Vs, MOTION FOR PROBATION/ALTERNATIVE MOTION
FOR PROBATION WITH AN ALTERNATIVE SENTENCING PLAN
NANCY BOCK DEFENDANT.
Comes the Defendant, by Counsel, and moves the Court for probation or, in the
alternative, for probation with an alternative sentencing plan upon whatever terms and
conditions the Court may deem appropriate. As grounds for this Motion the Defendant
states as follows:
1. That the Defendant, Ms. Bock, has no prior criminal record.
2. That the Defendant has accepted responsibility for her offense, The Defendant states
4o the Court ina letter attached as Exhibit 1
“I fully accept the responsibility of my actions. I know that
my actions have disappointed God, my family, my friends and most,
of all the taxpayers that put their faith and trust in me by electing me
to my position for the past 25 years.
My career in my office began over 42 years ago. I always
took pride in serving our taxpayers and helping others whether it was
in our county or any other county. I loved serving the citizens. I
also taught other PVA’s, deputies and employees in the Department
of Revenue for the past 25 years. I also was very involved in our Ky
Chapter of Assessing Officers and not only served as an officer but
spearheaded several charitable fundraisers in the state. I am also
very involved in my church, I have served as one of the Worship
leaders for Children’s Church, Director of Awana, VBS Teacher,
and a Sunday School teacher. Children are a very important part of
my life. [am very involved in a very special 11-year old’s life. 1
spend time with him almost every day and help to support himfinancially. 1 also help with a couple whom are 88 years old, I take
them to church and to doctor’s appointments, The man is recovering
from brain cancer surgery and they do not have family in this area
1 know that I made mistakes that I have to live with the rest of my
life. 1 am so sorry, and I have truly lost so much from the mistakes
that I made. My reputation in our community is gone. T have been
on every news outlet and people whisper about me as I walk by. I
know that I deserve all this treatment as I misused the citizens trust
in me and my power.
Lam asking that you consider what type of person I really am.
I made mistakes and [ am guilty, and I am truly sony and
remorseful. I have already spoken to a few youth leaders and asked if
T may speak to the kids to tell them how a person may have the
world at their fingertips and have everything, they ever wanted but if
they make mistakes and commit crimes it will be taken away in a
moment. I want others to lear that no one is above the law.
‘Thank you so very much for your time and consideration in
my case.”
3. That Ms, Bock has paid her restitution in full. Attached as Exhibit 2 is proof of the
payment of $5,174.49 to the McCracken County PVA Office.
4, Ms. Bock severed McCracken County for forty (40) years in the Property Valuation
Administrator (PVA) Office. Twenty-six (26) of those years she was validated by the
public being re-elected to office, as stated in a letter from Cecilia Newberry attached
as Exhibit 3.
Numerous PVAS from across the state have written to the Cou, she taught
classes to other PVAs across the state and was always the first to offer to help a
newly elected PVA.
Tony Lindauer, retired PVA for Jefferson County writes “Her dedication to
other PVAs was inspiring. She helped so many new PVAs adjust to their duties”
Tony ended his letter attached as Exhibit 4, with a plea to the Court,
[would hope that all the kindness and goodness she has done
over so many years would be taken into consideration in her ca
before you. Mercy is a wonderful gift for those who have donewrong and repent and repay for their misdeeds. I believe in Nancy
Bock and wish that all her works for her community would deserve
that mercy.”
Jason 8, Chinn, PVA of Ohio County since 1999 writes to the Court in a
letter attached as Exhibit 5;
“Since taking office in May of 1999 Naney Bock has become
a friend and I have upmost respect for her. Nancy instructed my very
first class a Property Valuation Administrator and since I have had
many classes with Nancy. She always exuded professionalism and
would do anything to help. Nancy was the driving force behind
numerous fund-raising activities throughout our years as colleagues.
Naney has received many deserving awards from the Kentucky
Property Valuation’s Association.”
Ronald Wood, PVA of Caldwell County, writes in a letter attached as
Exhibit 6, “[wJhen I was elected as a new PVA over 13 years ago, Ms. Bock was
the first PVA to extend a congratulation and offer to help in anyway... Therefore,
my staff and I are asking for you to consider the whole person and to offer some
grace as you consider your judgement conceming of Ms. Nancy Bock.”
The PVA of Henry County, Jason Seriber, has known Nancy for twenty-
two (22) years. He acknowledged that Naney contacted him personally about her
offense and took responsibility for her actions. Mr. Scriber describes in a letter
attached as Exhibit 7, how Nancy served in “leadership capacity within the
Kentucky PVA. Association...and spent countless hours assisting our association
through teaching educational courses, volunteering on several committees and
leading many of our charitable projects.”
Barbara Techenor, Nelson County PVA, attached as Exhibit 8, has known
Nancy since 1980, Barbara writes, “Nancy was...instrumental in establishing
