RESOLUTION NO. 482-S'06 RESOLUTION APPROVING AN ORDINANCE AMENDING THE LAST PARAGRAPH OF SECTION 2.4.06 AND PARAGRAPH D OF SECTION 2.4.07 OF THE REVISED PROVINCIAL REVENUE CODE OF BULACAN ON THE DECLARATION OF REAL PROPERTY BY THE OWNER OR ADMINISTRATOR AND DUTY OF PERSON ACQUIRING REAL PROPERTY OR MAKING IMPROVEMENT THEREON ve AUTHOR: HON. GLENN B. SANTOS WHEREAS, the Revenue Task Force observed that an oversight has been made in the provision of fast paragraph of Section 2.4.06 and Section 2.4.07 (paragraph d) both pertain to the penalty of P500.00 to be imposed in case of their violation; WHEREAS, the Provincial Revenue Code of Bulacan prescribe a fine or penalties for violation of the tax ordinance for the owner or administrator who fails to ply on dectaring their real property and the duty of person acquiring real property or ‘aking improvement thereon;Resolution No. 482-S'06 Province of Bulacan Page 2 WHEREAS, under Section 516 of the Republic Act 7160 also known as the Local Government Code of 1991 allows the sanggunian of a local government unit to prescribe fine or other penalties for violation of tax ordinance from @ minimur fine of Pt 000.00 and imprisonment of one (1) month to a maximum of a fine of PS,000.00 and imprisonment of six (6) months. In case of a sangguniang barangay, the minimum fine is P100.00; and maximum of P500.00; WHEREAS, the amendment of the Provincial Revenue Code is in accord with the mandate of the Local Government Code of 1991 (R.A. 7160) to effectively carry out the powers and functions of the province towards the fruition of a fully developed, sustainable and self-reliant community; NOW THEREFORE, for and in consideration of the foregoing premises, authored by the Hon. Glenn B. Santos, Chairman of the Committee on Ways and Means, BE IT RESOLVED, as it is hereby resolved, to approve this amendatory ordinance: PROVINCIAL ORDINANCE NO. 07-S'06 [AN ORDINANCE AMENDING THE LAST PARAGRAPH OF ‘SECTION 2.4.06 AND PARAGRAPH D OF SECTION 2.A.07 OF THE REVISED PROVINCIAL REVENUE CODE OF BULACAN ON THE DECLARATION OF REAL PROPERTY BY THE OWNER OR ADMINISTRATOR AND DUTY OF PERSON ACQUIRING REAL PROPERTY OR MAKING IMPROVEMENT THEREON Be it ordained by the Sangguniang Panlalawigan of Bulacan: SECTION 2.0.06 - DECLARATION OF REAL PROPERTY BY THE OWNER OR ADMINISTRATOR - (last paragraph) “Property owners or administrator who fal fe comply with this provision shall be subject to a fine of ONE THOUSAND PESOS {P1,000.00) or imprisonment of not ess than one (1) month or more than six (6) months or both at the discretion of the court.” SECTION 2.A.07 - DUTY OF PERSON ACQUIRING REAL PROPERTY OR MAKING IMPROVEMENT THEREON - (d) Property ovmers or administrators who fa to comply with this provision shall be subject to a fine of ONE THOUSAND PESOS £000.00) or imprisonment of not less than one (1) month or more than six (6) months both at the discretion of the court.”Resolution No. 482-S'06 Province of Bulacan Page 3 SECTION 8.8.05 - EFFECTIVITY ~ This Code shall take effect immediately.
