NOTICE INVITING TENDER (NIT)

Indian Oil Corporation Ltd, Bongaigaon Refinery (IOCL-BGR) invites electronic bids through its website
https://iocletenders.nic.in under two bid system, (Part-I : Techno-Commercial Part & Part-II : Price Part) for the subject
work, from experienced Contractors fulfilling the qualifying requirements stated hereunder:

6. Bid Qualification Criteria 6.1 Financial Criteria:
The annual financial turnover of the Bidder during any of the preceding three
financial years shall be at least Rs. 68.67 lacs.
6.2 Experience Criteria
6.2.1 Bidder should have experience in successful completion of similar job as under
during any of the last five years ending on the last day of the month immediately
previous to the month in which last date of bid submission falls of value as
mentioned below:
a) Three similar completed works each costing not less than the amount equal
to Rs. 34.34 lacs OR
b)
Two similar completed works each costing not less than the amount equal to
Rs. 45.78 lacs OR
c) One similar completed work costing not less than the amount equal to Rs.
57.22 lacs.
The similar nature of work is: “PURCHASE OF RENEWABLE ENERGY
CERTIFICATE FROM POWER EXCHANGES IN INDIA”.
6.3 In addition to above specific qualification criteria have been listed below:
a. The Bidder should have a valid trading license from Central Electricity
Regulatory Commission (CERC).
b. The Bidder should provide documentary evidence showing previous
experience of similar type of work of trader RECs from power exchanges.
c. The Bidder should have a valid Membership Certificate applicable upto April
2021 of IEX (Indian Energy Exchange) & Power Exchange of India Limited
(PXIL) showing the authority to purchase REC directly from exchange.
NOTE:
(a) Documentary evidence in the form of copy of Order/Agreement and completion
certificate containing executed value from the client should be submitted along
with the name of the company, address, contact person with Telephone, Fax, e-
mail address in support of experience criteria under Sl. No. 6.2.1. In case
executed value is not mentioned in the completion certificate, copy of certified bill
or record of payment shall also be acceptable for determining the executed value
provided completion certificate is also submitted. Work completion date shall be
considered for deciding the period of work experience. Bids without proper
evidence are liable to be rejected.
(b) With regard to sub-contracted work order, the bidder has to submit a Certificate
from the end user / Owner / Consultant of the Owner stating that the main
contractor has intimated them about the engagement of sub-contracting OR have
been allowed / permitted as a sub-contractor.
(c) The completion certificate, submitted by the bidder shall separately indicate the
GST/service tax amount included in the value of completed job OR a separate

certificate from the respective client, mentioning the GST/service tax amount if
any, included in the value of completed job under consideration should be
submitted by the bidder. Amounts mentioned under clause 6.2.1 above are
excluding GST/service tax.
(d) In case GST/service tax amount/component is not specified in the submitted
completion certificate, then the amount equivalent to rate of applicable
GST/service tax for the subject tender shall be deducted from the value of
completed job mentioned in the completion certificate to arrive at the value of the
completed job without GST/service tax.
(e) Financial turnover shall be as per Balance Sheet including Profit & Loss Account
of the bidder audited by a Chartered Accountant.
(f) For Annual Rate Contracts (ARC) of repetitive nature, similar ARC job that has
been successfully completed by bidder for the originally awarded period of such
ARC shall be considered as completed works even though such ARC is under
execution on account of extension. However, the original contract must have been
completed within the cut-off date of completion as mentioned under clause 6.2.1
above and documentary evidence thereon shall be provided by the bidder.

(EMD) Mode of payment of Earnest Money:
Earnest Money shall be paid only through online mode like
Netbanking/NEFT/RTGS/Bank Guarantee (BG) as per the details mentioned in
Special Instructions to bidders for E-tendering. No offline instruments like
Demand Draft/Pay Order/Banker’s cheque etc. towards EMD shall be accepted.

In case value of EMD is not less than ₹ 1.00 lakh, Bidder has the option to submit
EMD through BG from a scheduled bank (as per the format prescribed in the General
Conditions of Contract. The BG shall be valid upto last date of bid validity as per NIT
plus 3 months. Original BG shall be sent to Tender Issuing Authority and the same
should reach him within 7 working days from the date of opening of technical bids.
Only those physical BG instruments found matching with the copy submitted in the E-
portal shall be considered as valid.
Note:
Tenders without Earnest Money are liable to be rejected. However EMD shall be
exempted for Central/State PSU, JV of IOCL and Micro & Small Enterprises (MSEs)
registered with Agencies/Bodies as per Public Procurement Policy for MSEs Order
2012 issued by Ministry of MSME, Govt. of India.

14 Others
a) Physical Bids will not be accepted. Tender Documents can be downloaded from the website
https://iocletenders.nic.in and online bids are required to be submitted with Digital signatures on the system. All
help files are available at https://iocletenders.nic.in website.
b) Bidders are required to go through the NIT and tender document carefully and submit the required documents
in favour of their credentials and other requirements along with their offer as per instruction given in the Tender.
c) Bids from Consortium shall not be accepted.
d) The bidders must ensure that their offers are submitted electronically in time.
e) Consultants or their subsidiary company or companies under the management of consultant, are not eligible to
quote for the execution of the same job for which they are working as consultant.
f) Conditional offers are liable for rejection. Offer shall be evaluated with respect to bid qualification criteria to
determine the techno-commercially qualified bidders. Offers of unqualified bidders is liable for rejection.
g) IOCL-BGR reserves the right to accept/reject any or all bids or to split the work amongst various contractors or
to award only part of the work or annul the total bid process without assigning any reason whatsoever. No
compensation is paid for the efforts made by the contractor in case tendering process is abandoned by IOCL-
BGR.
h) Prevailing Government guidelines regarding Purchase Preference shall be applicable.
i) The bidder shall bear all costs associated with their bid including costs and expenses relating to the visits to the
site etc. and IOCL-BGR will in no case be liable for these costs regardless of the outcome of the bidding
process.
j) IOCL (BGR) at its discretion may extend the deadline for submission of the bids.
k) Any dispute relating to this NIT is subject to jurisdiction at Bongaigaon, Assam.
l) Any addendum/corrigendum/sale date extension in respect of above tender shall be issued on our
website ‘https://iocletenders.nic.in’ only and no separate notification shall be issued in the press.

1.0 GENERAL
1.1 This Special Instructions to Bidders (SITB) shall be read in addition to the Instructions to
Bidders (ITB) appearing in page No. 89 to 139 of General Conditions of Contract.

1.3 Pre bid meeting shall be held on the date and time as mentioned in the Notice Inviting
Tender or its corrigendum to resolve bidders’ queries, if any. Bidder shall forward the
consolidated pre-bid query (if any) to IOCL by E-mail as per the format attached in the
bidding document at least 5 days prior to the scheduled date of pre-bid meeting.
1.4 In case foreign contractors intents to participate, tenders can be submitted either by the
contractor directly or by their Indian Agent on behalf of them, but not both. The Indian Agent
should represent only one contractor and he shall not quote on behalf of another contractor
for subsequent or parallel tender for the same job.
1.5 Consultant appointed for the project / job is not allowed to participate in the tender either
directly or indirectly. An indirect participation shall include participation through an affiliate or
as a sub-contractor, consultant or supplier. The expression ‘affiliate’ for the purpose of this
clause will include any person, or company or association (howsoever designated)
who/which is a member of the consultant (if the consultant is a joint venture or consortium or
who or which directly or indirectly holds 10% (ten percent) or more of the capital or voting
capital of consultant (if the consultant or any of its members is a company or a body
corporate) or who or which is a consultant or sub-contractor of the consultant with regard to
the project.
1.6 The Bid, all correspondence and documents relating to the bid, between Bidder and IOCL
(BGR), shall be written in English language only. Any printed Literature furnished by Bidder
may be written in other language provided that this Literature is accompanied by an
authenticated English translation in which case, for purpose of interpretation of the Bid, the
English translation shall govern. Bid submitted in any language other than English as not
accompanied by an appropriate English translation will be rejected, without assigning any
reason thereof.
1.7 After downloading of the Bidding Document from tender portal and at least 2 days prior to
the deadline for submission of bid, Bidder shall acknowledge receipt and confirm his
intention to bid for the subject Work in the prescribed format by mail and also state his
intention to participate in the pre-bid discussion, if scheduled as per NIT.
1.8 Once quoted, the bidder shall not make any subsequent change in price or other changes,
whether resulting or arising out of any technical/ commercial clarifications and details sought
on any deviations, exceptions or stipulations mentioned in the bid unless any amendment to
Bidding Document is issued by Owner. Similarly, no revision in quoted price may be allowed
should the deviations stipulated by him are not accepted by Owner and are required to be
withdrawn by him in favour of stipulation of the Bidding Document. Any unsolicited proposed
price change is likely to render the bid liable for rejection.
1.9 Bidders shall quote the prices in Indian Rupees only unless otherwise specified in the
tender.
1.10 Cutting and corrections in the bid document should be avoided and if it is unavoidable, it
should be kept at the bare minimum and it should be neatly cut and re-written without over-

writing and use of white fluid. All corrections should be duly signed by the tenderer. In case
the tenderers resorting to many corrections including usage of white fluid in the tender
document, the tender shall be liable for rejection.
1.11 Bidders should submit their quotation on their letterhead only or by way of return of original
tender formats duly filled. If the tender document is attached with any communication or
terms and condition, the same should be on party’s letterhead. Any tender submitted by the
tenderer in violation of above is liable to be rejected.
1.12 The following conditions are applicable for conventional tenders invited through
http://eprocure.gov.in/cppp
i) Tenderers are advised to download the documents from the website i.e.
http://eprocure.gov.in/cppp, after due registration. This is to ensure that the bidder
downloads proper/complete tender documents. This also enables the bidder to visit the
website for any corrigendum / correction which is essential for submitting proper tender.

