out t he l and as provi d ed in sub -section (1)
till the d eci sion of th e suit.
(4) If no cl ai mant app ears within three year s fr om the d at e on whi ch the
[Tah sild ar] took po ssession of th e l an d or if a cl aimant whose cl aim h ave be en
rej ect ed un der sub-section (2) doe s n ot file a suit within one year as pro vided in
sub -section (3), th e [ Tah sildarl may sell t he d eceased bhumi sw ami 's ri ght in the
holding b y a uction.
(5) Notwithst andin g anyth ing cont ain ed in an y l aw for the time b eing in
force a cl ai mant who est ablish es hi s title in la nd whi ch h as b een dealt with in
accordance with th e provisions of thi s section, sh all be entitled only to th e rent s
payable un der su b -section (1) and the sal e p roceed s r eali zed und er sub -section (4)
less all su ms due on t he holdin g o n acco unt of land revenu e and the exp en ses of
man agement and sale.
178. Pa rtition of holding.— (1) If in any holding, which has been assessed
for purpose of agri cul ture und er S ection 59, th ere ar e mor e than one bhu mi swami
an y such bhu mi sw ami may appl y to a Tah sildar for a p artition of his sh ar e in the
holding :

(2) Nothing in sub -section (1) sh all aff ect an y ri ght in tr ees in the holdin g
of a bhu mi sw ami in favo ur of an y p er son exi stin g o n th e d ate of the co min g into
force of thi s Cod e, bu t the bh umi swami may appl y to the Tahsildar to fix th e value
of su ch ri ght and pur cha se the ri ght throu gh the Tah sild ar in su ch mann er as m ay
be prescribed.
180. R estri ction on tran sf er of trees.— (1) Th e tran sfer b y a bhumi swami
of an y tr ees st an din g in any land comprised in hi s h oldin g except the produce of
su ch trees shall be voi d unl ess th e l and itself is tr an sf erred.
(2) Trees st andin g in any l and co mprised i n the holdin g of a b humi swami
sh all• not b e attached or sold in execution o f a d ecr ee or ord er of a Ci vil Court or
under an ord er of a Reven u e Offi cer or und er an order m ade in p ursu ance of an y

a gr ant within the meaning of the Go vern ment Grant s Act , 1895 (XV of 1895).

(i) that h e h as f ail ed to pay th e r ent for a p eriod of thr ee month s from the

(2) A tr ansaction b y whi ch a vill age ser vant att empt s to tran sf er his
interest in his ser vi ce land b y sal e, gift, mortga ge, sub -lea se or otherwise except
by a sub -l ease for a p eriod not exceeding on e year , sh all b e void.
(3) If the hold er of su ch land di es, resi gns or is l awfull y di smi ssed the
land sh all p ass to hi s successor in office.
184. Dispo sal of servi ce land in Sironj R egion w hen servic es no lo nger

thereof] may, if the area of l and und er hi s p er sonal cultivation i s belo w t w ent y-five
acr es of u nirrigat ed l and , within on e year of th e comin g into force of thi s Cod e,
mak e an appli cation to the Sub -Di vi sion al Officer for r esu mption to land h eld b y
his o ccup ancy t en ant f or his p er son al culti vation.
(2) On re ceipt of th e appli cation, the Sub -Di vi sion al Offic er shall, after

195. Occu pancy t ena nt's rig ht s of transf er.— (1) No o ccupan cy t en ant
sh all b e entitled to transfer b y wa y of sale, gift, mort gage, sub-lease or oth erwi se
his ri ght in the l and or any p ortion ther eo f, and every such sale, gift, mort gage,
sub -l ease or other tr an sf er sh all be void abl e as provi d ed in Section 197

(2) Nothin g in sub -sectio n (1) shall prevent an o ccup an cy t ena nt from
transferrin g hi s holdin g or any part thereof by sal e or gift to any co -
ten ant or an y p erson Who, if h e survi ved t he tenant without n earer
heirs, would in herit the h oldin g.

