AFFIDAVIT
I, SPECIAL AGENT ELA PEREZ, of legal age, Filipino, single,
and a resident of Mandaue City, after having been duly sworn in
accordance with law, do hereby depose and say that:
1. Lama lawyer by profession and is presently a special
agent of the National Bureau of Investigation (NBI), Regional Office
No. VII, stationed in Cebu City. For the past ten years I have been
assigned as Head of the NBI’s Heinous Crimes Division.
2. As Head of the NBI's Heinous Crimes Division, 1 conducted
hundreds of investigations involving heinous crimes that resulted in
successful prosecution and conviction of the suspects. I also
participated in numerous trainings and seminars here and abroad
involving crime investigation, including autopsy examinations and
electronic evidence gathering and analysis.3. Sometime on 15 February 2019 at around 8:00 in the
morning, our office received a report that a body of a dead woman
was thrown off a cliff in Barangay Busay, Cebu City
4. Acting on the report, my team and I wasted no time in
proceeding to the place where the body was found. Upon arrival at
the area, several residents of the place were gathering around the
body of the victim. In accordance with the standard operating
procedure, we then cordoned the area off and conducted autopsy on
the cadaver of the victim.
5. The autopsy examination that I personally conducted reveals
the following findings:!
“(a) Date and time
of examination: — February 15, 2019 at 12:00 pm;
(b) Approximate
time of death; twelve (12) hours prior to examination;
(6) Cause of death : multiple stab wounds and head injury;
(d) Injuries sustained:
(i) twenty-six stab wounds in various parts of the body;
(ii) the skin of the entire face was ripped off using sharp
bladed instrument exposing an open wound;
(iii) eyes popped out;
(iv) tongue protruded from the mouth;
(v) head injury caused by a blunt instrument.
(e) Other remarks: body was totally naked with a white laced
underwear pulled down to the ankle; old
laceration found in the hymen; negative of
spermatozoa.”
6. Our team also found some items near the body of the victim,
such as a white handkerchief? embroidered with the capital letter “J’
and the words “I love you 3,000", a pair of size 10 black sneakers,’ and
a silver Samsung Galaxy cellphone.*

Exhibit “D”.7. We would later learn that the full name of the victim is
Jolleane Perino (“Jolleane”), 24 years old, a resident of Lahug, Cebu
City, and a third year law student of the University of San Carlos,
whose cadaver was positively identified by her parents and relatives
8. Jolleane’s gruesome murder shocked the nation and
generated intense public furor that no less than the President of the
Republic of the Philippines ordered the NBI to conduct hot pursuit
operation and bring to justice the persons responsible for such an
abominable crime. We were given two weeks to solve the case.
9. In the ensuing extensive investigation that our team
conducted, we were able to gather from the accounts of eyewitnesses
that at around 5:00 p.m. of February 14, 2019, Jolleane was seen
attending a mass held at the Lahug Parish Church where she was the
lead singer of the church choir that serviced the mass administered
on that evening. After the mass ended at past 6:00 p.m. of that day,
Jolleane was also seen agitated while talking to a man her age in front
of the church’s main entrance. After a few minutes, Jolleane and the
man hurriedly walked towards the parking lot and boarded a
motorcycle and left the church with the man driving and Jolleane
backriding. The man was later identified by witnesses as Jeffrey
Thomas Fuentes (“Jeffrey”), 24 years old, a third year law student at
the University of San Carlos, and a resident of No. 6 Camia Street,
San Jose Village, Barangay Tisa, Cebu City.
10. Our team also gathered a video recording captured by the
Close Circuit Television (CCTV) installed by Marco Polo Hotel by the
roadside showing Jolleane and Jeffrey on board a motorcycle going to
the direction of Barangay Busay, Cebu City
11. Applying my expertise, training, and experience on
electronic evidence gathering, examination, and analysis, I opened
and examined the cellphone that we found at the place where the
cadaver of the victim was discovered and confirmed that the
cellphone belonged to Jolleane as her picture is used as the screen
saver and her name corresponds to the number saved in the
cellphone’s contacts directory. Jolleane’s parents also confirmed
Jolleane’s ownership over the phone having seen Jolleane using, the
phone before her death.
12. As I browsed over the text messages found in Jolleane’s
cellphone, I particularly found a series of text exchanges between
Jolleane and Jeffrey. I gathered from the members of Jolleane’s
family and close friends that Jeffrey is Jolleane’s ex-boyfriend, whom
Jolleane met in law school.