2.0 Definitions
With respect to this document, the following definitions shall apply:
i) “Tender” or “Bid” shall mean Bidder’s offer to perform the Work, in accordance with
Bidding Document.
ii) “Tender Document” or “Bidding Document” shall mean the documents issued by
Owner through tender website including any subsequent addenda to enable bidder to
submit his Bid.
iii) “Bidder” or “Tenderer” shall mean the person or company who receives the Tender
Document and submits Tender or Bid to IOCL (BGR).
iv) The words “owner’, ‘purchaser’, IOCL, ‘IOCL (BGR)’, ‘Corporation’ have been used
interchangeably and would mean the same in expression and intent in proper context.
Also, the words ‘bidder’, ‘tenderer’, ‘contractor’, ‘vendor’ have been used
interchangeably and would mean the same in expression and intent in proper context.
v) The words “Schedule of Rates” or “Bill of Quantities” have been used interchangeably
and would mean the same in expression and intent in proper context.

3.0 Submission of the Bid


3.1 The Bid shall be submitted in two parts viz. PART-I (Techno-commercial/ Un-priced Bid) &
PART-II (Priced Bid).
3.1.1 PART-I of bid will contain the following documents:
3.1.1.1 Earnest Money Deposit (EMD) through online mode.
3.1.1.2 List of documents to be uploaded/submitted
i) Copies of work order and completion certificates of executed jobs and other supporting
documents in support of fulfilling the Bid Qualification Criteria.
ii) Audited Balance sheet, including profit & loss account of bidding entity for the
preceding 3 financial years.
iii) Income Tax Assessment order for the last 3 years. In case assessment for any
particular year has not been completed, copy of the Income Tax Return duly
acknowledged by Income Tax Dept may be submitted.
iv) Authority of the person submitting the bid with his Digital Signature Certificate, as per
clause 3.1.1.5 below.

vi) Copy of MSE certificate issued by designated authority/body if bidder is registered

3.1.1.5 Document on authority of the person submitting the bid shall be as given below

In case of Proprietary Concern  If the bid is submitted by the proprietor, no Power of


Attorney (POA) is required. However, he will upload
undertaking certifying that he is sole proprietor.
 If the bid is submitted by person other than
proprietor, POA authorising the person to submit bid
on behalf of the concern.

In case of Partnership Firm/LLP POA alongwith Deed of Partnership / LLP Agreement.

In case of Company  Certified copy of Board Resolution Authorising the


person submitting the bid on behalf of the company.
OR
 POA and the supporting Board Resolution
authorising the person submitting the bid on behalf
of the company.

In case of Co-operative Society Copy of Resolution passed as per Society Rules.

3.1.1.6 Bidder shall ensure that all the documents uploaded in E-tender portal are complete and
legible. Submission of incomplete or illegible documents may lead to rejection of bid.

3.1.2 PART-II (Priced Bid) of the bid shall consist of the duly filled in Excel file provided by IOCL-
BGR as a part of tender document for E-tenders. In case of other than E-tenders, the price
bid shall be submitted within a sealed envelope in physical hard copy. No stipulation,
deviation, terms & conditions, presumption, basis etc. shall be stipulated in Priced bid.
Owner shall not take cognisance of any such statement and may at their discretion, reject
such Bid.

4.0 Bid Validity


4.1 Bid shall remain valid for 4 (four) Months from the due date of opening of Bid. The Bidder
shall not be entitled during the said period to revoke or cancel his bid or to vary the bid
except and to the extent required by Owner in writing. In case the tenderer alter / modify /
withdraw his bid after deadline for submission of bid and within the validity period, the tender
submitted by the tenderer shall be liable to be rejected and EMD forfeited. In case of failure
of the party for more than one occasion, the tenderer may be put on holiday list for a period
of one year.
4.2 Owner may request the bidder for extension of the period of validity of bid. If the bidder is
asked to extend the validity the same should be without any deviation in the terms and
conditions including change in prices. If the bidder agrees to the extension request, the
validity of Bank Guarantee towards EMD/Bid Security shall also be suitably extended.
Bidder may refuse the request of extension of bid validity without forfeiting his EMD/Bid
Security. However, bidders agreeing to the request for extension of validity of bid shall not
be permitted to modify the bid because of extension, unless specifically invited to do so.

5.0 Bid opening and evaluation


5.1 Opening of Techno-Commercial Part of Bid

5.1.1 This part will be opened on the scheduled date and time as specified in Notice Inviting
Tender or any extension thereof. In case of e-tenders, bidder’s physical presence is not
required during bid opening.
5.1.2 In the event the specified date of physical bid submission/opening (other than for e-tenders)
happens to be a holiday or a non-working day for IOCL (BGR), the date of physical bid
submission/opening shall stand extended automatically upto the specified time of next
working day. However for e-tenders, there will not be any extension of online bid submission
date if there is local bandh/strike on the date of submission.
5.2 Techno-Commercial Evaluation of Bids
5.2.1 Bidders who are found to qualify based on the Qualification Criteria specified in the NIT shall
be considered for detailed Techno-Commercial evaluation. Decision of Owner in this regard
shall be final and binding.
5.2.2 IOCL (BGR) reserves the right to use in-house information for assessment of Bidder’s
capabilities keeping in view their performance in past job(s) with any client. Past
performance shall include safety related performance also.
5.2.3 Though Qualification Criteria mentioned above are the basic criteria for consideration of a
bid, fulfilment of the same shall not automatically mean qualification of the bidder for
opening of the price bid or for award of the job.
5.2.4 To assist in the examination, evaluation and comparison of bids, IOCL(BGR) may ask the
Bidders individually for clarification of their bids. The manner of such communication shall
be as decided by IOCL-BGR.
5.2.5 Notwithstanding any provision contained anywhere else in the bidding document regarding
submission of any document by the bidder, IOCL-BGR shall have the absolute discretion to
request any bidder for any additional/shortfall/outstanding documents for the purpose of bid
evaluation. Bidder shall submit all additional documents if asked for, in the manner advised.
However, in case of any shortfall in submitted documents related to Bid Qualification Criteria
mentioned in NIT, only one opportunity shall be given to the bidder during techno-
commercial evaluation stage for submission of complete and clear document. Bidder shall
submit reply to all queries from Owner within the time period as specified by Owner.
5.2.6 After opening of the technical bids but before the opening of the price bids, the bids may be
rejected for unsatisfactory performance or adverse comments which have come to the
notice after the issue of the tender enquiry.

5.3 Opening of Price Part of Bid


5.3.1 Priced bids of only those Bidders who are found to qualify based on the Qualification Criteria
specified in the NIT and whose bids are considered techno-commercially acceptable shall
be opened after giving intimation to qualified bidders. Price part of bids shall be opened in
presence of bidder for physical bid opening and without presence of bidder for opening of E-
bids. For E-bids, the intimation to qualified bidders shall be through system generated e-mail
alert.
5.3.2 Pre-price bid conference – In certain specific tenders and if decided by IOCL-BGR, there
will be a pre-price bid conference with technically acceptable bidders provided commercial
deviation exists in one or more of the bids. Other aspects of such pre-price bid conference
are
5.3.2.1 All the commercial aspects will be fully clarified to the technically acceptable bidders.
5.3.2.2 Based on discussions in the pre-price bid conference, deviations, if any, from tendered
terms and conditions shall be communicated in writing to all the bidders and they shall be

asked to submit their price implication (positive or negative) in sealed envelope when
substantial changes are made/or price implication on their earlier quoted rates in other
cases after taking into account the modified terms and conditions including deviations,
within stipulated period. It shall be clearly understood by the bidder that if they take any
further deviations, their offer shall be rejected outright. Price implication envelope received
after the stipulated date shall not be considered. Bidders unable to comply with OWNER’s
terms and conditions including proposed deviations will be allowed to withdraw.
5.3.2.3 If a bidder takes any further deviations other than those agreed, while submitting the revised
price bids/price implication, his price bid shall be rejected outright without any reference. In
case it is found after opening that any deviation is incorporated in the revised price bid,
vendor/ bidder is also liable to be placed on holiday for a period of one year for future
tenders in IOC.
5.3.2.4 Decisions will be taken strictly on the basis of revised price bids. Price negotiation if
considered necessary by OWNER, may be carried out with L-1 bidder.
5.4 Evaluation of Priced Bid
5.4.1 The price bids will be evaluated by OWNER to ascertain the relative position of the best-
evaluated Tender in the interest of OWNER.
5.4.2 The quoted price of bidder shall be subjected to loading on account of the followings:
a) Price Reduction clause - The difference between the quantum as per GCC and that
offered by the tenderer shall be added to the tendered amount.
b) Payment terms - In case bidders take deviations to the specified payment terms,
loading for interest implication at 1% higher than IOC's cash credit rate shall be done.
c) Specific Discount - This will be considered while preparing comparative statement.
d) Item wise quotation - In such cases where the party has not quoted for each and every
item and few items have been left over which are not more than 5% based on
estimated rate, the offer shall be evaluated by considering the highest rate quoted by
the other tenderers. If after taking the highest rate, party comes out to be the lowest,
then the lowest party can be called for price negotiations and asked to match the
unquoted items rates with the lowest offer. This clause is however, not applicable for
LSTK tenders.
e) In case of any benefit to IOC R&D for the usage of IOC R&D formulations by the
tenderer in the form of royalty, such royalty inflow net of prevailing taxes / surcharges,
shall be deducted from the quoted price as specified in the tender documents.
5.4.3 If any unconditional rebate has been offered, the same shall be considered in arriving at the
net quoted price. No cognisance shall be taken for any conditional rebate, for the purpose of
evaluation of offer.
5.4.4 Any uncalled lumpsum / percentage reduction by the Bidder after the due date shall not be
considered for evaluation. However, if reduction is from the Bidder who is otherwise
evaluated lowest, such reduction shall be taken into account for arriving at the contract
value (if awarded) and not for evaluation purpose.

6.0 Negotiation and award of contract


6.1 Negotiations will not be conducted with the bidders as a matter of routine. However,
Corporation reserves the right to conduct negotiations. Bidders to quote competitive prices
considering the fact that price negotiations, if required, will be held with the lowest tenderer
only, unless specified otherwise in the tender.

