SWORN AFFIDAVIT OF WITNESS

I, Anna A. Santos, Filipino, 25 years of age, with residence at 124


Bagong Bato St. Tondo Manila., under oath, depose and state that:

1. I am the niece of Teodora A. Santos as she is the sister of my father


Benjamin A. Santos.

2. When my parents died due to an accident, I was adopted by my


aunt Teodora, who was at that time living in the above-stated residence,
to fulfil my father’s death wish. I was supported by my aunt with regard
to my necessities from then on.

3. From that time on, I accompanied my aunt together with accused


Rodolfo B. Perez, who was working as a houseboy then.

4. Sometime in the 2nd day of June, when I arrived home coming


from my work as a cashier in a convenience store, I heard my aunt
angrily shouting. Upon asking, she said that her money kept in her
cabinet amounting to TEN THOUSAND PESOS (P 10,000.00) was
missing.

5. On the same day, my aunt confronted accused Rodolfo regarding


the matter as he is usually the one who would have the access to her
room when he will be doing his everyday routine of housekeeping.

6. Considering that accused Rodolfo was the son of my aunt’s


acquaintance, who lived in the province, she put her trust on the former
in being able to have the keys in the rooms of the house.

7. However, after the confrontation, accused Rodolfo manifested


harsh attitude towards my aunt and uttered curses towards her alleging
that my aunt is humiliating him and accusing of him of doing something
that he has not done.

8. Upon witnessing the confrontation, I tried to intervene between


them but accused pushed me and stormed out of the room.

10. I tried to pacify my aunt who was emotional at that time, and told
her that we should report the incident to the Barangay Officials or to the
police station near us to file for police blotter as the accused tried to
threaten us.

12. However, my aunt refused to heed my suggestion and tried to


forget what had happened between her and the accused.

13. On June 12, 2019, I arrived from home at around 8PM, coming
from a birthday party. I was accompanied by my boyfriend, Norberto A.
Dela Cruz, a policeman who was assigned to roam around in our
Barangay.

14. When I was about to open the door with my keys, I found the
same already open, which is very unusual since my aunt would usually
make sure that the same is locked.

15. Upon opening the door, I was shocked to see my aunt lying and
covered with blood. The accused was there holding a kitchen knife full
of blood.

16. The accused then tried to escape but lucky enough, my boyfriend
was able to stop him and pushed him to the ground.

17. I hurriedly went outside and asked for help from our neighbors.

18. Meanwhile, my boyfriend immediately brought accused Rodolfo


to the nearest police station to have him confined there and to report
the matter.

19. Unfortunately, help came too late. My aunt already lost too much
blood when the ambulance arrived and my aunt was already dead upon
arrival.

20. Due to the tragic demise of my aunt, I am now left alone, and again
subjected to a very painful and heartbreaking situation of losing another
family member.
