GOVERNMENT OF KARNATAKA No. HFW/ 126 / CGE/2016 Government of Karnataka Secretariat Vikasa Soudha Bangalore Dated: 15/06/2016 CIRCULAR It has come to the notice of the State Government that Electronic Nicotine Delivery Systems [ENDS] commonly known as E-cigarette and other similar technologies by whatever name called products mainly containing ciiemical/drugs like nicotine with propylene glycot as main ingredients have adverse to the public health. Nicotine is a Chemical Substance, itis addict forming and poisonous to the Human beings. Use of this may leads to causes for Heart Disease, Respiratory Diseases, once it is consumed may leads to addict formation. Sometimes it may causes death to Human beings. The use of nicotine in food products preparation i.e., use of this Chemical in any form is banned in India under Food Safety and Standard Act 2006. Nicotine is allowed as an aid for de-addiction in nicotine replacement therapy under Drugs and Cosmetics Act 1940. Nicotine gums/lozenges of strength 2mg and 4mg and Nicotine transdermal therapeutic patches are the only nicotine containing drugs approved by the Drugs Controller General (India) as an aid for de-addiction in nicotine replacement therapy.(Drugs and Cosmetics Rules 1945 r/w Schedule K Item Number 33)State has the knowledge that Electronic Nicotine Delivery Systems [ENDS] or e-cigarette and other similar technologies by whatever name called products have been sold, illegally (including online sale), without a obtaining valid license from appropriate authority specified by law. The use of nicotine in food products and consumption by Public is bamned under Food Safety and Standard Act 2006. r/w notification No: F.No.2-15015/13/2010, dated: 1/08/2011 and under para 2, 3, 4 of Food Safety and Standards (Prohibition and Restriction on Sales) Regulation 2011. Further nicotine is allowed as an aid for de-addiction in nicotine replacement therapy under Drugs and Cosmetics Act 1940, it is not allowed for any other purpose under law. Therefore, the State Government hereby prohibits the sale (including online sale}, manufacture, distribution, trade, import and advertisement of Electronic Nicotine Delivery Systems [ENDS}, its parts and components in any shape or size of cartridges containing picotine in the ae qa.