6.2 Within the period of bid validity granted by the Bidder, IOCL (BGR) will notify the successful
Bidder in writing by letter sent by registered post/courier/mail or hand delivered intimating
IOCL’s acceptance of the bid.
6.3 Owner shall not be obliged to furnish any information/ clarification/explanation to the
unsuccessful bidders as regards non-acceptance of their bids. Owner shall correspond only
with the successful bidder.
6.4 For contracts of value Rs. 10.00 lakh and above, the successful Bidder(s) shall have to
execute a formal Contract with IOCL (BGR) in accordance with the form of contract in the
format prescribed in G.C.C. forming part of the bid documents within 30 (thirty) days from
the date of receipt of the Letter of Acceptance of Bid from IOCL(BGR) on a non-judicial
stamp paper and of appropriate value. The cost of non-judicial stamp paper shall be borne
by the Bidder.
6.5 Until the formal contract is signed, the bid documents and Addendum (a) at any time and
any modification thereto and/or therefrom agreed upon by IOCL(BGR) read with the
Bidder’s final bid shall be considered as contract.
6.6 The Contract document shall consist of the following:
i) Agreement (Form of Contract), on non-judicial stamp paper by Owner and
Contractor.
ii) Letter of Acceptance.
iii) The Bidding Document along with the drawings, if any.
iv) General Conditions of Contract of Indian Oil Corporation Ltd
v) Amendments to Bidding Document or post award Amendment, if any.

SPECIAL CONDITIONS OF CONTRACT -I

1.0 GENERAL
1.1 The job site is located at Dhaligaon in Chirang District of Assam, India. It is about 5 K.M.
from Bongaigaon Town which is served by broad gauge rail network. The job site is also
connected by National Highway No.31-C. The approximate distance of the job site from
Kolkata and Delhi by rail is 825 and 1900 KMs respectively. The nearest civil aerodrome
is at Guwahati situated at 190 KMs from job site. An inland waterways port is available
at Jogighopa on the river Brahmaputra about 40 KMs away. This river port, however,
does not have facilities for handling heavy cargo.
1.2 It will be imperative for each Bidder to inform himself of relevant laws, conditions and
factors that may have any effect on the execution of works and supplies under the
contract. In their own interest, the Bidders are requested to familiarise themselves with
applicable Indian laws including Indian Income Tax Act, 1961, the guidelines issued by
Ministry of Petroleum & Natural Gas, The Environment Protection Act, 1986, Air
(Prevention and Control of Pollution) Act, 1981; Hazardous Wastes (Management,
Handling and Transboundary Movement) Rules, 2008; e-Waste (Management &
Handling) Rules, 2011; GST Laws and other related Acts, laws and Regulations, with
their latest amendments etc., as prevalent in India. IOCL(BGR) shall not entertain any
request for clarifications from the Bidders regarding such local conditions. It must be
understood and agreed that such factors shall be deemed to have properly been
investigated and considered while submitting the Bid. No claim for financial or any other
adjustments to the Contract Price on account of lack of clarity or proper understanding of
such factors shall be entertained.
1.3 These Special Conditions of Contract (SCC) shall be read in conjunction with the General
Conditions of Contract (GCC), Schedule of Rates, specifications of work, technical
specifications, drawings and any other document forming part of this Contract wherever the
context so requires.
1.4 Notwithstanding the sub-division of the document into these separate sections and volumes,
every part of each shall be deemed to be supplementary of every other part and shall be
read with and into the Contract so far as it may be practicable to do so.
1.5 The Bidding Document shall be read in conjunction with any amendment/addendum
issued subsequently. Any addendum thus issued shall become part of Bidding
Document. In case Addendum is issued during the bidding period, Bidder shall consider
its impact in his bid. In case Addendum is issued subsequent to receipt of bids, Bidder
shall follow the instructions issued along with Addendum with regard to submission of
impact on quoted price / revised price, if any.
1.6 If any provision in the GCC is repugnant to or at variance with any provision (s) of the
Special Conditions of Contract and the two cannot be reconciled or otherwise co-exist, the
particular clause of the GCC shall be deemed to be modified only to the extent to which
the particular special condition is expressly contradictory or repugnant to its import and
effect..
1.7 It will be the CONTRACTOR’s responsibility to bring to the notice of Engineer-in-Charge any
irreconcilable conflict in the Contract documents before starting the work (s) or making the
supply with reference to which the conflict exists.
1.8 Wherever it is stated in this Bidding Document that such and such a supply is to be effected
or such and such a work is to be carried out, it shall be understood that the same shall be
effected/carried out by the CONTRACTOR at his own cost, unless a different intention is

specifically and expressly stated herein or otherwise explicit from the context. Contract
value (also referred to as Contract Price) shall be deemed to have included such cost.
1.9 Whenever a party is put on a holiday list, the party is not considered for placement of
order anywhere in the Corporation during the period of holiday. During the holiday period
no enquiry shall be sent to the vendor.
1.10 In case the tender is accepted and the contractor fails to deposit the amount of initial
security deposit or to execute the contracts within the stipulated period, the earnest
money shall liable to be forfeited. In case of failure of the party for more than one
occasion, the tenderer may be put on holiday list for a period of one year.
1.11 Wherever the interest bearing advance is given to the contractor as per terms of the
contract, interest on advance shall be recovered by IOCL from running account bills.
Contractor, therefore, shall deposit the amount of TDS with the Income Tax Dept and
claim reimbursement from IOCL against submission of TDS certificate
1.12 Advance payment against approved drawings, if any, shall be made against bank
guarantee only.
1.13 In case where mobilisation advance has been agreed to in the contract, Corporation
reserves the right to recover mobilisation from the bill in full or by a higher percentage if
the progress of the work is not according to the terms and conditions of the agreement.
1.14 No suo-moto reduction in price by the Bidder will be permitted after the opening of
bids. If any Bidder unilaterally reduces the price(s) quoted by him in his bid after the
opening of bids, the bid(s) of the concerned Bidder shall be liable for rejection and
Earnest Money shall be liable to be forfeited.
2.0 Clarification Requests by Bidder
2.1 The details presented in this Bidding Document have been compiled with all reasonable
care. However, it is the Bidder’s responsibility to ensure that the information provided is
adequate, clearly understood and it includes all documents as per the Index.
2.2 Bidder shall examine the Bidding Document thoroughly in all respects and if any conflict,
discrepancy, error or omission is observed, Bidder may request clarification by using
Clarification window in the E-tender portal within the Seek Clarification end date & time.
2.3 Response to queries/ clarifications raised will be sent as expeditiously as possible
through the e-tender portal. The response shall not form part of Bidding Document
unless issued as an Amendment/Addendum.
2.4 Any failure by Bidder to comply with the aforesaid requirement shall not excuse the
Bidder, after subsequent award of Contract, from performing the Work in accordance
with the Contract.
3.0 Earnest Money Deposit/ Bid Security
3.1 Earnest Money Deposit shall be exempted for Central/State PSU, JV of IOCL and Micro
& Small Enterprises (MSEs) registered with Agencies/Bodies as per Public Procurement
Policy for MSEs Order 2012, issued by Ministry of MSME, Govt. of India. The certificate
issued by the said agencies/bodies shall be valid on the date of opening of the tender.
3.2 In case Owner cancels or withdraws the Invitation to Bid at its absolute discretion for
which no reason requires to be assigned, the earnest money submitted by Bidder will be
returned to him.
4.0 Bank Guarantees for Earnest Money / Security Deposit / Performance

4.1.1 Bank Guarantees upto ₹ 2.0 crores or less shall be accepted if it is issued by an Indian
branch of any scheduled bank appearing in the Second Schedule to the RBI Act, 1934.
4.1.2 Bank Guarantees above ₹ 2.0 crores shall be accepted if it is issued by an Indian branch

(i) Any Nationalized / PSU Bank appearing in the Second Schedule to the RBI Act,

4.1.3 Apart from above, BG, irrespective of its amount, issued by any other bank including but

guaranteed by any bank mentioned above at 4.1.2.

4.2 Credit rating


4.2.1 In case of submission of BG issued or confirmed/counter guaranteed by a bank
mentioned at para 4.1.2. (ii), the BG document shall include a condition that if the credit
rating of such bank falls below the Desired Credit rating during the validity period of the
Bank Guarantee, the vendor shall either submit a fresh Bank Guarantee or get the
existing Bank Guarantee confirmed/counter guaranteed, at its own cost, through a bank
mentioned above at 4.1.2 (having at least Desired Credit rating, if applicable).
4.3 Bank Guarantees shall be issued on stamp paper of adequate value as per law/rules on
stamp duty prevailing in the concerned state.
5.0 BENEFITS/PREFERENCE FOR MICRO & SMALL ENTERPRISES (MSES)
5.1 As per Public Procurement Policy for Micro & Small Enterprises (MSEs) Order, 2012
issued vide Gazette Notification dated 23.03.2012 by Ministry of Micro, Small and
Medium Enterprises of Govt. of India, MSEs must be registered with any of the following
in order to avail the benefits/preference available vide Public Procurement Policy MSEs
Order, 2012.
a. District Industries Centers (DIC)
b. Khadi and Village Industries Commission (KVIC)
c. Khadi and Village Industries Board
d. Coir Board

