Queries re: proposed ordinance authorizing the mayor to negotiate, conclude and
obtain a loan with the DBP…:
1. Who is the proponent of the said ordinance?
If there is no proponent, then the “supposed deliberation” of today’s
committee as a whole has no effect whatsoever since it is still premature for the sangguniang bayan to transact business or deliberate because it did not yet acquire jurisdiction over the subject.
If someone (at the moment) volunteered to be the proponent, still, it is
premature since observing the legislative process, the said measure must first be calendared for first reading before it can be referred to the committee.
If there is indeed a proponent, then let him present or explain his
measure and ask questions relating to: A. The prior understanding of the sangguniang bayan to individually ratify the projects/programs of the term loan agreement vis-à-vis the present proposal of ratifying all projects/programs in just a single ordinance; B. Because of this “general ratification” of the concluded term loan agreement, the proposed ordinance seems to grant the mayor the authority to obtain a loan in full despite the prior agreement to prioritize the public market and terminal; C. Whether the said ordinance is violative of the “one title, one subject” rule since the title speaks of the grant of authority and ratification as the subject matter of the ordinance, yet in section 2, there is a provision effecting for an “amendment” when it declares that the (1) construction of vendor’s shed, (2) lot acquisition for various uses, and (3) the acquisition of heavy equipments were “allegedly” in accordance with the approved local development plan of the LGU for 2018? The granting of authority to the mayor to contract loans and an amendment to LDP cannot be allowed in a single ordinance without necessarily violating the “one title, one subject” policy.
2. Ask explanation regarding the amounts to be included in the annual budget of
the LGU for debt servicing; or how did the proponent arrived at those figures?
