MANIFESTATION with MOTION

COMES NOW, Respondents, through the undersigned counsel
and unto the Honorable Court of Appeals, most respectfully manifest
that:

1. On 28 December 2018, the Respondents received a Resolution

by the Court of Appeals (21st Division) dated 14 December 2018,
requiring the Respondents to file a, within 10 days from receipt,
a Comment on the Petition filed by the herein Petitioner;

2. Moreover, the undersigned counsel only received the copy of the

subject Resolution only this January 7, 2019;

3. However, up until today, the Respondents nor the undersigned

counsel were not furnished with a copy of the Petition;

4. Considering the above-mentioned predicament of the

Respondents and because of the impossibility to intelligently
comment on the petition absent any copy thereof, Respondents
ask that they be given an additional ten (10) days from receipt of
the Petition/rectified Petition.
IN VIEW OF THE FOREGOING, it is most respectfully prayed that
this Court:
1. To duly NOTE this manifestation;
 2. To allow the Respondents to file a Comment to the
Petition within ten (10) days from receipt of the Petition
or from receipt of the rectified Petition;

Other reliefs just and equitable are likewise prayed

for based on the above premises.