5.2 MSEs participating in the tender must submit the certificate of registration with any one
of the above agencies.
5.3 The registration certificate issued from any one of the above agencies must be valid as
on close date of the tender. The successful bidder should ensure that the same is valid
till the end of the contract period.
5.4 The MSEs who have applied for registration or renewal of registration with any of the
above agencies/bodies, but have not obtained the valid certificate as on close date of
the tender, are not eligible for exemption/preference.
5.5 The MSEs registered with above mentioned agencies/bodies are exempted from
payment of Earnest Money Deposit (EMD).
5.6 Price Preference – Subject to meeting terms and conditions stated in the tender
document including but not limiting to prequalification criteria, twenty percent of the total
quantity of the tender is earmarked for MSEs registered with above mentioned
agencies/bodies for the tendered item. Where the tendered quantity can be split, MSEs
quoting a price within a price band of L1 + 15 percent shall be allowed to supply up to 20
percent of total tendered quantity provided they match L1 price. In case the tendered
quantity cannot be split, MSE shall be allowed to supply total tendered quantity provided
their quoted price is within a price band of L1 + 15 percent and they match the L1 price.
In case of more than one such MSEs are in the price band of L1 + 15% and matches the
L1 price, the supply may be shared proportionately.
5.7 Out of the twenty percent target of annual procurement from micro and small enterprises
four percent shall be earmarked for procurement from micro and small enterprises
owned by Scheduled Caste & Scheduled Tribe entrepreneurs. In the event of failure of
such MSEs to participate in the tender process or meet the tender requirements and L1
price four percent sub-target so earmarked shall be met from other MSEs.
5.8 To qualify for entitlement as SC/ST owned MSE, the SC/ST certificate issued by District
Authority must be submitted by the bidder in addition to certificate of registration with any
one of the agencies mentioned in paragraph (I) above . The bidder shall be responsible
to furnish necessary documentary evidence for enabling IOCL to ascertain that the MSE
is owned by SC/ST. MSE owned by SC/ST is defined as:
a. In case of proprietary MSE, proprietor(s) shall be SC /ST
b. In case of partnership MSE, The SC/ST partners shall be holding at least 51% shares
in the enterprise.
c. In case of Private Limited Companies, at least 51% share shall be held by SC/ST
promoters.
5.9 It is clarified that the procurement policy mentioned under clause 5.0 hereinabove is
meant for procurement of only goods produced and services rendered by Micro & Small
Enterprises. Stockist / traders are excluded from the purview of public procurement
policy.
5.10 All MSME Bidders, who are registered with Udyog Aadhar Memorandum (UAM), are
required to submit UAM registration certificate and mention UAM Number in
‘PROPOSAL FORM-E’.

6.0 COMPLIANCE TO BIDDING DOCUMENT REQUIREMENT


6.1 Owner expects Bidder’s compliance to the requirements of Bidding Document without any
deviation. Any Bid containing exceptions / deviations to the following stipulations /
conditions shall be liable for rejection.

(c) Liability clauses
(d) Scope of Work
(e) Scope of Supply
(f) Security Deposit
(g) Bid Security/EMD
(h) Arbitration

6.2 Tender is also liable for rejection if the tenderer
a. Stipulates his own conditions
b. Does not disclose the full names and addresses of all his partners in the case of a
Partnership concern.
c. Does not fill in and sign the tender form as well as the schedule of rates,
annexures, specifications, etc.
d. Does not have his PF Code / Number from the Regional Provident Fund
Commissioner.
e. Does not have GST Registration / Number
f. Does not give proof of past performance
g. Does not submit Signed Integrity Pact Agreement. The IP Agreement shall be
completed in all respect and required to be uploaded in e-tender portal along with
the tender document. Partial submission of IP Agreement will not be considered.
h. If the tenders are partly quoted.
i. If the tenders contain unacceptable terms and conditions
j. In case of suo moto reduction in the prices offered by the tenderer
k. If the tender is not according to our format
6.3 Deviation on other conditions, if unavoidable, should be furnished as per Format for
Exceptions / Deviations included in the Bidding Document. Owner shall not take
cognisance of any deviation stipulated elsewhere in the bid. If no deviations are to
be stipulated, then the same should be confirmed in the format by mentioning “NO
DEVIATION” or “NIL”. In case however, Bidder stipulates deviations, and there are
sufficient bids without any deviation, Owner shall have the right to reject such bid at its
absolute discretion.
7.0 CONSTRUCTION WATER & POWR SUPPLY
7.1 Power and Water shall be provided to the CONTRACTOR, subject to availability, on

chargeable basis. BGR shall recover from the CONTRACTOR for Power & Water
consumed by the CONTRACTOR at the rate mentioned in the Special Conditions of
Contract-II.
7.2 BGR may supply power and water to the Contractor from the nearest available point of Work.
But the contractor has to make his own arrangement to draw power and water for his work at
his own cost.
7.3 BGR shall make effort to ensure power and water available to the contractor. If power &
water cannot be made available, the Contractor shall have to make his own arrangement of
power and water. In such case no compensation will be given to the contractor.
8.0 TERMS OF PAYMENT
8.1 Mobilization Advance
8.1.1 Not applicable
8.1.2 In case mobilisation advance is paid to the contractor, The Bank Guarantee for
Mobilisation Advance shall be for 110% of the total amount of Mobilization Advance.
Such advance shall be released in stages.
8.2 Progressive payment : As per General Conditions of Contract unless separately
mentioned in Special Conditions of Contract-II.
8.3 Payment shall be subject to deductions towards chargeable materials (if any) issued by
Owner, security deposit, charges for rents, income tax & others as applicable as per
terms of Contract.
8.4 All payments against the contract shall be released by e-payment mode only
(RTGS/NEFT/ Account to Account transfer). The bidder shall submit their Bank details
alongwith a copy of cancelled cheque to Owner.
9.0 TAXES AND DUTIES
9.1 Taxes, Duties, Octroi, Levies etc.
9.1.1 The quoted prices shall be deemed to be inclusive of all taxes, duties, Octroi, levies,
royalties etc. except GST and cess on it (if any) with respect to CONTRACTOR’s scope
of work/scope of supply till the completion of the Work. Quoted prices shall remain firm
till the completion of all works in all respect except on account of taxes/duties as
admissible under the General Conditions of Contract and any other variations
specifically mentioned in the special conditions of contract. The quoted price shall be
exclusive of SGST & CGST/ IGST.
9.2 Goods & Service Tax (GST)
9.2.1 Depending upon the nature of service of subject tender, category of services, service
accounting code (SAC) and applicable rate of GST (SGST+CGST OR IGST as the case
may be) is to be confirmed by bidder as per prescribed format given in the technical bid
in PROPOSAL FORM-O to the Special Instructions to Bidders (SITB).
9.2.2 Bidders are to necessarily indicate their Goods & Service Tax Identification Number
(GSTIN) along with their techno commercial bids unless and otherwise they are
exempted as per GST Laws & Rules. Offers without GSTIN shall be treated at par with
“Unregistered” Taxable Person as described in 9.2.4 below.
9.2.3 If the bidder deviates w.r.t. category of services, service code and GST rate as per the
format given by IOCL in the technical bid, then details with proper justification must be
provided.
9.2.4 In case a Bidder declares that he is not required to be registered under GST laws and

Rules, he shall be treated as “Unregistered Taxable Person”. In such case, Owner is


liable to pay GST under reverse charge and therefore for the purpose of evaluation, bid
shall be evaluated after considering GST Rates and Service Accounting Code(SAC) as
determined by the Owner.
9.2.5 In case Service is specified where Service Recipient is liable to pay GST under Reverse
Charge, same shall be clearly mentioned in the PROPOSAL FORM-O .
9.2.6 Bid evaluation shall be done after considering GST Rates and Service Accounting Code(
SAC) quoted or confirmed as per the format provided in the Technical Bid or and shall
be evaluated on gross tax basis i.e. after including amount of GST so quoted or
confirmed. Owner shall not be liable to pay or reimburse rate of GST actually invoiced
which is in excess of GST rate quoted or confirmed by the bidder.
9.2.7 In case a Bidder claim that he has opted for Composition Scheme as defined in Section
10 of CGST Act, 2017, he shall submit Form GST CMP 01 and GST CMP 02. His Bid
shall be evaluated without considering GST. [Please note that Composition Scheme
is available only for Restaurant and Outdoor Catering Services]
9.2.8 CGST & SGST (or UTGST) or IGST, as the case may be, shall be released only on
receipt of GST Invoice containing the following details :-
a) Name, address and GSTIN of the supplier;
b) Serial number of the invoice;
c) Date of issue;
d) Name, address and GSTIN or UIN, if registered of the recipient;
e) Name and address of the recipient and the address of the delivery, along with
the State and its code,
f) HSN code of goods or Accounting Code of services;
g) Description of goods or services;
h) Quantity in case of goods and unit or Unique Quantity Code thereof;
i) Total value of supply of goods or services or both;
j) Taxable value of supply of goods or services or both taking into discount or
abatement if any;
k) Rate of tax (Central Tax, State Tax, Integrated Tax (for inter-state supply), Union
Territory Tax or cess);
l) Amount of tax charged in respect of taxable goods or services (Central Tax,
State Tax, Integrated Tax (for inter-state supply), Union Territory Tax or cess);
m) Place of supply along with the name of State, in case of supply in the course of
inter-state trade or commerce;
n) Address of the delivery where the same is different from the place of supply and
o) Signature or digital signature of the supplier or his authorised representative.
9.2.9 It shall be obligatory for the Bidder to issue Credit Note for Price reduction on account of
delay in delivery as defined in the Bid or Contract Documents in the month immediately
following the month in which deduction of account of delay in delivery is effected by the
Owner.
9.2.10 In case of any advance including Mobilization Advance given as per Contract, the

