SALE DEED

THIS DEED OF ABSOLUTE SALE IS EXECUTED AT CHENNAI ON THIS


….. DAY OF DECEMBER 2017, BY
Mr.SUBRAMANIA MUDALIAR, Son of Panchatchara Mudaliar, residing
at No.1/51, Pillaiyar Koil Street, Thandalam, Chennai-602 101, duly represented
by his Power Agent Mr.D.DURAISINGH, (PAN NO.AAIPD4510A) S/o.
Shri.Devapitchai Nadar, aged 53 years, residing at No.48, 3 rd Street, Brindavan
Nagar, Valasaravakkam, Chennai-600 087,(Power of attorney registered as
Doc.No.599/2011, dated 03.06.2011, in SRO Pammal) hereinafter called the
‘VENDOR’ of the ONE PART:
TO AND IN FAVOUR OF

1.Mr.N.VIJAY SUNDAR, (PAN: ANOPV9911A) Son of Mr.Navarathinaraj,


aged about 29 years and 2. Mr.N.ARUN, (PAN: BAHPA3835R) Son of
Mr.Navarathinaraj, aged about 26 years, both residing at No.5, Kovarthana
Nagar, 8th Street, Nerkundram, Chennai-600 107, hereinafter called the
‘PURCHASERS’ of the OTHER PART:
The terms ‘VENDOR ’ and ‘PURCHASERS’ which expression shall mean and
include wherever the context so requires or permits, their legal heirs, legal
representatives, executors, administrators, nominees and assigns of the
WITNESSETH AS FOLLOWS:-
WHEREAS the Vacant land, measuring Ac.0.78 cents in Survey No.95/1,
situated at Thandalam Village, Sriperumbudur Taluk, Kanchipuram District, was
originally belonged to Mr.Subramania Mudaliar, he having acquired the same from
his father Ponnusamy Mudaliar, under a Deed of Settlement dated 06.11.1979,
registered as Doc.No.3013/1979, in Book 1, Volume 838, Pages 21 to 26 in the
office of the Sub Registrar of Pallavaram.

WHEREAS the Vendor had converted the above said land into House-sites,
namely “AKASH NAGAR ANNEXE” bearing Plot No.1, measuring 2400 Sqs.ft. Plot
No.2, measuring 2400 Sq.ft. Plot no.3, measuring 2400 Sq.ft. and Plot No.4,
measuring 2400 Sq.ft. and he obtained Approval from CMDA, vide Planning
Permit No.1298/08, D.Dis.No.6722/07/A3, dated 02.12.08.

WHEREAS the Vendor herein decided to dispose the above said plots, do
thereby appointed and nominated one Mr.D.DURAISINGH, S/o.Devapitchai
Nadar,and the Power of attorney registered as Doc.No.599/2011, dated
03.06.2011, in SRO Pammal.
Whereas the Vendor herein has entered into a Construction Agreement with
the Purchasers on 28th October 2017, registered as Doc.No…..………./2017, dated
01.12.2017 in SRO Pammal.
WHEREAS the Vendor’s Power Agent offered to sell the 425 Sq.ft.
Undivided share land out of Schedule ‘A’ mentioned property, morefully
described in Schedule ‘B’ hereunder, for a sale consideration of a sum of
Rs.5,14,250/- (Rupees Five Lakhs Fourteen Thousand Two Hundred
Fifty only) and the Purchasers have also agreed to purchase the same free
from all encumbrances.

NOW THEREFORE THIS DEED OF SALE WITTNESSETH THAT:

In pursuance of the above agreement and in consideration of the sum


of Rs.5,14,250/- (Rupees Five Lakhs Fourteen Thousand Two Hundred
Fifty only) paid by the Purchasers to the Vendor in full settlement, the receipt
of which sum the Vendor doth hereby, admits, acknowledges and release the
Purchasers from any further payment towards this sale transaction.

The Vendor doth hereby grants, conveys, transfers, assigns all that piece
and parcel of 425 Sq.ft. UNDIVIDED SHARE OF LAND mentioned in the “B”
Schedule property hereunder, to and in favour of the Purchasers free from all
encumbrances, with all the rights, drains, ditches, water, water courses, liberties,
privileges, advantages, appurtenances whatsoever together with all the rights,
interest, claims and demands whatsoever of the Vendor into or upon the said
property TO HAVE AND TO HOLD UNTO and to the use of the Purchasers
absolutely and forever free from all encumbrances, charges, lien, right, trust,
will, litigation lispendens, attachments, demand of any kind whatsoever incurred
prior to the date of this conveyance.

WHEREAS the Vendor do hereby covenants with the Purchasers that the
Purchasers may enter into, quietly possess and enjoy the said Schedule B

property, as their own receiving the rents and profits thereof without any let,
hindrance, interruption, eviction, claim or demand whatsoever of the Vendor or
from any person or persons claiming through or under or in trust for the Vendor.
WHEREAS the Vendor do hereby covenants with the Purchasers that the
property hereby conveyed is free from all encumbrances, claims, lien, lispendens,
court attachment and that the said Schedule B property is not the subject matter
of any pending litigation in any court of law or tribunal.
WHEREAS the Vendor do hereby covenants with the Purchasers that he
has not done or suffered or been a party or privy to any act, deeds, things by
reason of which their titles to the Schedule B mentioned property is in any way
hampered.
WHEREAS the Vendor has paid all the rates, taxes and other public dues
outgoings in respect of the Schedule B property up to date and the Purchasers
shall be liable to pay the same from this day only.
WHEREAS the Vendor do hereby covenants with the Purchasers that he
will from time to time and at all times do all acts, deeds and things which may be
necessary to fortify and more perfectly and fully assuring and conveying the title
of the property as the Purchasers may reasonably requires;
THE PURCHASERS are at liberty to apply for transfer of the Patta from the
concerned Revenue Authorities in their name. The Xerox copy of Sale Deed and
Power of Attorney of the Vendor together with Xerox Copies of the connected
parent documents and other records have been handed over to the Purchasers
this day by the Vendor.
Principal is alive and the Power of Attorney is still in force.
SCHEDULE A PROPERTY
All that piece and parcel of Vacant land, bearing Plot No.1, measuring an extent of
2400 Sq.ft., in ‘AKASH NAGAR ANNEXE’, (Planning Permit No.1298/08,
D.Dis.No.6722/07/A3, dated 02.12.08) Comprised in Survey No.95/1, situated at
Thandalam Village, Sriperumbudur Taluk, Kanchipuram District, being

BOUNDED ON THE:

North by : Plot No.2


South by : Vacant land
East by : Vacant land
West by : 24 Feet Road

North by : 60 Feet
South by : 60 Feet
East by : 40 Feet
West by : 40 Feet
In all admeasuring total extent of 2400 Sq.ft. or thereabouts

And situate within the Sub-Registration District of Pammal and Registration District of
Chennai South.

SCHEDULE ‘B’ PROPERTY

425 Sq.ft. Undivided share of land out of 2400 sq.ft. morefully described in
‘A’ Schedule of Property.

The Present Market Value of the Schedule “B” property is Rs.5,14,250/-.


IN WITNESS WHEREOF THE VENDOR’S POWER AGENT AND PURCHASERS HAVE
SIGNED THE SALE DEED ON THE DAY, MONTH AND YEAR FIRST ABOVE WRITTEN IN THE
