FACTS:

On or about September 28, 1927, Alfredo Dolores and Joseph L. Wilson,


both employees of San Carlos Milling Co., Ltd., allegedly conspired to falsify a
cable or telegraphic dispatches to order San Carlos Milling Company in
Honolulu send an amount of $100,000. They allegedly took advantage of the
situation that their manager, Alfred D. Cooper, was on leave. The said
cablegraphic message was deciphered as if the said manager had the
knowledge about the requested money to the company’s account in China
Banking Corporation which was later transferred to the Bank of the Philippine
Islands (BPI). Following the falsification of the cablegraphic message, the
accused allegedly forged the signature of their manager, named Newland
Baldwin, causing it to appear as if the check was endorsed to Alfredo Dolores.
The said check was presented to BPI for the withdrawal of the amount of Php
200,000.

ISSUES:

Whether or not the accused Alfredo Dolores is guilty as principal by direct


participation and conspiracy with Joseph Wilson?

RULING:

YES, the accused Alfredo Dolores is guilty as principal by direct


participation and conspiracy with Joseph Wilson because the evidences
showed that he had a direct participation and cooperation as the execution of
the offense. The evidence of guilt has been also proven when he tried to hide
from the authorities and attempted to flee out of the country.
