On January 12, 1999 the Honorable Regional Trial Court Branch 74 Malabon issued judgment in
favor of Antonio Lo against Nogrocoma. On the same day Notice of Levy of Alias Writ of
Execution was annotated on the TCT No. 36692, annotated in the following manner:

2. The Metrobank foreclosed, auctioned and acquired the properties of Nogrocoma covered by TCT
No. 36692; the bank caused the cancellation of the said title, and that TCT N
M-29726 was issued in the name of Metrobank; The Notice of Levy on Alias Writ of Execution in
favor of Antonio Lo was carried over in new TCT No. M-29726;

3. Metrobank filed a Petition for Cancellation of Notice of Levy on Alias Writ of Execution
annotated in TCT No. M-29726, Entry No. 30591: T/M 2712, before RTC Branch 170 docketed as
LRC Case No. 928-MN. The Petition has been granted and the Notice of Levy on Alias Writ of
Execution was cancelled on April 7, 2006;

4. Mr. Antonio Lo discovered the cancellation of Entry 30591: T/M 2712 on January 2008,
immediately filed a Petition for Annulment
