Ms. Maleeka Ali Bokhari: Thank you. I beg to move that the Bill
further to amend the Islamabad High Court Act, 2010 [The Islamabad
High Court (Amendment) Bill, 2019], as reported by the Standing
Committee, be taken into consideration at once.

‫‪honourable member for raising this Amendment because this is her‬‬
‫‪right.‬‬

‫ارگ آپ‪ section (3)(1) of the Islamabad High Court Act, 2010‬وک دںیھکی وت اس ےک‬
‫ادنر‪ already‬اھکل وہ اےہ ہک بج یھب‪ judges appoint‬وہں ےگ ‪they will be appointed‬‬
‫‪from different provinces and other territories.‬‬

‫دورسی ابت ہی ےہ ہک االسل آابد اہیئ وکرٹ یک‪ territorial jurisdiction‬ایسی ںیہ ہک اہیں‬
‫ہپ‪ regulatory bodies‬ںیہ‪ companies ،‬ںیہ اور تہب اسری ایسی ‪ organizations‬ںیہ ‪so we‬‬
‫‪require judges that come different set of legal expertise. We cannot‬‬
‫‪appoint judges on the basis of domicile. They have to be appointed on‬‬
‫‪the basis of their legal acumen and their legal expertise. So, on this‬‬
‫‪basis, we oppose this Amendment strongly.‬‬

2019], as reported by the Standing Committee, in clause 2, the
proposed Amendment in subsection (1) of Section (3) may be
numbered as paragraph (a), and thereafter the following paragraph (b)
shall be added, namely-

“(b) for the full stop at the end a colon shall be substituted and
thereafter the following proviso shall be added, namely:-

“provided that the Judges approved duly by the Parliamentary

Committee will provide their income tax returns and statement of
assets for the immediately preceding five fiscal years.”

Amendment and the honourable Member has pointed out a

number of things. I would like to respond to them one by one in turn.
I was present there. There was ‫ ےہ‬dissenting note ‫ابت ہی ےہ ہک یٹیمک اک‬
dissenting note by Members, but the Committee then said that

and then we will have to amend the Constitution. We will have to

amend Article 193 of the Constitution. So, that is why, we oppose this
Amendment.

Let me get into the issue please. I ،‫ رکیپس اصبح! اےسی ےھجم ںیہن‬:‫رتحمہم ہسیفن اشہ‬
On behalf of the entire Opposition ‫اور ہی ریما ااقحتسق رجموح وہراہےہ ہک‬drafted this.
drafted a note of dissent does not get the opportunity to speak and
Speaker Sahib, we are not opposing for the sake of opposing. There are
reasons and we are speaking for the powers of this Parliament, for the
‫ انجب‬prerogative of the Committee and above all for the Ministry itself.
‫وہا اور اس ںیم اوسفس ےس انہکڑپاتےہ۔‬discuss ‫ سج ںیم ہی لب‬،‫رکیپس! اس دم رصف دو زگنٹیم وہںیئ‬
It seemed like a ‫وج رٹسنمی ےہ‬Madam Parliamentary Ministry is sitting here
post office. The Ministry did not have a view, did not even want to have
a view, did not want to get the figures that was solicited by the
Committee without any information. How can this Parliament make an
informed decision.

Mr. Speaker, and if this House is sovereign and this is an oversight

body and this House through a Constitutional Amendment has the final
right of appointment of judges. Don’t treat us like a post office and
don’t treat your Ministry like a post office. !‫مہ وت آپ یک ابت رکرےہ ںیہ وت انجب رکیپس‬
‫اس وک‬I will not repeat the substantive matters that have been discussed
by my colleagues but I will talk of procedures and the prerogative of
this House, Mr. Speaker. ‫وت ارگ آپ اوپزنشی وک ںینس ےگ وت اشدی آپ یک وگرٹنمن‬
strengthen ‫وہاور‬rule of laws strengthen ‫وہ۔ویکہکن مہ ےن وج ابت یک‬procedural ‫ہی ابت‬
‫وہیئ ہک‬Committee wanted a certain information on the basis of which we
would agree or disagree with the government’s position. ‫اور وہ‬
information‫ہن رصف ںیہن دی یئگ‬There was an unwillingness ‫ اور اکی‬urgency ‫ڈراھت ہک‬
‫ںیمہ وجیھب آرنلبی زجج ںیہک ای رپسمی وکرٹ ےہک وتںیمہ وہ رکانےہ۔‬We have to, Mr. Speaker,
apply our minds because these laws are coming for all times to come. ‫وت‬

has been moved that the Bill further to amend the Islamabad High

Court Act, 2010 [The Islamabad High Court (Amendment) Bill, 2019], be
passed. (The Motion is adopted and consequently the Bill was passed.)