CONTRACTOR shall issue a GST Invoice containing all the details required as per GST
Laws and Rules. Subsequent recoveries / adjustment of Advance amount shall be
separately indicated in the GST Invoice for actual supply of Goods and Services.
9.2.11 In case any recovery is made for any facility or services provided by the Owner and such
recoveries are subject to GST, amount of recovery plus applicable GST shall be
deducted/recovered from the Invoices/Claim of the Bidder.
9.2.12 It's the obligation on the part of Bidder / Vendor / Contractor / Consultant to discharge his
liability by payment of GST to Government of India in cash OR utilisation of Input Tax
credit in respect of such supply of services through GST Invoice under this Contract, so
that Owner will avail Input Tax credit on such supply. In the event that the input tax credit
of the GST charged by the Bidder / Vendor / Contractor / Consultant is denied by the tax
authorities to Owner due to reasons attributable to Bidder / Vendor / Contractor /
Consultant, Owner shall be entitled to recover such amount from the Bidder / Vendor /
Contractor / Consultant by way of adjustment from the next invoice or from Bank
Guarantee. In addition to the amount of GST, Owner shall also be entitled to recover
interest and penalty, in case same is imposed by the tax authorities on Owner.
9.2.13 If there is an increase in the rate of output tax (Goods and Service Tax) or any new
output tax is introduced in addition to the existing taxes or in lieu of existing taxes within
the contractual period or extension thereof due to reasons not attributable to contractor,
the Owner shall reimburse the same against documentary proof. However, if such
increase arises beyond the contractual completion period where delay is attributable to
the contractor, the Contractor shall bear the increase in the rates of existing taxes or any
new output tax.
9.2.14 All other provisions of The Goods and Services Act, 2017 shall be applicable for the
contract and contractor shall ensure compliance of the same.
9.3 Goods & Service Tax (GST) Registration
9.3.1 Bidder has to obtain GSTIN registration at the location where Works Contract Services
are to be performed or carried out. In case of other type of services, Bidder may decide
depending upon their business requirement and provisions of GST Laws. However, it is
advisable to obtain GSTIN in the State where job is required to be carried out/executed.
9.3.2 In case the bidder has applied for GST registration and not yet received GISIN, copy of
the Application Reference Number (ARN) is to be submitted along with the bid.
9.3.3 If bidder claims exemption from GST registration owing to turnover less than 20 Lakh,
valid documents to be submitted in proof of the same along with the bid and the offer will
be evaluated as mentioned in clause no 9.2.4 above.
9.3.4 GST registration no. of IOCL Bongaigaon Refinery of Assam is 18AAACI1681G1ZO
9.4 Notwithstanding the foregoing, OWNER shall not bear any liability in respect of:
a) Personal taxes on the personnel deployed by the CONTRACTOR, his SUB-
CONTRACTOR and Agent, etc.
b) The Corporate Taxes in respect of CONTRACTOR and his Sub-Contractor and
other Agents, Indian or foreign based.
c) Any other taxes / duties / levies
9.5 While obtaining tax exemption certificate under section 197 or 195(3) of Income Tax Act
from their assessing officer of Income Tax department, bidder should mention TAN of
Owner as “DELI09652G”.

10.0 SCHEDULE OF RATE:


10.1 The accepted rates shall remain firm for the entire contract period and no escalation on
any account shall be made except those specifically mentioned elsewhere in the tender.
10.2 The quoted rates shall include all cost of labour & materials, tools and tackles and all
safety appliances as required inside work area.
11.0 LABOUR MANAGEMENT
11.1 Compliance of Contract Labour Act / Rules etc.
11.1.1 In case of engagement of Contract labour at site, the Contractor shall comply with
prevailing labour Act/Rules/Statutes including payment of wages, contributions to PF,
ESI, payment of minimum bonus as per Payment of Bonus Act, etc., to his workmen. He
shall submit necessary documents to the Engineer-in-Charge in respect of the above.
11.2 Provision of ESI Act & PF Act:
a) Contractor shall adhere to all provisions of ESI Act and make contribution to ESIC in
respect of their workmen and submit all necessary documents to the Engineer-in-
Charge. It shall be mandatory for the successful bidder to submit the ESI registration
certificate (if applicable) within 15 days from the award of work, to EIC.
b) Contractor shall comply with various provisions of EPF & MP Act 1952 and the
schemes framed thereunder including extending the benefits of EDLI to the
uncovered employees engaged by the contractor. The contractor shall be required to
submit undertaking as per format prescribed in this SCC-1 regarding compliance of
all laws as applicable and submit all necessary documents to the Engineer-in-
Charge.
c) The Tenderer shall furnish independent P.F. Code applicable to them or their firm
while bidding for the tender.
11.3 Provision of facilities to be provided by the contractor to workers:
11.3.1 For all contractors under which 50 or more persons are working, the contractor shall
provide the following facilities to the workers and their quoted rates deem to cover these
facilities:
a) Arrangement for First Aid,
b) Arrangement for clean drinking water,
c) Toilet,
d) Canteen where tea and snacks are available,
e) A crèche where 10 or more women workers are having children below the age of 6
years.
11.3.2 Owner shall not pay extra amount for providing above facilities by the contractor.
11.4 Contract Labour gate passes:
11.4.1 The contractor, at his own cost, shall arrange for gate passes of contract labours
including their photo-graphs. Owner shall not pay any amount to the contractor on this
account.
11.4.2 Return of Contract Labour Passes on completion of contract work.
Immediately after completion of a particular contract, the contractor shall return the gate
passes of contract labours to CISF without fail through the concerned Engineer-in-
Charge. Tenderer is to note that his /their final bill shall not be processed for payment
until a certificate to this effect is issued by Engineer-in-charge / HOD.

11.4.3 The Contractor shall verify the C&A of the Contract labours before engaging them in
plant and shall be responsible for such pre-employment verification of his labours.
11.5 Payment of wages and other facilities to Contract Labours
The contractor shall have to pay wages and other benefits/ facilities admissible to the
contract labour, if engaged by contractor as per notified rates. Present BGR notified
rates for Dhaligaon are as under

b) Annual increase in the daily wages will be @ Rs. 16.00, Rs.17.00, Rs.18.00 and
Rs.20.00 for Un-skilled Labour, Semi-skilled Labour, Skilled Labour and Highly
Skilled Labour respectively. The annual increase for different categories of contract
labour will be on 1st January of subsequent year on the Daily Wage rate prevailing
on 1st January of the previous year (i.e in 01.01.2019 the annual increase will be on
the prevailing wage of 01.01.2018 and so on).
c) In case, the applicable daily minimum wages notified by the Central Govt. from time
to time exceeds the prevailing daily wages as notified by BGR ( after adding the
Annual increase as mentioned above ), then the notified daily minimum wages of
the Central Government shall be applicable.
d) Categorising the labour under Unskilled, Semiskilled, Skilled and Highly Skilled
category will be based on the guidelines for categorisation notified by the Central
Government. Besides, Vehicle Driver, Chamber Operator/Chamber Rigger, IBR
Welder, ITI trained Electrician/ Fitter, Cook, and Catering Supervisor will also be
considered in Highly Skilled Category.
e) The contract labours will be paid Statutory Allowance @ 13.13% of daily wage rates
(i.e. 8.33% towards Bonus and 4.8% towards Gratuity/ Retrenchment.)
f) The contract labours will be paid Non-statutory Allowance @ 24% of daily wage
rates [to cover the other benefits such as HRA (10%), LTC (3%), Canteen
allowances (4%), uniform allowance(3%), cycle allowance (1%), washing
allowance(1%) and education allowance (2%)].
g) The contract labours working in rotating shift (wherever required as per terms of
contract) will be paid Shift Allowance @ Rs.18/- per day for A & B Shift and @
Rs.22/- per day for C shift..
h) Earned Leave with wages will be regulated as per Factories Act. However, the
contract labour shall be entitled for the earned leave from the date of joining of the
contract.

i) The Contract labours will be entitled to 6 days sick leave in a year. The unutilised
Sick Leave can be carried forward to the succeeding year only within the period of
the particular contract. There will be no encashment for sick leave.
j) The contract labours will be entitled to 1 day paid casual leave for every completed
Calendar month (maximum 12 days in a calendar year.). The unavailed Casual
Leave shall not be carried forward to the succeeding year. There will be no
encashment for casual leave.
k) The contract labours will continue to be covered under EPF & ESI Acts and
deduction of contribution will be made accordingly by the Contractor and deposited
to the concerned authorities under the Acts along with employer’s share of
contribution. The contribution towards EPF & ESI will be as per applicable provisions
of the respective acts. EPF contributions will be on Basic Wage, but ESI
contributions will be on basic wage plus statutory & non-statutory allowances.
l) In case, a contract labour works for more than eight hours in a day (lunch and recess
period excluded), he will be entitled to overtime as per the provisions of the Factories
Act and Minimum Wages Act 1948.
m) After every six days of continuous work, one paid weekly off will be allowed.
n) Contract labours working half day (4 hours or less) in a day will be paid 50% of the
wages.
o) No contract labour below 18 years of age and above 58 years will be allowed to
work.
p) All records and registers required under statutory provision will be maintained by the
contractors. Provisions of the Factories Act, EPF & MP Act, ESI Act, CL(R&A) Act,
Minimum Wages Act and other applicable labour law will be duly complied by the
contractors.
q) Contractors and contract labours will abide by safety norms and wear safety
gadgets/PPE as prescribed by Bongaigaon Refinery Authority. Contractors and
contract labours will abide by Security restrictions and Biometric Attendance logging
system or any other system as may be implemented in the Bongaigaon Refinery
from time to time. Violation of Safety norms may attract penalty.
r) Contractors will issue wage slip to all contract labours in advance of the date of
payment of wage to the contract workers. Contract labour will open individual bank
account in any of the schedule banks and their payment of wages and other dues
will be made to the respective bank accounts. The payment to individual bank
account shall be done through ECS mode.
s) Working hours of contract labour will be 8 hours a day excluding lunch break period
(12 noon to 12.45 PM). General Shift timing of the labour will be from 8.00 AM to
12.00 Noon and 12.45 PM to 04.45 PM. However, this timing can be adjusted
depending upon work requirement. No contract labour will leave contractor’s work
site during working hours without the authorisation of contractor/authorised
representative.
t) Entry and exit gate will normally remain closed from 08.15 AM to 12.00 Noon and
01.00 PM to 04.45 PM. No contract labour will be allowed to move through entry/exit
gate during the above timing without authorisation by the Contractor/authorised
representative.
u) Contract labours will deposit/ surrender the gate pass issued to them on completion
of job or on separation. Failure to do so by a Contract Labour without adequate

reason/ justification will make him ineligible for any job under a contract in
Bongaigaon Refinery.
v) Contract labours will be fully responsible for the loss or damage of Biometric Card
issued to them and will deposit/ surrender the Biometric Card to the contractor on
completion of the job. On failure to deposit/surrender the Biometric Card on
completion of job/ separation, the cost of the card will be recovered from his/her
dues.
w) Contract labours will not enter the plant or work site on days when no contract job is
available or required at work site.
11.5.1 Contractors shall not engage any labour without obtaining medical fitness certificates as
prescribed.
11.6 Escalation for Labour wage:-

