1. NAME

3. GENERAL DESCRIPTION / JUSTIFICATION

 Right in the outset of last Financial Year 2015 -16, the services of
ECSP were hired on special direction of the Chief Minister Punjab
to identify Dangerous School Buildings in Punjab against a huge
allocation of funds amounting to Rs.8000.000 million in la rger
public interest. The firm identified thousands of S chool Buildings
(4727) as ‘Dangerous’ throughout the Province.
 Accordingly more than 2808 -scheme were put under execution
against the available allocation of Rs.8000.000 million under Block
Allocation ‘Reconstruction of Dangerous School Buildings’ reflect ed
at GS No.179 in ADP 2015 -16. More than 98% buildings have been
reconstructed and the rest are very near to be completed.
 Chief Minister during a Stock -Take meeting in 2015 had desired
even to have TPV against the work being executed under the
project at district level. The same direction s were conveyed
through an approved summary dated 31.07.2015 as well. More
than half of the Financial Year was over and the schemes were
already under execution at district level and were badly needed to
be monitored by TPV as desired by the Chief Minster. Therefore,
an urgent contract was signed with the same firm under P unjab
Procurement Regulatory Authority (PPRA) during January 2016
with an opinion that payments would be made out of next year’s
ADP i.e. 2016-17 as no cushion was available in ADP 2015 -16.
 During first demand of funds for 1 s t half 2016-17, School Education
Department informed P&D that Rs.50.000 million were reserved for
payment to the firm M/S ECSP after completion of TPV.
 After the completion of the TPV work and submission of its report,
M/S ECSP presented its bills for payment in the light of signed
agreement.
 P&D Department was twice requested vide letter
No.SO(ADP)Conultancy-439/2016 dated 24.10.16 & 21.11.16 to
allocate the requisite amount out o f reserved share under block
allocation title ‘Reconstruction of dilapidated School Buildings’
reflected at GS No.414 in ADP 2016 -17 on the basis of approved
summary and signed agreement.
 Planning and Development, in return, advised School Education
Department vide letter No.1(660)PO(EDU)P&D/2016 dated
28.11.16 to have ex-post-facto approval of the project from the
competent forum of PDWP for having allocation of requisite funds
against the service provider firm as TPV.

4. DETAILS OF STUDY

 Co-ordination with Resident Supervision Consultants.
 Monitor executed work as per specifications.
 Check laboratory reports for various material tests.
 Joint visits to selected school sites as per TORs.
 Photographs of various construction activities at sites for compiling
reports.
 Preparation and submission of soft & hardcopy of Nine Divisions /
36 Districts of Punjab on monthly basis.

● Full payment to consultant shall be made after completion of


assignment, submission of report and presentation of bill as per
Rules & Government financial practices
● Payment to consultant shall be subject to all applicable
Government taxes.

● Consultant’s remuneration shall not exceed amount of agreement


price

● In case of failing of consultant to complete the assignment on


time, a penalty of 0.1% per day up to the maximum of 10% of
the agreement cost will be imposed. The release of payment
shall be as per schedule provided.

(vii) Reporting

As per Annex- B
Taxes

Income / withholding tax or any tax levied upon the income of Consultants shall be
deducted by the Client at the time of payment against consultancy remunerations.
Client has to furnish a tax deduction certificate / income tax payment challan to the
Consultant after payment of deducted income / withholding tax. The Client agrees to
pay 16% Punjab Sales Tax on Services as levied under Punjab Sales Tax on Services
Act 2012.
2.1 Effectiveness of Contract

The date on which this Contract shall come into effect is the date when the Contract
is signed by both the Parties.

2.2 Termination of Contract for Failure to Become Effective

The time period shall be thirty (30) days or such other period as the Parties may
agree in writing.

2.3 Commencement of Services

The Consultants shall commence the Services within fifteen (15) days after the date
of signing the Contract Agreement, or such other time period as the Parties may
agree in writing.

2.4 Expiration of Contract

The period of completion of Services shall be six (06) months from the
Commencement date of the Services or such other period as the Parties may agree
in writing.

3.8 Documents Prepared by the Consultants to be the Property of the Client

The Client and the Consultants shall not use these documents for purposes unrelated
to this Contract without the prior written approval of the other Party.

5.1.3 Approvals

The Client shall accord approval of the documents immediately but not later than
fourteen (14) days from the date of their submission by the Consultants.

6.2 Remuneration and Reimbursable Direct Costs (Non-salary Costs)

The Consultant will raise its monthly invoice as per Appendix-E at the end of each
month.
