CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of _____________, this
_______________________, 20___, by and between:

___________________________________, of legal age, single, Filipino, and with residence and


postal address at _______________________________________________________,
hereinafter referred to as the LESSOR.

-AND-

___________________________________, Filipino and with residence and postal address at


______________________________________________________ , hereinafter referred to as
the LESSEE.

WITNESSETH; That

WHEREAS, the LESSOR is the owner of commercial units situated at


__________________________, Cavite City;

WHEREAS, the LESSOR agrees to lease-out the property to the LESSEE and the LESSEE is
willing to lease the same;

NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR leases
unto the LESSEE and the LESSEE hereby accepts from the LESSOR the LEASED premises,
subject to the following:

TERMS AND CONDITIONS

1. TERM: The period of this contract of lease shall be TWO (2) years commencing on
________________ up to _______________, and may be renewed at the mutual agreement of
both parties;
2. RENTAL RATE: The LESSEE agrees to pay to the LESSOR a monthly rental rate of
__________________ (____________) PESOS for the first year per unit, which will be paid to
the LESSOR every ______ day of each current month.

3. DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this contract and
prior to move-in the one month advance rental and two months deposit, wherein the one month
deposit shall be applied as a rent for the last or 24th month and the remaining one (1) month
deposit shall answer partially for damages and any other obligations, for utilities such as Water,
Electricity, Telephone or resulting from violation(s) of any provisions of the contract.

4. DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent, such
as when the checks are dishonored, the LESSOR at its option may terminate this contract and
eject the LESSEE. The LESSOR has the right to padlock the premises when the LESSEE is in
default of payment or has an outstanding balance from failure to pay rent or being habitually late
in paying rent regardless of the balance owed and LESSOR may forfeit whatever rental deposit
or advances have been given by the LESSEE.

A three- day grace period will be allowed for late payment. However, failure to pay the
monthly rental within the grace period is subject to five percent (5%) interest per month of delay
as penalty.

5. SUB-LEASE: The LESSEE shall not directly or indirectly sublet, allow or permit the leased
premises to be occupied in whole or in part by any person, form or corporation, neither shall the
LESSEE assign its rights hereunder to any person or entity and no right of interest thereto or
therein shall be conferred on or vested in anyone by the LESSEE without the LESSOR’S
approval.

6. CARE OF THE LEASED PREMISES: The LESSEE received the leased premises in good
and tenable condition, and he/she agrees to take care of the premises like a good father of a
family.

7. PUBLIC UTILITIES: The LESSEE shall pay for its telephone, electric, water, internet and
other public services and utilities during the duration of the lease.

8. EXPIRATION OF LEASE: At the expiration of the terms of this lease or cancellation


thereof, as herein provided, the LESSEE will promptly deliver to the LESSOR the leased
premises with all corresponding keys and in as good and tenable condition as the same as is now,
ordinary wear and tear expected devoid all occupants, movable furniture, articles and effects of
any kind. Non- compliance with the terms of this clause by the LESSEE will give the LESSOR
the right, at the latter’s option, to refuse to accept the delivery of the premises and compel the
LESSEE to pay rent therefrom at the same rate until the LESSEE shall have complied with terms
hereof. The same shall be imposed in case the LESSEE fails to leave the premises after the
expiration of this Contract of Lease or termination for any reason whatsoever.
9. LESSOR’S RIGHT OF ENTRY: The LESSOR or its authorized agent shall after giving due
notice to the LESSEE shall have the right to enter premises in the presence of the LESSEE or its
representative at any reasonable hour to examine the same or make repairs therein or for the
operation and maintenance of the building or to exhibit the leased premises to prospective
LESSEE, or for any other lawful purposes which it may deem necessary.

10. ORDINARY REPAIRS: All ordinary repairs within the premises that may arise in the daily
use of the facilities therein shall be the sole account and expense of the LESSEE, without right to
reimbursement.

11. ALTERATIONS, ADDITIONS AND IMPROVEMENTS: The LESSEE shall not


introduce improvements or make alterations in the leased premises without the prior consent and
approval of the LESSOR.

12. USE OF LEASED PREMISES: The LESSEE hereby expressly agrees and warrants that the
leased premises shall be exclusively use for legal purposes and not for any illicit, illegal or
immoral affairs. The LESSOR shall not be responsible for any loss or damage of any of the
equipment, tools or materials of the LESSEE.

13. OTHER PROHIBITIONS: The LESSEE shall not bring into or store in the leased
premises, any inflammable or explosive goods or materials nor any article which may expose the
leased premises to fire or increase fire hazard of the building or increase the rate of insurance of
the building. The LESSOR shall not do or cause to be done any act or thing, which will likewise
increase the fire hazard or fire insurance of the building. In addition, the LESSEE shall not
tamper or modify the electrical wiring, installations or plans of the unit without informing and
securing the consent of the LESSOR or her representative.

14. COMPLIANCE WITH LAWS, ORDINANCES, ETC.: The LESSEE shall comply with
laws, ordinances, regulations of the National and Municipal Government with respect to the use
and occupancy of the leased premises, and shall not engage in any immoral or illicit business or
undertaking in the premises.

15. NOTICE, ABANDONMENT AND DAMAGE: The LESSEE shall notify the LESSOR
thirty (30) days in advance should the LESSEE decide to vacate the leased premises before the
expiration of the CONTRACT OF LEASE.

16. EXCLUSIVE VENUE: The parties hereto agree that the exclusive venue for litigation,
action or proceeding arising from or relating to this Agreement, or any alleged breach thereof,
shall be in Cavite City.

The violations of any provisions hereof including any violation of law in the use of the
leased premises shall be sufficient cause of terminating this agreement.