197. Right of certain person s to apply to set a sid e tran sf ers by occupan cy
tena nt s. —.(1) If an oc cup an cy t enant tran sf ers hi s rights in his holdin g or an y
portion ther eof in con tra vention of S ection 195, an y co -t en ant or an y p er son wh o,
if he survi ved the t enant without near er h eirs, would inh erit the holding or the
bhumiswami of who m su ch per son hold s th e land, m ay appl y to th e Sub -Di visional
Officer to be pl aced in possession and the Su b-Divi sion al Offic er, may in
accordance with the ru les m ade und er Sectio n 258 pl ace th e appli cant in possession
subj ect to hi s accept ance of th e li abilities of the o ccup anc y t enant for arrears of
rent and for advan ce f or necessar y exp en ses of culti vation.
(i) an y p er son who if h e sur vi ved the t en ant would inherit the
holding;

(3) On a surr end er b ein g executed und er sub -section (1), a bhumi swami

resu mption und er S ection 189 and th e excess l and , if any, sh all vest in the St at e
Govern ment and the b humi sw ami sh all be p aid compen sation for su ch excess l and,
whi ch shall be equ al t o two time s th e r ent payabl e th er efor und er Section 188.
(4) Wh er e any l and vest s in the State Govern ment und er sub -section ( 3),
the bhu mi swami sh all sp ecif y su ch land wi thin th e prescribed p eriod and in the
pre scribed mann er and on hi s f ailure to do so within su ch p eriod, such l and shall be
sp ecifi ed b y th e Su b-Di vision al Offi cer.
199. R eceipt.— Every bhu misw ami sh all gi ve a written re ceipt for t he
amount of r ent at th e time wh en su ch amou nt is recei ved by him in resp ect of an y
land in su ch for m and in su ch manner as may be prescrib ed.
200. Penalty f or failure t o give rec ei pt o r f or exc ess recov ery —If an y
bhumiswami fail s to give a r eceipt as r equired by Section 199 or recei ves b y w ay
of rent an y amount in excess of the r ent p ayabl e und er thi s Cod e, h e sh all, on the
appli cation of the o ccupan cy ten ant b e liabl e by an ord er of th e Tah sild ar to refu nd
the exce ss amount reco vered an d to pa y as p en alt y a sum not exceedin g l[tw o

thousand ru p ees], not exceeding twi ce su ch amount and th e Tahsildar may direct
that th e whol e or p art of su ch sum sh all be adju sted tow ards the amount of
co mp en sation payabl e by the occup an cy t en ant.
202. Reinst ate ment o f wrongf ully ejected occupancy tenant. — (1) If an y
per son w ho i mmediat ely b efore th e comin g i nto for ce of this Cod e h eld l and in an y
region in an y of th e capaciti es me ntion ed in.Section 185, has been ejected or
dispo ssessed of an y l and h eld by him durin g the three ye ars immediat el y pr ecedin g
the comin g into for ce of this Code, otherwi se than b y pro cess of law, may within
two years from the da te of comin g into forc e of this Code, appl y to the Tah sild ar
for hi s r einstat ement in such land.
(2) If an y p er son who on the comin g into force of this Co d e, hold s l and
as an occ up an cy ten an t has b een ej ected from or di spo ssessed of an y l and held b y
him, after the coming into force of this Cod e in contr avention of its provi sion s m ay

within two year s fro m th e d at e of su ch ej ectment or dispo ssession, appl y to the
Tah sildar for hi s r ein stat ement in such l an d.
(4) Th e Tah sild ar may, at an y st age of enquir y p ass und er sub -section (3)
an int erim order for h andin g o ver th e po ssession of the l an d to th e appli cant, if he
finds th at h e was ej ected or di spossessed b y th e oppo site part y within si x month s
prior to the submissi on of the ap plication under su b-sectio n (1) or (2), and th e
oppo site part y sh all, if necessary, b e eject ed und er hi s ord er.
(5) Wh en an int erim ord er h as b een passed under su b-section (4) , the
oppo site p art y may be required b y the Tahsi ldar, to execut e a bon d for su ch su m as
he may deem fit for abst ainin g fro m takin g possessio n of lan d unt il the final ord er

