But where the Appointing Authority fails or refuses

to act within such period of time provided under
applicable rule or within 30 days from receipt of
the request for the Appointing Party to act on the
challenge, the aggrieved party renew the
challenge in court. The challenge shall be filed as
a petition with the Regional Trial Court
