सा.का.िन. 1183(अ).—के ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए ा प िनयम िजसे भारत सरकार के
सड़क प रवहन और राजमाग मं ालय क अिधसचूना सं. सा.का.िन. 744(अ) तारीख 28 जुलाई, 2016 ारा मोटर यान अिधिनयम,
1988 (1988 का 59) क धारा 212 क उप-धारा (1) क अपे ानुसार उन सभी यि तय से िजनके उससे भािवत होने क संभावना
थ , ा प िनयम से यु त उ त अिधसूचना क ितयां जनता को उपल ध करा दी गई थ , तीस दन क अविध के समाि त से पहले
आ ेप और सुझाव आमंि त करते ए कािशत कए गए थे;
और उ त राजप अिधसूचना क ितयां तारीख 28 जुलाई, 2016 को जनता को उपल ध करा दी गई थ ;

और उ ा प िनयम क बाबत जनता से कोई आ ेप और सुझाव ा नह ए ह;

अतः, अब, क ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) क धारा 110 क उपधारा (1) ारा द शि य
का योग करते ए, क ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन िलिखत िनयम बनाती है, अथात् :-

1. (1) इन िनयम का संि नाम क ीय मोटर यान (22वाँ संशोधन) िनयम, 2016 है ।

(2) ये राजप म उनके काशन क तारीख को वृ ह गे ।

2. के ीय मोटर यान िनयम, 1989 म,—

(i) िनयम 9 म, उपिनयम (2) म “िनयम 32 क सारणी क म सं या 8 म यथािन द ट” श द , अ र और अंक के थान पर

“िनयम 32 क सारणी म यथािन द ट” श द और अंक रखे जाएंगे;

(ii) िनयम 14 के उपिनयम (1) म खंड (ख) के थान पर िन निलिखत खंड रखा जाएगा, अथात् :—

“(ख) यथाि थित, परी ण या प चातवत परी ण िनयम 32 म येक वग को चलाने के िलए और अनु ि त जारी करने के िलए
यथािविन द ट समुिचत फ स;”;

(iii) िनयम 32 के थान पर िन निलिखत िनयम रखा जाएगा, अथात् :-

करार के र होने के प चात् नए रिज ीकरण क दशा म दो सौ पये क अित र त फ स भा रत क जाएगी ”।

कािशत कए गए थे और अंितम संशोधन सा.का.िन. सं. 1096 (अ), तारीख 28 नव बर, 2016 ारा कया गया ।

NOTIFICATION
New Delhi, the 29th December, 2016

G.S.R. 1183(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were
published, as required by sub-section (1) of Section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification
of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 744(E), dated the 28th July,
2016, in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions
from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies
of the said notification containing the draft rules were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 28th July, 2016;
And whereas, no objections and suggestions were received from the public in respect of the said draft rules.
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of
1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules,
1989, namely:
1. (1) These rules may be called the Central Motor Vehicles (Twenty-second Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989,-
(i) in rule 9, in sub-rule (2), for the words, letters and figures “as is referred to in Sl.No.8 of the Table to rule 32”,
the words and figures “as specified in the Table in rule 32” shall be substituted;

(ii) in rule 14, in sub-rule (1), for clause (b), the following clause shall be substituted, namely:-
“(b) appropriate fee as specified in rule 32, for the test, or the subsequent test, as the case may be, of
competence to drive for each class and for issue of licence;”;
(iii) for rule 32, the following rule shall be substituted, namely:-
“32. Fees.—The fees which shall be charged under the provisions of this Chapter shall be as specified in the
table below:
Provided that the States may levy additional amounts to cover the cost of automation and technology utilised for
conducting the testing or providing value added services.

2. The fees specified at serial numbers 1, 2 and 3 of the Table above shall be paid collectively at the
time of submission of application for issue of learner’s licence or driving licence or for endorsement of
another class of vehicle, as the case may be.”;

(iv) for rule 81, the following rule shall be substituted, namely:-
“81. Fees.-The fees which shall be charged under the provisions of this Chapter shall be as specified in the
Table below:

Provided that the States may levy additional amounts to cover the cost of automation and technology
utilized for conducting the testing or providing value added services.

Note 1: For the removal of doubts, it is hereby clarified that medium passenger motor vehicles, heavy goods vehicles,
imported motor vehicles or any other vehicles not mentioned against Serial No.4 of the above Table include
both transport and non-transport vehicles.
Note 2: Where the certificate of registration issued is in the form of any Smart Card Type, an additional fee of rupees
two hundred shall be charged except in the case of issue of fresh certificate of registration after cancellation of
hire purchase or lease or hypothecation agreement.”.