of their holdin gs or if in the course of an enquiry into an appli cation mad e und er
sub -section (1) or su b-section (2) t wo -thirds of th e bhumi swamis of th e village
mak e an appli cation agr eein g to th e consolidation of th eir holdings, su ch
appli cation sh all b e d eemed to b e th e appli cation on b eh alf of all t he bhu mi sw ami s
of the village.
(4) If in a case f alling un der sub -section (3), an y sch eme of con solid ation
of holdings is confirmed, it sh all b e bindin g on all th e bhu mi swamis of th e village,
and on an y p erson wh o may sub sequ entl y b e entitl ed to hold or occup y the l and.

ent er into such po ssession fro m a date to b e mention ed in the sch eme.
211. Pro cedu re o n confirmation. — (1) Upon confirmation of the sch eme
of con solid ation, the Con solidation Officer sh all, if n ecessar y, dem arcat e the
bound arie s of th e holdings and sh all pro ceed to announ ce th e deci sion s fin all y
mad e a nd cau se to b e pr epar ed in accord ance with th e sch eme, a n ew fi eld map,
record -of -ri ght s, othe r recor d s prescrib ed und er S ection 114 , Nist ar P atrak and
Wajib -ul-ar z.
(2) The n ew record s p repar ed und er sub-se ct ion (1) sh all be d eem ed to ha ve
been prep ar ed und er Chapt er IX or XV II, a s the case may be.

con solidation proceed ings, to tr an sf er or other wise deal with an y p art of his
origin al holdin g or l and so as to affect th e right s of an y oth er bh umi swami th ereto
under th e scheme of consolidation .
(2) Not withst an ding anything contain ed i n sub -section (1) or an y oth er
en act ment for th e time being in force the Co nsolidation Offi cer shall, if n ecessary,
put an y l essee or any mort gagee or oth er encu mbran cer entitl ed to possessio n, b y
w arrant , into po ssession of the h olding or part of a holdin g to whi ch hi s l ease,
mort gage or other en cumbrance has b een transf erred u nd er sub-sec tion (1).

241. Mea sures to p revent thef t of timber f ro m Govern ment f orest — (1) If
the St at e Go vernment is satisfi ed that in ord er to pr event th e theft of timber from
an y G o vern ment for est it is n ecessar y in the publi c int erest to re gul at e the f ellin g
and removal of timber in the villages comprised in any ar ea adjoin ing su ch for est s,
the St ate G overnment m ay, b y an ord er publish ed in th e Gazett e, decl ar e su ch area
to be notified ar ea for the p urpo ses of thi s section.
(3) Notwithst andin g anyth ing cont ained in Secti on 179 but subj ect to the
provi sion s of sub -section (5), when an or d er h as b een pro cl aimed in an y vill age
under sub -section (2), no per son sh all in pu rsu an ce of a tran sacti on of sal e or for
purpo ses of trad e or b usin ess fell an y timber tree in an y holdin g i n su ch village or
remo ve the corpu s of an y su ch tr ee fro m any such h olding except in accordance
with such rul es as may be mad e in th at b eh al f.

