1 (22.12.1999) The Freehold land shown edged with red on the plan of the
above Title filed at the Registry and being Holly House, 5 Riverside,
Nanpean, St Austell (PL26 7YJ).
2 (22.12.1999) There are excluded from this registration the mines and
minerals excepted by a Conveyance thereof dated 1 April 1937 made
between (1) John Bevill Fortescue (2) Charles Augustus Phillimore and
others and (3) English Clays Lovering Pochin & Co Ltd in the following
terms and the land is also subject to the following ancillary rights of
working:-

"The Vendor as Trustee by virtue of the powers vested in him by the


Settled Land Act 1925 and of every or any other power enabling him in
that behalf thereby granted unto the Company

FIRST ALL china clay and china stone in or under the lands in the
Parish of St Stephen in Brannel in the County of Cornwall which are
coloured yellow green purple and blue on the sixteen sheets of the 25
inch Ordnance Map annexed to those presents (which said sheets had been
signed by the Vendor and impressed with the Common Seal of the Company
for the purposes of identification and were thereinafter referred to
collectively as "the plan") and all the equitable interests in
undivided shares which the Vendor had power to grant in china clay and
china stone in or under the other lands situate lying or being within
the said Parish

TOGETHER with full free and exclusive liberty licence and power to dig
work and search for such china clay and china stone and to raise work
cleanse and make merchantable and fit for sale such china clay and
china stone and to take carry away convert and dispose of the same the
Company or the persons for the time being exercising the above-
mentioned liberties licenses and powers or any of them paying proper
compensation for damage or injury thereby caused as thereinafter
provided

SECONDLY ALL other metals minerals and quarries of building and road
stone in or under such of the said lands as were shown and delineated
on the plan and were thereon coloured yellow and blue

TOGETHER with all necessary powers of working or getting the said


metals minerals and stone the Company or persons from time to time
exercising the said powers or any of them paying proper compensation
for damage or injury thereby caused as thereinafter provided

SIXTHLY THE right for the Company so far as the Vendor could grant the
same and subject to the Company paying full compensation for all damage
or injury thereby caused

(A) To maintain and use in perpetuity all the existing lines of pipes
or conduits then or lately used for the purposes of conveying china
clay or china clay sand in suspension in water and for conveying water
for use in the winning and getting of china clay in and throughout the
land coloured on the plan

(D) To maintain and use all the existing electric transmission lines
then used or enjoyed by the Company over any part of the lands coloured
yellow and green on the plan

(E) To enter on the surface of any of the land coloured yellow and
green on the plan for the purpose of inspecting repairing removing and
renewing the said pipe lines conduits diverted streams roads or ways
paths and electric transmission lines or any of them

(9) Subject to compensation as next thereinafter provided not to do or


permit or suffer to be done any act or thing other than or beyond the
processes usually adopted in working for china clay or china stone
which should in any way be prejudicial to the adjoining or neighbouring
property of the Vendor

(10) To pay full and complete compensation in respect of all and any
damage to the surface of any land buildings or other erections on land
belonging to the Vendor or belonging to any person or persons to whom
the Vendor was or might be liable to pay compensation which should be
worked down or otherwise destroyed damaged or injuriously affected by
the searching for digging working getting raising conveying cleansing
and making merchantable by the Company or their lessees or grantees of
china clay china stone or other minerals or metals or stone thereby
conveyed or caused by any other works incidental thereto PROVIDED that
that clause should not be deemed to imply any grant or licence by the
Vendor to exercise any rights or privileges not thereby expressly
granted nor to affect the rights and remedies of the Vendor or any
adjoining owners at common law or otherwise.