11.6.1 The rates stated in the Schedule of Rates shall not be subject to variation on any
account whatsoever, other than new taxes, duties, levies, charges and variation in
minimum wages.
a) Increase in minimum Wages means : Any increase in minimum wages of workers and
corresponding increase in statutory components of wages due to coming into force by
any fresh law or notification issued by State/Central Government or wage increase
arising out of a Court Order or directions of the Corporation to pay higher wages.
b) Any increase in minimum wages after stipulated date of price bid submission shall be
payable from the effective date mentioned in the notification as defined in (a) above up
to contractual completion period including justifiable extensions, if any. Any increase in
minimum wages beyond justifiable extension period is to be borne by the contractor. The
amount becoming due after contractual completion will be reimbursed only after
approval of time extension; however, contractor has to ensure that payment to workers
is made as soon as it becomes due as per labour payment schedule.
c) There shall be no service charge/profit component payable to the contractor on account
of differential amount reimbursed to the Contractor towards increase in minimum wages.
d) The additional impact of taxes to be paid by the contractor to the authorities on account
of increase in minimum wages will be reimbursed by IOCL.
e) Reimbursement of differential amount on account of increase in minimum wages shall
be made in the following manner :-
11.6.2 For contracts in which number of manpower to be deployed has been specified,
the differential amount on account of increase in wages for the actual number of labours
deployed as per direction of E-I-C shall be reimbursed to the contractor as per wage
register certified by E-I-C upon submission of proof of payment of revised wages and
statutory components.
11.6.3 For contracts in which number of manpower to be deployed has NOT been
specified, if the increase in the minimum wages is beyond 10% at a time(singular
increase more than 10%), the differential amount exceeding 10% will be reimbursed
based on calculations given at (a) and (b) below and the lower of the two values will be
considered for reimbursement :
a) Differential amount arrived using price variation formula given below.

percentage variation in each category for Unskilled, Semi-Skilled, and Skilled).

Value of Escalation = (Z/1.15) * (A /100) * [(Y-10)/100]
OR
b) The differential amount (Increase in Wages & Statutory Components) calculated based
on certified Wage Register.

11.6.4 Mixed type of contracts, having both type of items i.e. composite as well as
specified manpower, will be dealt in accordance with the relevant clauses as
mentioned above.
11.7 OTHER CONDITIONS:-

11.7.1 No contractors can engage contract labours without obtaining the labour licence from
ALC (C) for engaging 20 or more labourers. Before commencement of the work, the
contractor shall apply to the Licensing Authority and submit a copy of the license to the
Engineer-in–Charge.
12.0 MOBILIZATION
12.1 All expenses towards mobilisation at site and demobilisation including bringing in
equipment, work force, materials, dismantling the equipment, clearing the site etc. shall
be deemed to be included in the prices quoted in SOR items and no separate payments
on account of such expenses shall be entertained unless otherwise specifically
mentioned in SOR / Contract document.

13.0 INCOME TAX


13.1 Income tax at the prevailing rate shall be deducted from the CONTRACTOR’s bills as
per Income Tax Act. OWNER shall issue necessary TDS Certificate to the
CONTRACTOR.

14.0 PRE-JOB MEETING


14.1 Prior to the starting work, the contractor should attend the Pre-job meeting/Kick Off
Meeting with Engineer-in-charge to review company’s loss control system requirements
& the compatibility of their system so as to formulate action plan to enable them to meet
all the loss control system requirements.

15.0 COORDINATION WITH OTHER AGENCIES:


15.1 The work shall be carried out in such a manner that the work of other agencies operating
at site is not hampered due to any action of the contractor. The contractor will be
responsible for ensuring proper coordination with other agencies. In the event of any
dispute between the contractor and any other agency employed at or about the job site
arising out of or related to the performance of the work, the decision of the Engineer-In-
Charge shall be the final and binding on the contractor.

16.0 DAMAGE TO PROPERTIES:


16.1 The contractor shall be fully responsible for making good or making necessary payment

for any loss or damage caused by any structures , properties etc. belonging to the owner
if such loss of damage is due to the fault and / or sub contractor’s to the entire
satisfaction of the owner whose assessment shall be final and bring on the contractor.

16.2 The contractor shall indemnify and make the owner harmless of all claims or damage to
the property other than owner’s property arising under or by reason of disagreement if
such claims results from the fault and /or negligence of wilful act or omissions of the
contractor or his employees , agents, representatives or sub contractors.

17.0 HAZARDS & POTENTIAL HAZARDS


17.1 The contractors should obtain appropriate information from the Engineer-in-Charge
about known hazards & applicable emergency plans prior to starting work.

17.2 Potential hazards shall be communicated to contractor personnel about changes in


process/procedures during execution.

18.0 RECORD OF PERFORMANCE OF VENDOR/CONTRACTOR


18.1 Non-performing vendors/contractors may be put on a suspension list for a period of 6
(six) months applicable for the specific Unit. Treatment of vendor during suspension
period shall be same as Holiday Listing except for the tenders where price bids had
already been opened prior to placement of the vendor/contractor under suspension.

18.2 In addition to putting the non-performing contractor/vendor under suspension, Holiday


Listing process shall also continue for such vendor as per policy of Owner.

19.0 HEALTH, SAFETY AND ENVIRONMENT (HSE) MANAGEMENT/SAFETY NORMS


19.1 The CONTRACTOR shall adhere to the Health, Safety and Environment (HSE)
Management system as per the stipulations made in the following documents:

a) OISD Guidelines 207 (April 2016 Edition) and 192 (April 2016 Edition).
b) The General Conditions of Contract.
c) The Bidding Document
d) Any statutory provisions related to HSE/Quality Norms.
In case there is any contradiction on any provision within these documents, the most
stringent requirement shall be applicable.
19.2 Contractor Control Policy :

Contractor and his./their staff working at the facility operated by IOCL shall abide by the
following safety rules. Failure to comply with any of these rules will result in the removal
of that person from the site and may jeopardize the contract. The company requires
contractors working at the facility, to meet all relevant contractual and statutory
obligations in contractor with the health and safety in particular the Indian Safety Act (as
amended) and all regulations under that Act. Contractors (which term shall include the
contractor’s sub-contractors, if any, shall hereinafter be referred to, as the contractor,
shall comply with the following :

(a) Training: The contractor along with his staff will have to undergo the mandatory safety
training and only after obtaining a certificate from Fire & Safety Department of
Bongaigaon Refinery for having undergone the training successfully, the contractor will
be allowed to execute the job by Engineer-in-Charge. The contractors are responsible

for training their labourers (even temporary ones) and make them aware of the hazards
and the measures required to be taken before are allowed to work at site.

(b) Safety Performance : The contractor will have to obtain Safety Performance Certificate
for the job he has executed against an order.
(c) Insurance to be obtained for all the workmen under Workmen’s Compensation Act, 1923
(d) Gate Pass to be obtained for all the labourers and supervisors.
(e) Permits/Clearances to be obtained for carrying certain classified works inside the

(k) Welfare Facilities like check and change rooms and other facilities are provided inside
the Refinery and consumption of foods shall be allowed in canteen or break rooms only.
(l) Environment and Waste Disposal System to be followed strictly.
(m) Equipment for Works should conform to all statutory safety regulations.
(n) Working outside normal working hours will only be done with the permission of
Engineer-in-Charge.
(o) Right to Search any vehicles, person or property, at any time IOCL feels necessary.
(p) Contractor’s Liability includes indemnifying any loss, damage or expense claim arising
from the contractor’s negligent acts or omissions or failure to comply with these
conditions.
(q) Right to stop work: If in the company’s opinion, an unsafe situation arises or if safety
regulations are broken.
(r) Vehicles Speed Limit inside Refinery is 25 KM per hour.
(s) Load handling at road site should not be done by blocking roads.
(t) Completion of job cannot be certified without clearing the work sites thoroughly.
(u) No person below the age of 18 years will be allowed to work inside the Refinery.
(v) General safety rules should be strictly adhered to while working inside the Refinery. This
list is not exhaustive. It will depend upon the nature of the work and the hazards
associated with the work.

19.3 WORKMEN COMPENSATION INSURANCE: The contractor shall obtain an insurance


policy in respect of all workmen engaged by him on the Corporation’s job indemnifying
his liability under the workmen’s Compensation act 1923 and its subsequent
amendments. The contractor shall be permitted to commence the work only after he has
obtained adequate insurance coverage under the said Act, by specifying exact nature of
work and shall produce to the company upon request evidence of such insurance.

19.4 Gate Pass: On arrival at Bongaigaon Refinery, the contract employees will be expected
to pass through the company’s security screening procedure. The contractor shall
arrange the gate pas for all the contract labours with the help of the Engineer-in-Charge
and the Security Officials of the Refinery. No person will be allowed to work without valid
gate pass. Before leaving site they will be required to once again pass through the
security screen. The contractor shall be responsible for:

(I) Notifying the company’s representative of the names of all sub-contractors,


(II) Issuing a copy of these ‘Safety Rules for Contractors’ to earn sub-contractor and
ensuring compliance.

