ARBITRATION - An alternative dispute resolution technique for the resolution of disputes outside

the courts. A third party reviews the evidence in the case and imposes a decision that is legally
binding on both sides and enforceable in the courts. Arbitration agreements have to be signed

MEDIATION – Does not impose but facilitates negotiations by a neutral third party(mediator) to reach
a common agreement( can be made binding by settlement agreement).

Conciliation differs from mediation in that in conciliation, often the parties are in
need of restoring or repairing a relationship, either personal or business.
LITIGATION- Ur court(judicial) mode.( disputant files a civil suit – painful in terms of time, stressful,
loss of relationships). And the winner continues to worry for there can be appellate and further
appellate proceedings

Civil disputes could be dealt with through mediation. – flexible, speedy, confidential and cost
effective. Mediation can be less stressful and expensive than litigation and holds the prospect of
revival of relationships. Could lead to a win-win situation.