(14) That the Company should not enter upon any land of the Vendor not
thereby conveyed for the purpose of exercising any liberty thereby
granted except in cases of repair or renewal of pipes or other works of
immediate urgency and then only with the previous consent of the agent
of the Vendor without giving 21 days' previous notice in writing to the
Vendor or his agent of the Company's intention so to do and would
forthwith erect and thereafter maintain to the satisfaction of the
Vendor or his agent suitable fences round their works on any land so
entered upon

IT WAS THEREBY AGREED AND DECLARED as follows:-

(1) Any dispute which should arise in regard to compensation or the
amount thereof or the erection of any accommodation or other works
should be referred to the decision of an arbitrator appointed by the
President of the Land Agents' Society and that should be deemed a
reference to arbitration under the Arbitration Acts 1889 to 1934

(2) Notwithstanding the provisions as to payment of compensation


hereinbefore contained at any time during the life of the survivor of
the issue living at the date of those parents of His Majesty King
Edward the Seventh and the period of 20 years from the death of such
survivor the Vendor might instead of being paid compensation in respect
of damage to any land belonging to the Vendor and not thereby conveyed
by reason of the same being worked down or otherwise destroyed or
injured or made unfit as aforesaid require the Company to purchased the
said land so damaged at its full value previously to its being so
damaged such value in case of dispute to be determined by arbitration
as thereinbefore provided

(3) Such election should be signified by notice in writing given by


the Vendor or his agent to the Company

(4) The completion of any such purchase should be made at the


expiration of one month after the receipt by the Company of such notice
and as from the expiration of the said period of one month the purchase
money should bear interest at the rate of £5 per cent per annum until
payment thereof

(5) The land as to which such notice should be given should be sold
subject to the like conditions as to title or otherwise as that subject
to which the land thereby conveyed had been sold

(6) Any such sale should be without prejudice to rights of the Vendor
to compensation under the covenant aforesaid in respect of damage to
other lands of the Vendor by reason of severance or the erection by the
Company of buildings or works thereon or otherwise

(7) The costs of the Vendor and his Trustee should be paid by the
Company on the completion of such purchase

7. (A) Definition clause

(B) The expression "china clay" was intended to comprise not only the
marketable article usually so called but also all the substances
usually associated with china clay in its unworked state in the ground
although some or all of such substances might not be properly classed
as minerals Except that in regard to the land coloured green and purple
and purple hatched black metals minerals or other underground profits
even though found associated or mixed with china clay were not included
in the sale

(C) The expression "china stone" was intended to mean all qualities or
kinds of china stone as then sold under that name but did not include
granite or granitic rock which had no vitrifying content."

NOTE: The land in this title forms part of the coloured yellow referred
to. The coloured green, blue and purple referred to were not shown on
the plan lodged on first registration.
3 (22.12.1999) There are excluded from this registration the mines and
minerals excepted by a Conveyance of the land in this title dated 29
October 1947 made between (1) George Grenville Fortescue (Vendor) (2)
Charles Augustus Phillimore and Others (Trustees) and (3) Richard
Wellington and Annie Wellington (Purchasers) in the following terms and
the land is also subject to the following ancillary powers of working:-

"EXCEPTING AND RESERVING unto the Vendor and his successors in Title as
mentioned in the First part of the Second Schedule hereto.....

china clay and china stone and to raise work cleanse and make
merchantable and fit for sale such china clay and china stone and to
take carry away convert and dispose of the same the Company or the
persons for the time being exercising the above mentioned liberties
licences and powers or any of them paying property compensation for
damage or injury therby cuased as therein provided SECONDLY ALL other
metals minerals and quarries of building and road stone TOGETHER with
all necessary powers of working or getting the said metals minerals and
stone the Company or persons from time to time exercising the said
powers or any of them paying proper compensation for damage or injury
thereby caused as therein provided"
4 (22.12.1999) Notice entered in pursuance of rule 254 of the Land
Registration Rules 1925 on 22 December 1999 that the registered
proprietor claims that the land has the benefit of a right of way over
the land coloured yellow on the plan to a Statutory Declaration dated 4
August 1999 by Dorothy Thelma Grant.