(III) Contractors shall acquaint themselves of the site fire and emergency alarm
procedures and first aid arrangements before commencing work.
(IV) The contractor shall surrender to the Pass Issuing authority all the gate passes
issued for a particular job after completion of the job. And no payment will be made
to any contractor(s) who fail to comply with this.
19.5 WORK PERMITS :

Certain classes of work in the Refinery require permit to ensure that precautions listed
on the permit are taken and also that all people be kept fully informed of the details and
possible dangers of the job in hand. WORK WITHOUT WORK-PERMIT AND
CLEARANCE CERTIFICATE IS PROHIBITED. These jobs fall in four categories
followed with clearance certificate for each permit.
19.5.1 COLD WORK PERMIT :
Cold Work Permit is required for all the jobs where sparks or flames are not coming out
during work.
19.5.2 HOT WORK PERMIT :
Hot Work Permit is required for all jobs involving sparks or flames including the use of
internal Combustion engine driven machines. Hot Work Permit is required for all vehicles
to enter a tank farm or operating unit area. Hot work permit is also required for
radiography work.
Where any hot work is required to be carried out in any area of the site a “Hot Work”
Permit has to be obtained from the Engineer-in-Charge prior to the commencement of
such work.
Any accidental fire, no matter how small, must be reported immediately. Workmen must
not be allowed to enter any vessel, sump or drain without Hot Work Permit and
clearance certificates issued for the job stipulating the necessary precautions to be
taken for the safety of the workmen.. it is the responsibility of the contractor to ensure
that the validity of the certificate/clearance is updated before allowing any work to
proceed.
19.5.3 EXCAVATION/DYKE CUTTING :
All excavation jobs must be covered by an excavation permit, which must be signed by
the Electrical Department, Civil Deptt., Fire & Safety Deptt., the supervising Engineer-in-
Charge and the concerned area in charge where excavation is to be carried out. All
excavation jobs shall be started at site only after getting the required Excavation Permit
from concerned department(s) and shall be completed within the period stipulated. All
excavations must be roped off or a railing place around the opening, company’s safety
rules should be followed.

19.5.4 WORKING AT HEIGHT :


Any workmen required to work more than 2 (two) metres above the ground level must
have working at height permit and follow all the conditions of the permit. Always use
safety belt when working overhead.

(i) Persons working overhead should use safety belts.


(ii) Contractors are responsible for safe guarding their workmen or all overhead work
and to ensure that ladders and scaffoldings are of suitable construction and
properly erected.

(iii) Contractors must take precautions to safeguard persons on ground levels against
objects failing from the work above.
(iv) All work in connection with roofs and buildings must be covered by a safety
certificate and crawling board cat ladders must be used. In no case, any workmen
should be allowed to stand or crawl over any roof.

19.6 LADDERS :

(i) All ladders used must be of sound construction


(ii) Short ladders must not be spliced or tied to form a long one
(iii) A ladder must extend to five feet above the point of landing
(iv) All ladders of 20 feet or more length should be tied to the structure, on which they
are resting to prevent from slipping
(v) Ladders with missing or defective rings or with rings that repined for their support on
nails, spikes or similar fixing should not be used.
(vi) One person shall climb ladder at a time.
19.7 SCAFFOLDING :

(i) Scaffolding should not be overloaded and materials should not be taken on it unless
needed for work within a reasonable time.
(ii) Every scaffolding must be of sound construction and adequate strength for the
purpose for which it is made
(iii) Scaffold must be securely fastened every 25 ft (8 meters) to pipe racks, vessels,
furnace structure or some other rigid structure.
(iv) Scaffold grills must extend at least 6 inches and not more than 12 inches beyond the
end section support and must be securely fastened to the end sections.
19.8 Fire Prevention:

The Refinery operates a strict No Smoking Policy, within all areas of the premises.
Smoking is only permitted in designated areas. These areas are indicated. Contractor
and his Supervisor (s) must ensure and educate that smoking is not allowed in any part
of the Refinery area except in smoking booths specially constructed for this purposed.
Smoking outside specified area is forbidden.
19.8.1 All persons before entering the Refinery must deposit all matches, lighters or any other
spark producing devices in their possession with the duty security inspector at the main
gate itself. Carrying any means of ignition is strictly prohibited. Any contractor’s
employee who is/are found smoking or in possession of matches or lighter or any other
means of ignition in prohibited area will be turned out and will not be permitted to re-
enter the company’s premises and suitable action as decided by the Management of the
Refinery will be taken against the contractor.
19.8.2 Use of cell phone has been prohibited in the Refinery area.
19.8.3 No dry battery or accumulator type of electric hand lamp or torch, which are not of the
flame proof safety type, shall be taken into the Refinery.
19.8.4 In the event of a fire or accident involving equipment or personnel, inform the Fire
Station, which is located inside the Refinery without delay.
19.8.5 When any fire extinguisher is not in working condition, inform the Fire Station
immediately so that the same could be replaced.
19.8.6 Fire hydrant should not be opened without the permission of the Fire & Safety Division.

The contractor shall not tap any fire hydrant for obtaining water for his work/without
obtaining prior approval and clearance thereof from the Fire & Safety Deptt. of the
Refinery, which shall be obtained through the Engineer-in-Charge.
19.8.7 All chipping of masonry, concrete, hot jobs, etc. which may be required to be done shall
be carried out only after obtaining necessary hot work permits from the respective unit in
charge or other competent authority through the Engineer-in-Charge. All the precautions
prescribed by the unit in-charge will also have to be followed. Only non spark producing
tools, such as brass hammer and chisel shall be allowed to be used inside the battery
area.
19.8.8 Flammable materials are stored on site in designated areas. These areas are clearly
marked.
19.8.9 Contractor’s personnel shall not carry out any operations within these areas which
involve welding, cutting, grinding, burning or the use of electricity powered tools or naked
flames, unless with the Engineer-in-Charge’s approval when special arrangements shall
be made for such works to be carried out.
19.8.10 Flammable Liquids and Gases: Flammable liquids and gas cylinders may be brought to
the site if permission has been given and the containers, storage and use of such
materials comply with statutory requirements.
19.8.11 Gas cylinders and portable heaters of any kind are subject to approval by the Engineer-
in-Charge and must, wherever they are used, be secured in an upright position.
19.8.12 Connection to Existing Services: The contractor must not connect or couple up to any of
the services on site (electricity, gas, air, steam, water and drains) without prior
arrangements has been made.
19.8.13 In case of fire, firm alarm set in different locations to be excited and inform fire & safety
deptt. immediately.
19.9 Personal Protective Equipment :

19.9.1 The contractor has to ensure that all the contract labourers of any skill are provided with
all safety appliances from top to toe like safety helmet, safety goggles, safety belts,
safety shoes/gum-boots, protective cloths, etc. wherever required for complying with the
Safety Rules of Refinery by the Contractors. The quoted price/rates should include the
cost of providing all these safety equipment. The contractor shall be held fully
responsible for any violation of the above if noticed by IOCL/Statutory bodies at any time
during the execution of work and they shall be penalized as deemed fit. However, if
IOCL issues such PPEs to contractor(s) on returnable basis depending on stock
availability, all such equipments should be return to the issuing authority. No payment
will be made to any contractor without returning such returnable materials issued to him.
19.9.2 ‘Guideline on use of PPE’ and ‘PPE Matrix’ is enclosed with this tender document as a
separate document. The same shall be followed meticulously during work execution.
19.10 Working in confined Places.

The contractor’s personnel must not enter any confined spaces on the site including
process vessels, tanks, ducts, etc. unless they are fully trained and qualified to carry out
confined space entry and are following strict confined space entry procedures. Confined
space entry can only be authorized by Engineer-in-Charge.

19.11 Welfare Facilities :

The consumption of any form of food, sweets or drinks within the working areas is strictly
forbidden. Food may only be consumed in the canteen or break rooms located inside the
Refinery. The contractor should ensure to keep these facilities in a clean condition.
Overalls and dirty working clothes are not allowed in the break rooms.
19.12 The Environment and Waste Disposal :

Contractors must conform to the requirements of the environment protection legislation


and any subsequent amendments thereto. In particular, discharge into the drains or
other waste disposal arrangements are not allowed without the permission of site
manager. All precautions must be taken by the contractor against any sort of
environmental pollution. All waste generated during contract must be taken away by the
contractor.
19.13 Energy Management :

IOCL has an effective Energy Management Policy and is committed to productive,


environment friendly and efficient use of energy throughout its installations and facilities.
The contractor shall make all their workmen aware of proper handling of their energy
consuming equipment and use energy efficient tools/tackles during execution of the
contract.
19.14 Noise :

The contractor shall take all precautions necessary to protect against the generation of
excessive noise in carrying out the work and shall advise the site manager of any
exceptions that may require special action.
19.15 First Aid: The contractor’s attention is drawn to the Factories Act reporting of accident,
injuries, diseases and dangerous occurrence requirements with which the contractor
must comply. All accidents/incidents must be reported to the Engineer-in-Charge.

19.15.1 Medical facility is available throughout day and night at the Bongaigaon Refinery
Hospital.
19.15.2 All injuries should be treated with a minimum of delay.
19.15.3 Any job involving dangerous chemicals, where the use of protective clothing for the
protection of the workmen is essential, must be covered by a safety certificate. All
protective clothing will be supplied by the Refinery. It is the responsibility of the
contractor to ensure that his workmen wear these protective clothing wherever required.
19.16 Equipment For Works :

19.16.1 The contractor shall not use any hand tools, ladders or other equipments owned by the
company, unless the Engineer-in-Charge has given permission in writing. Any testing or
repair of such equipment arising from such use shall be at the cost of the contractor.
19.16.2 The contractor shall not use on the premises cartridge operated tools without the
Engineer-in-Charge’s permission. Such tools must not be left unattended and must be
removed from the premises when not in use.
19.16.3 The contractor must hold a current test certificate or other appropriate documentation in
respect of all equipment and plant that is subject to statutory test or inspection and must
produce such documents to the site manager if required to do so.

19.16.4 All work equipment used on site must be safe to use and must not bring any additional
hazard on to the site. The company electrical personnel must check the contractor’s
electrical equipment before it issued on the site.
19.17 Working outside normal hours: The Contractor must take suitable arrangements with
the site contract co-ordinator to ensure the security of the premises at all times. If
weekend or outside normal hours working is required, the contractor must advise the
Engineer-in-Charge and give the names of all contract personnel involved in such work
and must ensure that adequate health and safety cover is provided.

19.18 Right to Search: The company reserves the right to search any vehicles, person or
property, on a random basis, whilst entering on or leaving the company premises
including the contractor’s personnel, vehicles or property.

19.19 Contractor’s Liability:

The company shall hold the contractor for any loss, damage or expense claim arising
from the contractor’s negligent acts or omissions or failure to comply with these
conditions.
19.20 Right to Stop Work :

The company has the right and duty to stop the work proceedings if safety regulations
are broken or, if in the company’s opinion, an unsafe situation arises.

