Freedom of speech and expression is a basic fundamental right and any attempt to suppress it will

have catastrophic results for any democracy. The Indian Constitution have incorporated the freedom
of speech and expression as a fundamental right subject to some restrictions. The roots of any
democracy will hold only when the voice of the people is not supressed by any government
machinery. Free speech has been under constant scrutiny as the extent to which an individual can
exercise the right has always been under spotlight.

Section 124A of Indian Penal Code defines Sedition and the word has not found any place in the
Constitution but Article 19 (2) of the Constitution puts restriction on Freedom of speech and
expression.