245. Rights to hold hou se site f ree of land rev enu e.— A buil ding site of
reason able dimen sion s in th e abadi sh all not be liabl e to th e payment of l and
revenu e if su ch sit e i s occu pied b y a kot w ar or a p erson who holds land or work s as
an agricultur al arti san or an agri cultural l abourer in such village or in a village
usu all y cultivat ed from su ch village.
246. Right of perso ns hol ding house si tes in a badi. —Subj ect to the
provi sion s of Section 244 ever y p er son who at the co min g into f o rce of thi s Code
lawfull y hold s an y l an d as a h ou se sit e in th e abadi or who may h ereaft er l awfull y
acquire su ch land shall be a bhu mi sw ami in resp ect of su ch l and

landl ess p er son on o r aft er the commen cement of the Madh ya Pr ade sh Land

24. (1) If any cl aim is set up b y a third person to the prop erty attach ed or
proceed ed against un der the pr ovi sion s of this Cod e, th e Revenue Officer shall
enq uire into the cl aim and may ad mit or reject it.
(2) Th e p er son again st who m an order i s mad e und er sub -rul e (1) may,
within on e year fro m the dat e of the ord er, institut e a suit to establi sh th e ri ght
whi ch he cl aims to the propert y att ach ed or proc eeded against; b ut subj ect to the
result of su ch suit, if any, th e order shall be con clu si ve.
SALE GENERALLY
26. (1) The Revenue Officer sh all cause a procl amation of the in tended sal e
to b e mad e st atin g t he time and pl ace o f sale and sp ecif ying as fairl y and
accur at el y as po ssibl e —
(c) the amount for the recover y of w hich th e sal e i s ordered; and
(d) every oth er thin g whi ch the Revenu e Offic er con sid er s mat erial s
for a pur ch aser to know in ord er to ju dge the n ature and the
valu e of th e prop ert y.

(2) A cop y of the pro cl am ation issu ed und er sub-rule (1) where it relate s to

27. Th e Revenue Officer m ay, if he con sider s thi s n ecessary, summo n the

29. (1) Th e Revenu e Officer m ay, in his di scretion, adjourn any sale
her eun d er to a sp ecified d ay and ho ur and the offi cer cond u cting an y su ch sal e
may, in hi s di scretion, adjourn the sal e r ecording his r eason s for such adjournment
Pro vided that wher e the ord er of th e Revenue Officer can b e obtain ed in
time, no such adjourn ment sh all b e made wi thout such order.

33. (1) Wh er e th e pro pert y to b e sold i s a gr owin g crop and the crop from its
nature ad mit s of bein g stored but h as not yet been stored, th e day of the sale shall
be so fi xed as to ad mit of it s bein g mad e read y for storin g b efor e th e arri val of
su ch d ay, and th e sale shall not be h eld unti l the crop h as b een cu t or gather ed and
is read y for storin g.

holding th e sal e direc ts, and in d ef ault of p ayment the prop ert y shall forth with be
resold.
(2) On payment of the purch ase mon ey, th e officer or other p erson holdin g
the sal e sh all grant a r eceipt for th e sam e, an d the sal e shall b eco me ab solute.
36. (1) Wh ere th e pro pert y sold is mo vabl e propert y of whi ch act ual sei zure
has b een mad e, it sh all be deliver ed to the purch aser.
37. On ever y sale of immovabl e propert y the p erson d ecl ared to b e the
purch aser sh all p ay i mmedi atel y after su ch d ecl aration a d epo sit of twent y-five p er
cent on th e amount of his purchase mon ey to the officer or oth er per son condu ctin g
the sal e, and in d ef aul t of su ch d ep osit, th e property shall forthwit h be resold.
38. Th e full amount of purch ase money payable sh all be paid b y the
purch aser within fifteen days fro m th e d at e o f the sal e of the property.

