सा.का.िन. 1172(अ).—रा पित भारत के संिवधान के अनु छे द 309 के पर तुक ारा द त शि य का योग
करते ए और क ीय उ पाद शु क और भूिम सीमा शु क िवभाग िनरी क (समूह 'ग' पद) भत िनयम 2002, सीमा-शु क
िवभाग िनरी क (िनवारक अिधकारी) (समूह 'ग' पद) भत िनयम, 2002 और सीमा शु क िवभाग िनरी क (परी क) (समूह
'ग' पद) भत िनयम, 2002 को, उन बात के िसवाय अिध ांत करते ए िज ह ऐसे अिध मण के पहले कया गया है या करने
का लोप कया गया िव त मं ालय, राज व िवभाग के क ीय उ पाद शु क और सीमा शु क के िनयं णाधीन िनरी क (क ीय
उ पाद शु क), िनरी क (िनवारक अिधकारी) और िनरी क (परी क) के पद पर भत क प ित का िविनयमन करने के
िलए िन निलिखत िनयम बनाते ह, अथात:-
1. संि त नाम और ारं भ.—(i) इन िनयम का संि त नाम क ीय उ पाद शु क और सीमा शु क किम नरी
(क ीय उ पाद शु क, िनवारक अिधकारी तथा परी क) समूह 'ख' पद भत िनयम, 2016 है।
(ii) ये राजप म उनके काशन क तारीख को वृ त ह गे।
2. आवेदन- ये िनयम इन िनयम म उपबंध अनुसूची के तंभ(I) म िविन द ट पद को लागू ह गे ।
3. पद सं या, वग करण और वेतन मे स म लेबल.—उ त पद क सं या, उनका वग करण और इससे उपाबं
वेतन मे स म लेबल वे ह गे जो उ अनुसूची के त भ (2) से त भ (4) म िविन द ट ह।
4. भत क प ित, आयु-सीमा और अहताएं, आ द.—भत क प ित, आयु-सीमा, अहताएं और उनसे संबंिधत
अ य बात वे ह गी जो पूव त अनुसूची के त भ (5) से त भ (13) म िविन द ट ह।
5. िवशेष उपबंध.—(1) जब तक क ीय उ पाद शु क और सीमा शु क बोड ारा अ यथा िनदेिशत न कया जाए,
काडर िनयं ण ािधकारी (सीसीए) का अपना अलग काडर होगा।

6. िनरहता.—वह यि -
(क) िजसने ऐसे यि से िजसका पित या िजसक प नी जीिवत है, िववाह कया है या िववाह क संिवदा क है, या
(ख) िजसने अपने पित या अपनी प नी के जीिवत रहते ए, कसी यि से िववाह कया है या िववाह क संिवदा
क है,
उ त पद पर िनयुि का पा नह होगा: परं तु य द कदीय सरकार का यह समाधान हो जाता है क ऐसा िववाह ऐसे
यि और िववाह के अ य प कार को लागू वीय िविध के अधीन अनु ेय है और ऐसा करने के िलए अ य आधार ह तो वह
कसी यि को इस िनयम के वतन से छू ट दे सके गी।
7. िशिथल करने क शि .—जहां क ीय सरकार क यह राय है क ऐसा करना आव यक या समीचीन है, वहां वह,
उसके िलए जो कारण ह उ ह लेखब करके तथा संघ लोक सेवा आयोग से परामश करके इन िनयम के कसी उपबंध को
कसी वग या वग के यि य क बाबत, आदेश ारा िशिथल कर सके गी।
8. यावृि .—इन िनयम क कोई बात, ऐसे आर ण, आयु-सीमा म छू ट और अ य रयायत पर भाव नह
डालेगी, िजनका क ीय सरकार ारा इस संबंध म समय-समय पर िनकाले गये आदेश के अनुसार अनुसूिचत जाितय ,
अनुसूिचत जनजाितय , भूतपूव सैिनक और अ य िवशेष वग के यि य के िलए उपबंध करना अपेि त है।