19.21 VEHICLES IN THE REFINERY AREAS :

19.21.1 The speed limit for all vehicles in the Refinery area is 25 KM per hour. All vehicles must
be mechanically sound and have an efficient exhaust, silencer, horn brakes, filter cap
and CCE approved flame arrester.
19.21.2 Vehicles must be kept at the specified main roads only with driver and no vehicle should
enter any operating area without a valid Fire Permit and Safety Certificate.
19.21.3 Vehicles should not be parked where they are likely to impede the movement of other
vehicles in the Refinery and care must be taken when parking near railway lines to see
that sufficient clearance is allowed between vehicle and locomotives/trucks. Drivers of
vehicles must not attempt to move against shutter signals.
19.22 LOADS HANDLING AT THE SIDES OF THE ROADS:

PARTICULAR CARE MUST BE TAKEN ON ALL REFINERY ROAD WHERE THIS TYPE
OF LOADING/UNLOADING IS UNAVOIDABLE. The contractor/his Supervisor
(s)/Personnel should follow the advice of Engineer-in-Charge designated for the job.
19.23 GENERAL SAFETY :

19.23.1 All operations must be carried out in accordance with statutory requirements and Codes
of Practice that apply to that operation.
19.23.2 The contractor or his Supervisor(s) must exercise close supervision over his employees
and ensure that the persons working under him are competent to perform their work
safety. He must enforce strict adherence safety rules and procedures of the Refinery.
19.23.3 Contractor or his Supervisor (s) must take immediate corrective action whenever unsafe
conditions/practices are discovered.

19.23.4 Contractor or his Supervisor(s) must develop safety awareness in the minds of the all
workmen
19.23.5 Contractor or his Supervisor(s) shall report the causes of all minor/major/near-miss
accidents that occur in their job site(s) and immediately take remedial actions to prevent
recurrence of such incidents.
19.23.6 By regular and systematic inspection, Each Contractor or his Supervisor(s) must ensure
that all tools, equipments, machinery and premises are in safe and operative condition.
19.23.7 Display/show your identity card/gate pass badge.
19.23.8 Contractor must ensure the compliance of personal protective equipment like helmet,
safety shoes, safety belt and hand gloves, gumboot etc. in the Refinery area.
19.24 MISCELLANEOUS: Persons below the age of 18 should not be employed in any part of
the Refinery area.

19.25 PENALTY FOR VIOLATION OF SAFETY PROVISIONS

19.25.1 (i) Violation of applicable Safety, Health & Environment related norm: a penalty of Rs.
5,000 per occasion.

(ii) Violation as above resulting in .


a) Any physical injury, a penalty of 0.5% of the contract value (maximum of Rs.
2,00,000) per injury in addition to Rs. 5000 as in item (i) above.

b) Fatal accident, a penalty of 1% of the contract value (maximum of Rs. 10,00,000)


per fatality in addition to Rs. 5,000, as in item (i) above.
19.25.2 The aforesaid penalty clause is over and above the applicable statutory requirements.
Contractor shall take appropriate insurance policy for the effective implementation of the
above penalty provision
19.25.3 In case of accidents depending on the seriousness of injury etc. in addition to the
hospitalization / Treatment charges and Group insurance amount, compensation shall
be paid by the Contractor to the affected person / his family members in presence of
Engineer-in-charge as per Workmen Compensation Act.
19.26 With reference to clause No. 4.1.1. xix), Page 156 of General Conditions of Contract, the
contractor shall unless otherwise specified in the contract, upon receipt of the work order
inform the Engineer-in-Charge the details of one or more person nominated from his
side whose primary responsibility will be to ensure all safety compliances throughout the
contract period. The nominated person shall mandatorily attend the safety training
organized by the Owner/Engineer-in-Charge before start of work and will be responsible
for implementation of all safety practices as per job requirement. The cost of deployment
of such person shall be deemed to be included in the contract price.

19.27 QUALITY, SAFETY, HEALTH & ENVIRONMENT POLICY:

Contractors are required to submit, their QSHE Policy. Otherwise, the following attached plausible
QSHE Policy should be adopted.

SPECIAL CONDITIONS OF CONTRACT - II


1. SCOPE OF WORK:
1.1. The trader has to purchase Solar Renewable Energy Certificates RECs in favour of
IOCL, Bongaigaon Refinery (BGR) so that BGR can comply Renewable Purchase
Obligation (RPO) as per Assam Electricity Regulatory Commission Notification dated
15.10.2015.
1.2. The trader has to purchase a total of 22616 nos. of Solar RECs for BGR. IOCL will
inform trader regarding quantity of RECs to be procured prior to 7 days of the trading
date. The trader has to purchase the RECs within stipulated time as informed by IOCL
after commencement of the job. RECs shall be purchased on need based and no
compensation will be provided to the trader by IOCL BGR on variation of quantity.
1.3. In case of successful bidding, the Trader has to submit the successful bidding
document along with the certificates by next day of bidding to IOCL BGR.
1.4. The trader shall provide market analysis and data management, monthly report and
relevant inputs required etc. on monthly basis or as & when required by IOCL.
1.5. Registration with IEX & PXIL: It is the sole responsibility of the successful bidder to
complete the job of registration of our company IOCL BGR in the IEX & PXIL within the
reasonable time limit of 15 days after the job has been handed over.

4.1.3. Valid Membership certificate applicable up to April'2021 of IEX (Indian Energy
Exchange) & Power Exchange of India Limited (PXIL) showing the authority to
purchase REC directly from exchange.

8. TIME SCHEDULE & WORKING TIME


The duration of contract shall be 24 ( Twenty-Four ) months to be reckoned from date of
commencement of actual work. The contract may however be extended for another 12
( Twelve ) months at the same rate as well as terms and conditions at the discretion of
BGR.
9. CONSTRUCTION/CONTRACTOR’S EQUIPMENT
9.1. No tools and plants will be available to the contractor from the owner. The contractor will
have to arrange for their own tools, plants and equipment which may be necessary for
smooth execution of the work.
10. DEFECT LIABILITY PERIOD: Not applicable.
11. OTHERS:
11.1. The Power Trader should ensure the service as & when required on 24X7 basis. The
soft copies of the information on bidding price, market price etc. shall be sent through e-
mail to Engineer-in-charge/ contact person as per contract.
11.2. The trader has to purchase a total of 22616 nos. of Solar RECs for IOCL BGR. RECs
shall be purchased on need based and no compensation will be provided to the trader
by IOCL BGR on variation of quantity.
11.3. The Power Trader will render necessary assistance in getting information on latest REC
scenario, up-gradation of Rules and regulations of central and state authorities,
delivery/collection documents etc.
11.4. The Power Trader shall not assign the contract or any part thereof except with the
written consent of the IOCL, Bongaigaon Refinery and such consent even if provided
shall not relieve the Power Trader from any liability or any obligation under the contract.
11.5. Invoices for the services rendered under the Contract, shall be raised by the successful
bidder at the end of every month. No advance payment will be made to the trader for
purchase of RECs. No other charges other than those quoted in the SOR except
government taxes applicable shall be admissible under this contract.
11.6. Payment after necessary deductions / retention shall be released by BGR within 15
days of submission of clear error free invoice and other required documents.
11.7. With reference to clause no 5.0 of Special Conditions of Contract – I, the contract is
non- spilttable.
11.8. In any other matter not covered in the contract, the decision of the owner shall be final
and binding on the bidders.
11.9. PF,ESI, GCC Clause Number 8.3 –“ Labour Laws and Regulations “ and Clause
Number 5.6.0.0-“ Defect Liabilty period ” has been waived off for this tender.
11.10. Clause No. 11.6 of Special Conditions of Contract-I is not applicable for this tender

SCHEDULE OF RATES
PREAMBLE

1. This preamble is an integral part of the “Schedule of Rates” and any definition and
explanation given herewith shall have as much force as though they are incorporated
into the description of the items themselves in the Schedule of Rates.

2. Unless otherwise specifically stated in the contract, all items under the contract shall be
covered and paid for in accordance with the items and relative rates mentioned in the
Schedule of Rates. However, for lumpsum basis contract, payment would be based on
contracted lump sum price only.

3. The rates indicated against each item in the Schedule of Rates are only selected
abbreviations desired to give a general indication of the work covered by the item, and it
is intended that each item shall encompass the entire work and operations involved in
and relative to the performance of work as envisaged in terms of the contract documents
and shall include all operations auxiliary, ancillary or incidental to or in connection
therewith and all other matters , risks and cost whatsoever provided for under the
“Schedule of Rates”. It is therefore, necessary that the Bidders should read and construe
the “Schedule of Rates” with reference to the “Bid Document” as a whole for a proper
description undertaking of the work(s), responsibilities, duties, obligations and liabilities
covered by each item of the “Schedule of Rates” on the understanding that items in the
“Schedule of Rates” cover the entire work under the contract split under different heads
for the purpose of convenience in computing payment due to the contractor and
enabling the Contractor to quote.

4. The Owner reserves the rights to increase /decrease the tendered quantity of any or
every item and delete any item at any stage of work at the accepted rates. The
Contractor’s claim for compensation or damages on account of these shall not be
entertained subject to provision contained in GCC.

5. Bidders are not authorised to change any content of the price schedule or the details
indicated therein. In case any modification of the contents are detected at any stage
before or after the award, the same shall make the bid/award liable to be cancelled with
other penal actions as per policy of Owner.

6. The bidder shall quote the rate and other details in the specified cells of Schedule of
Rates/Bill of Quantities. No rate shall be indicated by the bidder in the unpriced bid.

7. There are 2 (two) BoQs –


BoQ1 : This is percentage BoQ for quotable items. Tenderer has to quote by selecting
percentage (+) or (-) of the estimated value.
BoQ2 : This is a percentage BoQ for which amount shall be reimbursed on actuals on valid
documentary proofs . Tenderer need to quote for this BoQ “At Par” only. Any markup in “
excess” or “ less” shall be treated at “At Par” only.
Total Value of the contract will be the sum of BoQ1 & BoQ2.
