Issues pertaining to maintenance of wife, children and parents:

Synopsis:
The essential needs in our life are food, clothing and shelter. When the son willfully neglects the
parents , husband willfully neglects the wife , father willfully neglects the children then they have
right to file a case against the respondent(i.e., as a son or husband or father). Then the petitioner
file a case for maintenance under section 125 of Cr.P.C. (parents , children and wife can file a
case under this section) and wife can file case against her husband under section 24 (for
maintenance pendent lite and expenses of proceedings) and section 25 (for maintenance and
permanent alimony) of Hindu Marriage Act,1955.Then woman can file a case against men under
section 19( for residence orders) ,section 20( for monetary relief) and section 18 (for protection
orders) of Protection of Women against Domestic Violence Act,2005.

Maintenance can claim under Code of Criminal Procedure , 1973( for parents , children and wife),
Hindu Marriage Act,1955(for wife only), Protection of Women against Domestic Violence
Act,2005(for woman).

Goals:
The project aims to identify , on what grounds wife , children and parents can claim maintenance,
conditions for claiming maintenance and relation between section 125 of Cr.P.C and Hindu
Marriage Act , relation between section 125 of Cr.P.C and personal laws ,differences between
section 125 Cr.P.C and section 24 of Hindu Marriage Act.

Methodology:
The study will identify only the cases on maintenance in the Honourable family court and
additional family court of city civil courts, Hyderabad during the period of 04-06-2018 to 14 -
07-2018. It is difficult to cover all the cases reported as the time is short for the internship .The
reported cases will be analyzed in depth to understand its nature and issues.

Schedule:
1st week (04.6.18 to 08.6.18) - preparation and discussion of Project area/interest with project
guide.

2nd week (11.6.18 to 15.6.18) - understanding the conceptual background of the project and court
procedures.

3rd week (18.6.18 to 22.6.18) – Reviewed the Code of Criminal Procedure,1973 , Hindu Marriage
Act,1955 and), Protection of Women against Domestic Violence Act,2005 and discussed with
the project guide regarding the same.
4th week (25.6.18 to 29.6.18) – collected the cases reported in the family court and reading the
cases.
5th week (02.07.18 to 06.07.18) – analyzing the cases and provision in the act in discussion with
project guide .
6th week (09.07.18 to 13.07.18) – preparing the project report.
