Question 1

Philip made an offer to Susan, his cousin, to provide maintenance for her at the rate of RM350 a
month if she would give up her job as a typist in the civil service and study to be an accountant.
Susan agreed to accept Philip’s offer and in September 2012 she gave up her job and enrolled as
a student of an accountancy course. In August 2012 Susan had still not passed her final
examinations and so Philip advised her that he was no longer prepared to support her while she
continued her studies.

Advise Susan who wants to claim the RM350 a month.


Communication, acceptance and revocation of proposals

3. The communication of proposals, the acceptance of proposals, and the revocation of proposals
and acceptances, respectively, are deemed to be made by any act or omission of the party
proposing, accepting, or revoking, by which he intends to communicate the proposal, acceptance,
or revocation, or which has the effect of communicating it.

Acceptance by performing conditions, or receiving consideration

8. Performance of the conditions of a proposal, or the acceptance of any consideration for a


reciprocal promise which may be offered with a proposal, is an acceptance of the proposal.

Promises, express and implied

9. So far as the proposal or acceptance of any promise is made in words, the promise is said to be
express. So far as the proposal or acceptance is made otherwise than in words, the promise is
said to be implied.

Revocation of proposals and acceptances

5. (1) A proposal may be revoked at any time before the communication of its acceptance is
complete as against the proposer, but not afterwards.

(2) An acceptance may be revoked at any time before the communication of the acceptance is
complete as against the acceptor, but not afterwards.