ऐसे पदधारी (वुमैन सचर या ा समैन या कर सहायक या
आशुिलिपक ेणी-II) िज ह ने उस ेणी म पं ह वष िनयिमत
सेवा क है।
ट पण 1: वेतन मै स म दए गए लेबल म ऐसे पदधारी जो
इन िनयम के ारं भ क तारीख को िवभाग के पुि कृ त या
थायी पदधारी ह और जो ऐसे ारं भ से पूव आयोिजत एस डी
सी ई म भाग लेने के िलए पा ये सा यापूण आधार पर सभी
एस डी सी ई म भाग लेने के िलए पा बने रहगे; और
ट पण 2: आशुिलिप काडर म दए गए वेतन मै स म ऐसे
पदधारी जो इन िनयम के ारं भ म थ तारीख के प चात
िवभाग म पद हण कए ए ह ऐसे ारं भ क तारीख के
प चात् आयोिजत एस डी सी ई म भाग लेने के िलए पा नह
ह गे।
ट पण 3: अ य थय म क ीय उ पाद शु क और सीमा शु क
बोड ारा समय-समय पर जैसा भी क जाए ऐसा िलिखत
परी ा उ तीण करना अपेि त होगा और िलिखत परी ा अहक
व प का होगा तथा परी ा म द त अंक का ये ठता
अवधारण करने के िलए गणना नह क जाएगी।
ट पण 4: अ य थय से शारी रक परी ण उ तीण करना
अपेि त होगा और तंभ (7) के अधीन सीधे भत कए जाने
वाले यि य के िलए िविहत शारी रक मानदंड पूरा करना
होगा।

क तारीख के प चात् आयोिजत एस डी सी ई म भाग
लेने के िलए पा नह ह गे।
ट पण 3: अ य थय म क ीय उ पाद शु क और
सीमा शु क बोड ारा समय-समय पर जैसा भी क
जाए ऐसा िलिखत परी ा उ तीण करना अपेि त
होगा और िलिखत परी ा अहक व प का होगा
तथा परी ा म द त अंक का ये ठता अवधारण
करने के िलए गणना नह क जाएगी।

G.S.R. 1172(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution
of India, and in supersession of the Central Excise and Land Customs Department Inspector (Group 'C'
posts) Recruitment Rules, 2002, the Customs Department Inspector (Preventive Officer) (Group ‘C’ posts)
Recruitment Rules, 2002 and the Customs Department Inspector (Examiner) (Group ‘C’ posts) Recruitment Rules,
2002 except as respects things done or omitted to be done before such supersession, the President hereby makes the
following rules for regulating the method of recruitment to the posts of Inspector (Central Excise), Inspector (Preventive
Officer) and Inspector (Examiner) in the Commissionerates under the control of Central Board of Excise and
Customs, Department of Revenue, Ministry of Finance, namely:-
1. Short title and commencement.—(1) These rules may be called the Central Excise and
Customs Commissionerates Inspector (Central Excise, Preventive Officer and Examiner), Group ‘B’ Posts
Recruitment Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule
annexed to these rules.
3. Number of post, classification, level in pay matrix.—The number of the said posts, their
classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the
said Schedule.
4. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit,
qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid
Schedule.
5. Special provision. - Each Cadre Controlling Authority (CCA) shall have its own separate cadre,
unless otherwise directed by the Central Board of Excise and Customs.
6. Disqualification.—No person,—
(a) who, has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under
the personal law applicable to such person and the other party to the marriage and that there are other
grounds for so doing, exempt any person from the operation of this rule.
7. Power to relax.—Where the Central Government is of the opinion that it is necessary or
expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union
Public Service Commission, relax any of the provisions of these rules with respect to any class or category
of persons.
8. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other
concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and
other special categories of persons in accordance with the orders issued by the Central Government from
time to time in this regard.
