Establishment of the Council, functions, duties and powers

3. Establishment of the Council: (1) Nepal Media Council is established for carrying out regulatory
functions for the advancement of healthy and dignified journalism.
(2) The office of the Council shall be located in Kathmandu Valley.

4. Council to be an autonomous and organized institution: (1) The Council shall be an autonomous
and organized institution having continuous succession.
(2) The Council shall have a separate seal for its activities.
(3) The Council may, like an individual, acquire, use, sell or dispose of movable and immovable
assets or make other arrangements.
(4) The Council may, like an individual, sue and get sued in the same name.

5. Functions, duties and powers of the Council: In addition to the functions, duties and the powers
of the Council stipulated elsewhere in this Act, the Council shall have following functions, duties
and powers:
(a) Approve policies, annual budget and programmes of the Council.
(b) Advise the Government of Nepal on formulation of mass media policy.
(c) Monitor the compliance of the Code of Conduct issued by the Council and receive complaints
related to violation of the Code of Conduct.
(d) Conduct inquiry into complaints related to violation of the Code of Conduct and take necessary
action.
(e) Play necessary role in harmonizing the relations between the Government, mass media and the
ordinary people.
(f) Submit annual report with a study on the overall mass media scenario.
(g) Publish updated materials relevant to the Code of Conduct
(h) Conduct inquiry into contents, published or broadcast, and take actions.
(i) Carry out other functions as prescribed.

6. Formulate and issue Code of Conduct: (1) The Council shall, as necessary, formulate and issue
the Code of Conduct to maintain professional integrity.
(2) Every mass media outlet shall be required to enforce its own Code of Conduct by remaining
under the Code of Conduct issued by the Council as per Section 1.
(3) It will be the duty of the all mass media, electronic broadcast and online, print media and
literary media and their publishers, editors, journalists and correspondents to abide by the Code of
Conduct issued by the Council.
(4) The Council shall, as necessary, monitor the compliance of the Code of Conduct, which is
enforced under this Act, by all mass media, electronic broadcast and online, print media and
literary media and their publishers, editors, journalists and correspondents; and may give
instructions, as necessary, for compliance with the code of conduct while conducting monitoring.
(5) Concerned mass media, electronic broadcast and online, print media and literary media, their
publishers, editors, journalists and correspondents shall be obliged to follow the instructions given
under Section 4.