39. In d efault of payment within the p er iod mention ed in Ru le 38 , the
dep osit m ay, if the Revenu e Officer thin ks fit after d efr ayin g th e exp en ses, of the
sale, b e forfeit ed to the Govern ment, and the propert y sh all b e r esold and the
def aultin g p urch aser shall forf eit all claims to th e prop ert y or to an y p art of the
su m for whi ch it may sub sequ entl y be sold.
40. (1) Wh ere immo vabl e prop ert y has b een sold under thi s Code, an y
per son, eith er ow ning su ch prop ert y or hol ding an int er est ther ein b y virtu e of a
title acquired b efor e such sal e may, at an y t ime within thirt y d ays from the d at e of
sale, appl y, to th e Revenue Offi cer to h ave t he sal e set asid e on hi s d epo sitin g—
(2) If su ch d ep o sit i s mad e within thirty d ays from th e 'd at e of t he sal e the
Revenue Officer shall pass an ord er settin g asid e th e sale:
Pro vided th at, if a p er son ap plies un der Rule 41 to h ave su ch sale set asid e,

41. At an y tim e within thirty days from th e dat e of sal e, an y p erson who se
interest s are affect ed by su ch sal e may app ly to th e Revenu e Off icer to set aside
the sale on th e groun d of some materi al irregul arit y or mist ak e in publi shin g or
con du ctin g it, and th e Reven u e Officer may, aft er gi ving notic e to th e person s
affected th ereby, p ass an ord er setting asid e the sale and may or der r esal e; but no
sale shall b e set aside o n su ch ground s unless th e appli can t proves to the
sati sfaction of th e Revenue Offi cer that he h as sustain ed sub stanti al injury b y su ch
irregul arity or mistake.
42. Except in a case wh er e l and h as been sold for arr ears, which form a
ch ar ge on the land, th e pur ch aser may, at an y tim e within thirt y days fro m th e dat e
of sal e, appl y to the Revenue Offi cer to set aside the sal e on th e ground th at the

go od f aith to b e in po ssession of th e prop ert y on his Ow n ac count or on account of
so me p er son oth er than th e def aulter, the Revenue Officer sh all mak e an ord er
dismissin g the appli cation.

appli cation, supp orted b y affidavit or otherw ise, Of any p art y to th e pro ceedin gs or
of the witn ess to b e examin ed.
56. An y Revenue Officer m ay, in an y pro ceedings i ssu e a com mission for
the examin ation of —
(a) an y person r esid ent b eyo nd th e local li mits o f his juri sdi ction;
57. (1) A com missio n for th e examin ation of a p erson may b e i ssu ed to an y
per son who m the Court thinks fit to execute it, or to an y other Revenue Offi cer
who can con veni entl y examin e su ch p erson.
(2) Ever y Revenu e O fficer recei ving a commi ssion for th e examination of
an y person shall exam ine hi m or cau se hi m to b e examin ed pursuan t ther eto.
(3) Th e Revenue Offi cer o n i ssuin g any co mmi ssion und er thi s rule shall
direct wh ether the co mmission shall b e returned to himself or to an y Revenue
Officer su bordin at e to him.

61. (1) The pro vi sio ns of thi s Cod e r el ating to the summonin g, att endance
and examin ation of witnesses, and to th e remun er ation of, an d pen alties to be
impo sed u pon witn ess, sh all appl y to p er sons r equired to give eviden ce or to
produ ce do cument s u nder the se rul es an d for the purp o ses o f this rul e the
Commi ssioner sh all b e deemed to b e a Reven ue Court.
(2) A Commi ssioner may appl y to an y Reven ue Officer within the local
limits of who se juri sdi ction a witness r esid es for the issu e of an y process which he
may find it n ecessar y to i ssu e to, or aga inst, su ch witn ess, and su ch Reven ue
Officer may, in his di scr etion, i ssu e su ch p roc ess as he considers r eason able and
proper .

65. A ny person who i s of sound mind and has att ain ed majority and who se

the pro ceedin gs.
(2) Any su ch agreem ent or co mpro mi se ent ered into without the lea ve of the
Revenue Offi cer so re cord ed , sh all b e voidable against all p arties oth er th an the
minor.
68. The pr ovision s co ntain ed in Rules 63 to 67,shall appl y mutati s muta ndi s
to perso ns of u n sound mind.
