I. Background

Eight (8) PNB savings bank checks with Account Name Dennis L. Carnero or
Alicia A. Carnero, all payable to CASH and post-dated, were encashed by Jefferson
Agena at different dates (i.e., at Bauan, Batangas). These checks were encashed on the
premised that the checks were advanced to him to be used to pay the suppliers of rice.
Dennis L. Carnero is a retail vendor of rice at the market with residential address
at Bauan, Batangas. Further, prior to encashing another check, PNB savings bank’s
manager verbally confirmed that Dennis L. Carnero is trustworthy and reliable and that
his checks were good (i.e., Carnero is a pastor).
Meanwhile, Jefferson Agena is known at Bauan Public Market as one of the
persons-in-charge of distributing rice from the suppliers to the retail vendors with
residential address at Aplaya, Bauan, Batangas.
On 18 December 2017, one of the checks dated 16 December 2017 was deposited
but was returned by the bank on 19 December 2017 because the account was closed.
Same goes for the other checks (being under the same account).
Upon personally visiting Carnero and demanding payment for the
bounced/closed account checks, he explained that he is not liable and will not pay since
he did not directly transact with Jeannet Cordova. He explained that it was Agena who
should pay. Agena, as of December 2017, is nowhere to be found. It was later found out
that there are also other people from the market who encashed the checks of Carnero
through Agena (i.e., this amounts to more or less Php5 million).
