ORDER

This refers to the joint assessment conducted at the above-named


establishment on March 1, 2017. Under Department Order No. 131-B,
Joint Assessment refers to the process of evaluating compliance with
labor laws and social legislations jointly undertaken by the Labor Laws
Compliance Officer (LLCO) and the representatives of the employers and
employees.

The Checklist and Notice of Results were issued, furnished and


explained by LLCO ANA SHIELA F. GALANG to the respondent, through
its representative, MARIANNE JULIENNE VELASQUEZ, where the
following findings were noted:

On General Labor Standards (GLS):


1. Underpayment of 13th month pay;
2. No Lactation Station;
3. No Committee on Decorum and Investigation;
4. Non-presentation of proof of remittances of SSS, HDMF and
PhilHealth from January 2016 to present.

On Occupational Safety and Health Standards (OSHS):


1. Poor housekeeping;
2. Poor materials handling and storage;
3. No Safety and Health Committee;
4. No emergency medicines;
5. No Minutes of Meeting of Safety and Health Committee;
6. No Annual Work Accident/Illness Exposure Data Report; and
7. No Annual Medical Report 2016.

Records reveal that Mandatory Conferences were conducted on


April 21 and 28, 2017 but respondent failed to appear despite due notice.

Considering that respondent failed to effect corrective actions on the


noted deficiencies, this Office adopts the findings submitted by the Labor
Laws Compliance Officers who is presumed to have performed her duties
in a regular manner in the absence of evidence to the contrary.

Based on interview and affidavits of the employees, they were only


paid half of their 13th month pay for 2016. However, since payroll of 13th
month pay is not available, computation shall be based on the basic pay
of the employee as shown in the submitted payroll.

WHEREFORE, premises considered, respondents PELT


INFORMATION SYSTEMS, INC. and/or TERESITA M. TORRES is/are
ordered to pay GAY C. SANTO and seventeen (17) other similarly
situated employees, the aggregate amount of ONE HUNDRED FIFTY-SIX
THOUSAND SEVEN HUNDRED FORTY-SIX PESOS (Ph156,746.00),
representing underpayment of 13th month pay within ten (10) days from
receipt hereof. Failure to comply with this Order within the period prescribed
shall cause the imposition of penalty of Double Indemnity pursuant to
Republic Act 8188, otherwise known as “An Act Increasing the Penalty and
Imposing Double Indemnity for Violation of the Prescribed Increase or
Adjustment in the Wage Rates.”

LIKEWISE, respondents, PELT INFORMATION SYSTEMS, INC.


and/or TERESITA M. TORRES is/are hereby directed to submit its proof
of provision of lactation station, composition of its Committee on Decorum
and Investigation on Sexual Harassment, proof of remittances of
premiums to SSS, Pag-IBIG and PhilHealth for the period January 2016
to present, proof of good housekeeping, materials handling and storage,
composition of its Safety and Health Committee, proof of availability of
emergency medicines, copies of minutes of meeting of its Safety and
Health Committee, Annual Work Accident/Illness Exposure Data Report
and Annual Medical Report within ten (10) days from receipt hereof.
Otherwise, legal measures shall be taken by this Office for the
enforcement of this Order.
