RESOLUTION NO. 19- WHEREAS, the City Council has reviewed the ad valorem tax levies presently made within the corporate limits of the City for public school purposes and, based upon such review, the Council has determined that, in order to provide for the uniformity and equalization of the rates of ad valorem taxation levied in the City for public school purposes, the rates at which several of those taxes are currently levied should be adjusted, but without change to the aggregate rate of such taxes, so that there would not result in any increase or decrease in the net amount of school tax millage to be levied in the City, and WHEREAS, under applicable provisions of Section 217 of the Constitution of ‘Alabama and subject to certain conditions, the rates of any City ad valorem taxes may be reduced simply by resolution of the Council or other taxing authority, but any offsetting rate adjustments would necessitate the enactment of local legislation applicable to the City by the Legislature of ‘Alabama, and the approval thereof by the qualified electors of the City affected, and WHEREAS, the Huntsville City Board of Education has expressed a desire for uniformity and equalization of ad valorem school tax rates throughout the City, and, WHEREAS, legal counsel for the City has prepared and the Council has reviewed a form of legislative bill for advertisement and introduction in the Legislature, the effect of which would be to allow the City to take the steps necessary to ensure equalization of City ad valorem school tax levies throughout the City, and WHEREAS, such legislative bill must be advertised prior to its introduction in the Legislature, and WHEREAS, the Alabama Legislature is in regular session at this time and the Council has been advised that it is possible for the needed bill to be enacted at the current legislative session, provided the City moves forward promptly with the advertising and subsequent introduction of the necessary bill, and WHEREAS, under applicable law, before the adjustment of the rate or rates of any ad valorem tax already being levied at the full authorized rate thereof can be accomplished, a public hearing on the question of such adjustment must be held, and. WHEREAS, pursuant to prior action of the Mayor of the City, such public hearing has now been held and concluded following appropriate public notice thereof NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF HUNTSVILLE, that the City Council proposes that the ad valorem tax on all taxable property in the City presently levied and collected for public school purposes in the City pursuant to Amendment No. 8 to the Constitution of Alabama of 1901, which tax is presently authorized at a rate of 6 and 1/2 mills on each dollar (8.65 on each one hundred dollars), be increased by 15 and 1/2 mills on each dollar ($1.55 on each one hundred dollars) of assessed value of taxable property in the City, which such increase shall be contingent upon a favorable vote of the qualified
