IN THE MATTER OF THE REQUEST FOR OVERTIME PAY FOR LOCAL TREASURERS SERVING DURING THE 2019 NATIONAL AND LOCAL ELECTIONS AND BEYOND This pertains to the Memorandum dated February 12, 2019 of EO Melanio C. Sibayan, OEO, Balanga City, Bataan, relative to the request for overtime pay for Local Treasurers serving during the 2019 National and Local Elections and beyond, with the recommending approval of Executive Director Jose M. Tolentino, Jr. The Memorandum of EO Sibayan reads: “Your Honors, some Local Treasurers in Bataan verbally raised their concern particularly, the payment of their overtime for working beyond the regular &- hour work before and after May 13, 2019 NLEs. This is in compliance with their statutory obligations to act as custodians and distributors of accountable forms and supplies to all Poll Workers. Experience shows that the time-volume of their work during those periods demand the rendition of overtime as extremely necessary, and that failure to deliver their part would expose the government to embarrassment and negate the very purpose of holding elections. However, during the 2018 BSKE, the Commission issued Minute Resolution No. 18-0359 which specifically ‘endorses the Provincial, City, and ‘Municipal Treasurers to claim overtime pay for extra services rendered during the election period as deputies of the Commission chargeable against available funds of their respective local government units.’ The ‘same authority was also granted in 2007 under Minute Resolution No. 07-1711. in view of that, they claimed that while the Commission was supportive to them on that concern in the past, they respectfully request for issuance of authority/ order to claim overtime pay for work rendered not only for the 2019 National and Local Elections but EVEN BEYOND. This will spare them of addressing the same interest in future elections. For your Honors’ consideration and approval, please.” The Memorandum of Executive Director Tolentino states: “Attached is the Memorandum dated 12 February 2019 of EO Melanio C. Sibayan, OEO, Batanga City, Bataan, which was received by this office on April 2, 2019, respectfully requesting that the Local Treasurers of the said city who will be serving during the May 13, 2019 National and Local Elections, be allowed to claim overtime pay beyond the regular eight (8) hour work before and after May APage 2 of MIR. Payment of overtime claims shall be chargeable to the funds of the Local government units concerned. Consistent with previous authority granted by the Commission, the undersigned recommends the approval of the subject request of EO Sibayan. For your Honor's consideration.” Considering the foregoing, the Commission RESOLVED, as it hereby RESOLVES, to approve the recommendation of Executive Director Jose M. Tolentino, Jr., to grant authority to the Provincial, City, and Municipal Treasurers to claim overtime pay for extra services rendered during the election period as deputies of the Commission in connection with the May 13, 2019 National and Local Elections, subject to COA and Civil Service rules and regulations, and Payment thereof shall be charged to the local government unit concerned.
