Republic of the Philippines Professional Regulation Commission Manila Professional Regulatory Board for Foresters Resolution No. OL Series of 2016 IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 10690, OTHERWISE KNOWN AS AN ACT REGULATING THE PRACTICE OF FORESTRY IN THE PHILIPPINES, AND APPROPRIATING FUNDS THEREFOR, REPEALING FOR THE PURPOSE REPUBLIC ACT NUMBERED SIX THOUSAND: TWO HUNDRED THIRTY-NINE (R. A. NO. 6239), KNOWN AS THE “FORESTRY PROFESSION LAW” Pursuant to Section 10 (w), Article Il and Section 40, Article V of Republic Act No. 10690, otherwise known as An Act Regulating the Practice of Forestry in the Philippines, and Appropriating Funds Therefor, Repealing for the Purpose Republic Act Numbered Six Thousand Two Hundred Thirty-Nine (R. A. No. 6239), known as the “Forestry Profession Law’, the Professional Regulatory Board for Foresters, with the approval of the Professional Regulation Commission, hereby prescribes, issues and promulgates the following set of rules and regulations for the purpose of implementing the provisions of R. A. No. 10690. RULE! X TITLE, STATEMENT OF POLICY, OBJECTIVES, DEFINITION OF TERMS AND THE PRACTICE OF FORESTRY i) Section 1. Title. - This Resolution shall be referred to as the Implementing Rules and Regulations (IRR) of R. A. No.10690, otherwise known as An Act Regulating the Practice of Forestry in the Philippines, and Appropriating Funds Therefor, Repealing for the Purpose Republic Act Numbered Six, Thousand Two Hundred Thirly-Nine (R. A. No, 6239), known as the “Forestry Profession Law’, or for brevity, the IRR of R.A. No. 10690 or the Forestry Profession Act. Section 2. Statement of Policy. - The State recognizes the importance of ___ professional Foresters in nation-building and development. Hence, it shall develop and “nurture competent, ethical, globally competitive and well-rounded professional “Foresters who shall observe the highest standards of excellence, and whose professionalism shall be fostered through the administration of transparent, credible and relevant licensure examinations, a system of registration and self-regulation, and through continuing education This IRR of R. A. No. 10690 shall be interpreted, construed and carried out in the light of the Statement of Policy found in Section 2, Article | of R. A. No. 10690, as stated above. Section 3. Objectives. - R. A. No. 10690 and this IRR shall govern the: a) examination, registration and licensure of professional Foresters b) supervision, control and regulation of the practice of Forestry in the Philippines; ©) development and upgrading of the curriculum; P. BOX 2038, MANILA IMPLEMENTING RULES ANO REGULATIONS OF REPUBLIC ACT NO. 10650, OTHERWISE KNOWN AS AN AG’ REPEALING FOR THE PURPOSE REPUBLIC ACT NUMBERED SIX THOUSAND TWO HUNDRED THERTY-NINE (NO. 6259), KNOWN AS THE FORESTRY PROFESSION LAW. d) development of the professional competence of professional Foresters through mandatory Continuing Professional Development (CPD); and €) integration of the Forestry profession. Section 4. Definition of Terms. - For purposes of this IRR, the following terms shall mean: a) Board refers to the Professional Regulatory Board for Foresters; b) Board Chairperson refers to the Chairperson of the Professional Regulatory Board for Foresters; c) Commission refers to the Professional Regulation Commission created under R. A. No. 8981, also known as the “PRC Modernization Act of 2000"; d) Commission Chairperson refers to the Chairperson of the Commission; €) Professional Forester refers to a registered and licensed natural person who holds a valid Certificate of Registration (COR) and Professional Identification Card (PIC) issued by the Board and the Commission pursuant to R.A. No. 10690 and this IRR; f) Forest Products Processing Plant refers to any mechanical set-up, device, machine or combination of machines used for the conversion of logs and other forest raw materials into lumber, veneer, plywood, fiber board, block board, paper board, pulp, paper, or other finished wood and other forest products , excluding the construction of buildings and other architectural and ‘structural components; Reconnaissance and Survey refers to the preliminary and actual examination of the forest area where the best road layout shall be located, taking into account the contour, topography and the shortest load direction with good grade, alignment and other environmental concerns; h) Registration Fee refers to the amount paid by a registrant at the time of initial registration in order to be issued a Certificate of Registration (COR) and Professional Identification Card (PIC); i) Renewal Fee refers to the amount paid by a registered and licensed professional corresponding to the three (3) year validity period of the Professional Identification Card (PIC); )) Certificate of Registration (COR) refers to the document issued by the Commission signifying that the person named therein has complied with all the legal and procedural requirements for such issuance and is, as such, entitled to practice the Forestry profession. The COR represents the authorit of the holder thereof to practice the profession, with all privileges and benefits concomitant thereto; IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 1060, (OTHERWISE KNOWN AS AN ACT REGULATING THE PRACTICE OF FORESTRY TN THE PHILIPPINES, AND APPROPRIATING FUNDS THEREFOR. REPEALING FOR THE PURPOSE REPUBLIC ACT NUMBERED SIX THOUSAND |FWO HUNSRED THIFTY NINE (fA NO £220), KNOWN AS THE FORESTRY PROFESSION LAW” k) Professional Identification Card (PIC) refers to the document bearing the registration number, its dates of issuance and expiry, duly signed by the Commission Chairperson, that is issued to a professional Forester upon payment of the prescribed fee for three (3) years; |) Temporary/Special Permit refers to the provisional authority granted to a foreign Forester to practice in the Philippines under the conditions set forth by R. A. No. 10690 and other applicable laws, rules and regulations. It shall be valid only for the period therein set forth and shall only serve as the foreign Forester's limited authority to practice in the country; m) Continuing Professional Development (CPD) refers to the inculeation of advanced knowledge, skills and ethical values in a post-licensure specialized or in inter- or multi-disciplinary field of study for assimilation into professional practice, self-directed research and/or lifelong learning; n) CPD Providers refers to any natural or juridical entity duly accredited by the CPD Council for Foresters for the purpose of offering or providing CPD programs for the Forestry profession; \ 0) Practicing Professional Forester refers to a professional Forester who is engaged in the practice of Forestry as defined under R. A. No. 10690, including those holding positions in the government or private firms, oS companies, schools or corporations whose duties require knowledge and “ application of the art and science of Forestry: p) Accredited Integrated Professional Organization (AIPO) refers to the organization integrating all associations, federations and groups of professional Foresters that is accredited by the Board and the Commission: Q) Foreign Reciprocity refers to Section 7 ()) of R. A. No. 8981 and Section 14 (a), Article Ill and Section 27, Article IV of R. A. No. 10690; 1) Table of Specifications (TOS) refers to the list of outcomes-based competencies which the licensure examination measures and assesses; s) CHED refers to the Commission on Higher Education; 1) Bl refers to the Bureau of Immigration; and f u) SEC refers to the Securities and Exchange Commission. Section 5. Practice of Forestry. - The practice of Forestry is a professional and organized act of applying the principies on the art, science, practice and business of sustainable management of forest and forestland resources for the production of goods and services and the enhancement of benefits and values of such resources for the needs of the present and future generations. The practice of Forestry shall embrace, but not be limited to the following activities:
